본 논문에서는 정보통신망 이용촉진 및 정보보호 등의 관한 법률에서 '타인'의 범위에 관한 해석을 논점으로 삼고 있다. 대법원은 위 법 제49조의 '타인'의 범위에 관한 해석에서 생존한 사람뿐만 아니라 사망한 자도 포함하여 해석하고 있다. 물론 동법의 사자(死者)도 정보통신망의 안정성과 정보의 신뢰성 확보를 위해 포섭하여 해석할 수 있다는 견해가 존재할 수 있지만 형법 및 형사특별법은 죄형법정주의라는 이념상 허용될 수 없다는 견해가 타당하다. 형사법의 해석은 형벌이라는 가혹한 법률효과를 예정하고 있으므로 형벌법규의 해석은 엄격해야 하고 명문규정의 의미를 피고인에게 불리한 방향으로 확장해석하거나 유추해석을 해서는 안된다. 만약 동법 제49조의 '타인'의 범위에 사자(死者)를 포함한다면 법률해석의 방법인 문리해석, 논리해석, 목적론적 해석, 헌법 합치적 해석에도 반하므로 동법에서 '타인'의 범위에 사자(死者)를 포함시키고자 한다면 동법의 개정을 통해 법규 수범자에게 예측가능성을 확보할 수 있도록 용어의 분명한 정의규정이 입법을 통해 반영되어야 한다.

After feeding mixed samples, VS ranged from 60 to 80% of total costs in 15 days. EC ranged from1.21 to 2.45, 1.25 to 2.1 and 1.2 to 1.88mS/cm when worms were fed with a mixture of by-products of tidal current and sewage sludge, a mixture of by-products of algae producy, and food wastes and a mixture of by-products of algae producy, sewage sludge and food wastes. That means the kinds of mixture don't