UNCITRAL의 최근 동향 : 1976년 UNCITRAL 중재규칙 개정안의 제3회독을 중심으로 (Recent Developments : The Third Reading of the Revised Version of the UNCITRAL Arbitration Rules of 1976)

  • In 2006, the UNCITRAL Working Group II started a new project on the revision of the UNCITRAL Arbitration Rules of 1976. Ever since that time, 9 sessions of the Working Group II were devoted to the discussions on such topic. The Arbitration Rules has been acknowledged to be used for settling international disputes involving various disputing parties. In recent years, many treaty-based arbitrations have been subject to the Arbitration Rules. This article focuses on the discussions made in the 52nd session of the Working Group II where the third reading of the revised draft of the Arbitration Rules was completed except for a few provisions. Among the draft rules, the delegations were hardly able to reach an agreement with regard to Articles 2(2), 34(2), 41(3), (4), and (6). It is expected that those provisions would be agreed in the coming 43rd plenary session of the UNCITRAL. The use of the Arbitration Rules is dependent on the agreement by the disputing parties. It is not like the UNCITRAL Model Law on International Commercial Arbitration which was adopted in Korean legal system in 1999. However, the proper functioning of arbitration rules is essential for the efficient and successful operation of the arbitration system in a particular country. That is the reason why we should keep close attention on the discussions of the UNCITRAL with regard to the revision of the Arbitration Rules.

가임기 여성의 규칙적 운동 및 운동종류에 따른 대사증후군 간의 관련성 (The Association between Regular Physical Activity Types And Metabolic Syndrome in Fertile Women)

  • 본 연구의 목적은 가임기 여성의 규칙적 운동 및 운동의 종류에 따른 대사증후군 간의 관련성을 파악하여 효과적인 대사증후군 예방 및 관리 중재 개발을 위한 기초자료를 제공하고자 한다. 본 연구는 제7기 3차년도 국민건강영양조사 원시자료(KNHANES VII-3, 2018년)를 이용하여 만 19세 이상 가임기 여성 4172명을 대상으로 시행하였으며, 규칙적 운동의 종류에 따른 대사증후군 구성요소의 차이는 복합표본 t검정으로, 규칙적 운동의 종류가 영향을 미치는 대사증후군의 유병 위험은 복합표본 다중 로지스틱 회귀분석으로 분석하였다. 가임기 여성의 대사증후군 유병률은 3.1%(128명)이었으며 가임기 여성 중 규칙적 운동 실천군은 1979명(46.5%)이었다. 가임기 여성의 규칙적 운동 실천군은 미실천군과 비교하여 다섯 가지 대사증후군 구성요소 중 수축기 혈압(p =.002), 허리둘레(p <.001)와 공복혈당(p =.007)가 상대적으로 낮았으며 고밀도콜레스테롤(p <.001)는 상대적으로 높았다. 규칙적 운동 중 규칙적 근력운동 실천군은 규칙적 근력운동 미실천군과 비교하여 수축기 혈압(p <.001), 이완기 혈압(p =.005), 허리둘레(p <.001), 공복혈당(p <.001)과 중성지방(p =.015) 모두 상대적으로 낮았고 고밀도콜레스테롤(p <.001)은 상대적으로 높았다. 대사증후군에 영향을 미치는 혼란 변수들을 통제한 후, 규칙적 운동 실천군(유병교차비 0.59, 95% 신뢰구간 0.35-0.98, p =.040)과 규칙적 근력운동 실천군(유병교차비 0.34, 95% 신뢰구간 0.14-0.80, p =.013)은 각각 미실천군과 비교하여 대사증후군 유병위험이 낮게 나타났다. 그러므로 규칙적 운동은 가임기 여성의 대사증후군 유병 위험을 낮추는 중요한 변수임을 알 수 있으며, 가임기 여성의 대사증후군 예방 및 관리를 위한 운동 중재 개발 시 근력운동을 포함할 필요가 있음을 제언한다.

  • The rapid growth of Korea-China trade that was since the establishment of diplomatic relations in 1992, led China to surpass the United States and Japan to become Korea's largest trading partner in 2009. "The largest trade" also means "the most disputes", so it is essential to study on dispute settlement and enforcement system of the two. Therefore, in order to make the traders correctly understand and use the arbitration as a dispute settlement method in both China and Korea, this article makes a comparative study on arbitration system between the two countries. And finally, it analyzes the enforcement situation of arbitral award in China, then provides the author's personal recommendations as a countermeasure against the poor enforcement system in China.

한·일 해사분쟁해결과 중재제도에 관한 고찰 (A Study on the Arbitration and Maritime Dispute Resolution in Korea and Japan)

  • Arbitration is the dispute methods for speedy and economic resolutions in international commercial areas. In maritime disputes cases in East Asia, Korea and Japan are the regional benefits to cover and deal with the maritime cases on arbitration. And Korea and Japan are the competitive maritime industry for heavy shipbuilding industry, cargo carrier, processing and transhipment service on ports, and ship financial services in national competitive areas. Japan is the Tokyo maritime arbitration commission(TOMAC) as an uniquely capable of dealing with arbitrations involving problems arising in the sea field. TOMAC provides amended its arbitration rules 2014 aiming at matching with the maritime disputes circumstances with three maritime arbitration rules as ordinary rules, simplified rules and the rules of small claims arbitration procedure. KCAB however, as the unique commercial arbitration board in Korea is dealing on all of the commercial disputes on only the international commercial arbitration rules in 2011. Though KCAB is dealt with maritime dispute cases on international arbitration rules in Korea, it is small and simple compared with TOMAC in Japan. Maritime disputes are highly complicated and embroiled with multi-parties contract and subcontracts arising under contracts relating to bills of lading, charter parties, sale and purchase of ships, shipbuilding, ship financing and so forth. This paper is to provides a discussion and comparison on recently arbitration rules focus on the maritime aspects on Korea and Japan. We need to consider to make an independent and special institute and maritime arbitration rules including the multiparty consolidation and med-arb provisions for handling the disputes and resolution of maritime conflict cases in Korea.

싱가포르 국제중재제도에 관한 연구 (A Study on the International Arbitration System of Singapore)

  • These days, in line with the increase of opportunities in our country's firms to do transaction, large-scale M&A and investment with foreign firms incorporating arbitration clauses in the contracts have become general practice. Recently, Singapore has come to the fore as a place of arbitration and, particularly, Singapore International Arbitration Center (SIAC) was assessed as the favored international arbitration institution uniquely in Asia at the 2010 International Arbitration Survey: Choices in International Arbitration, along with the ICC, LCIA, and AAA/ICDR. Therefore, the country's firms need to understand properly the international arbitration procedure of Singapore. This study examines the international arbitration system of Singapore, focusing on the arbitration procedure of the SIAC. The Center revised arbitration rules twice in 2010 and 2013, and established the Court of Arbitration of SIAC in April 2013 for the first time in Asia in pursuit of stricter neutrality and promptness. It further seeks to run the arbitration procedure fairly by selecting a third country's people as an arbitrator, while its arbitration expenses are cheaper than those of the ICC. The study believes that for the country's international arbitration institutions such as the KCAB to jump forward as a world-class international arbitration institution, the Korean government should render positive support to them, learning from Singapore which does not spare any political and financial assistance to cultivate international arbitration institutions. On the other hand, KCAB should also try hard to improve in the aspects of neutrality, fairness, and promptness and to be selected as a trustworthy international arbitration institution by firms in Asian countries.

국제분쟁해결센터(ICDR)의 '긴급구제'제도('emergency relief' system)에 관한 연구 (A Study on the 'Emergency Relief' System of International Centre for Dispute Resolution)

  • This article examines the requirements of Article 37 of the ICDR International Arbitration Rules and issues that could arise if a party petitions a U.S. Federal Court to enforce an emergency arbitrator's Article 37 decision to grant pre-arbitration provisional relief. On May 1, 2006, ICDR introduced a new procedure for the granting of emergency arbitral relief under its ICDR Rules. The procedure enables a party to apply for emergency interim relief before the appointment of an arbitrator or tribunal to adjudicate the merits of the dispute. Instead, the application for emergency relief is considered by an emergency arbitrator appointed by the ICDR. In short, the ICDR has quickly appointed emergency arbitrator and resolved a challenge to an appointment within 36 hours. In addition, the emergency decisions have been issued within just a couple of weeks. In particular, we looked at what would happen after Article 37 emergency relief is granted. Based on my examination of U.S. cases on the enforceability of interim awards and orders, We conclude that U.S. courts would enforce Article 37 interim measures, whether they are characterized by the emergency arbitrator as an interim order or award. Where the situation warrants, arbitration executives should embrace and use emergency relief procedure of ICDR Rules.

순차규칙 모델링을 활용한 뇌경색증 환자 진단 분석 (Analysis for Diagnosis of Patients with Cerebral Infarction by Sequence Modeling)

  • 본 연구는 데이터 마이닝 기법 중 하나인 순차규칙 모델링을 활용해 뇌경색증 환자의 진단을 분석함으로써 뇌경색증의 선행질환과 합병증을 파악하고 이를 최소화할 수 있는 중재 개발에 기초자료를 제공하고자 시도되었다. 뇌경색증 환자의 진단 관련 데이터는 대구에 위치한 A 의료원에서 2000년에서 2007년 사이 뇌경색증으로 진단받은 환자의 관련 데이터를 추출하여 일괄분석을 위해 데이터마트를 구축하였다. 대상 의료 기관에서 총 2,267명이 뇌경색증을 진단 받았고 추출된 진단 데이터는 총 32,692건이었다. 데이터 분석은 Clementine 12.0의 순차규칙 모델링을 이용하였고 8개의 의미 있는 규칙이 발견되었다. 본 연구 결과는 2차 뇌경색 발생 예방 프로그램 개발 및 뇌경색증 환자의 합병증 예방 중재 개발의 기초자료로 활용할 수 있을 것으로 기대된다.

요양병원 입원 노인의 수면 양상 및 영향요인 (Sleep patterns and it's influencing factors of hospitalized elderly in long-term care hospital)

  • 본 연구는 노인요양병원 입원노인의 수면양상 및 영향요인을 파악하여 이들의 수면의 질 향상을 위한 중재프로그램 개발 시 기초자료로 활용하고자 시도된 서술적 조사연구이다. G시 노인요양병원에 입원한 65세 이상의 노인환자 142명을 대상으로 구조화된 설문지와 24시간 수면기록지를 사용하여 자료 수집하였다. 요양병원 입원노인의 일일 평균 수면시간은 10.7시간이었으며 낮 수면시간은 평균 3.9시간, 밤 수면시간은 평균 6.8시간 이었다. 총 수면규칙성은 71.7%였고, 낮 수면규칙성은 평균 58.1%, 밤 수면규칙성은 평균 80.5%였다. 요양병원 입원노인의 수면시간에 영향을 주는 예측요인은 병실 내 치매환자 유무로 10.3%의 설명력을 나타냈고, 수면 규칙성에 영향을 미치는 예측요인은 통증, 병실 내 치매환자 유무, 신체기능으로 16.1%의 설명력을 나타냈다. 따라서 요양병원 입원노인의 수면양상에 영향을 미치는 추가요인 규명을 위한 후속 연구의 필요성과, 본 연구에서 확인된 요양병원 입원노인의 수면에 영향을 미치는 요인을 고려한 중재프로그램 개발 및 적용이 필요하다.

  • The Federal Maritime Commission is issuing new regulations implementing the Administrative dispute Resolution Act. The new regulations expand the Commission's Alternative dispute resolution(“ADR”) services, addressing guidelines and procedures for arbitration and providing for mediation and other ADR services. This rule replaces current subpart U-(Conciliation Service), with a new subpart U-(Alternative Dispute Resolution), that contains a new Commission ADR policy and provisions for various means of ADR. The rule also revises certain other regulations to conform to the Commission's new ADR policy. So, this paper object was to study on the FMC's ADR in U.S. with the emphasis on the final rule analysis.

  • An Arbitration agreement is one kind of contracts between two or more contracting parties; any possible disputes that arise concerning a contract will be settled by arbitration. The parties are free to agree on the number of arbitrators. The role of the arbitrator is so significant in the arbitration system that its success or failure may depend on the credibility of the arbitrator. The purpose of this paper is to examine the specific elements of the Arbitration Clause through arbitration laws, arbitration rules and the related cases, to introduce the standard clause which are recommended by the international institution and the individual countries, and to make the parties of international commercial contracts reflect them in their contracts. Thus this author would like to recommend the famous and well known the Standard Clause which were drafted by international institution such as ICC and UNCITRAL or individual countries.(LCIA, AAA, CIETAC, KCAB)
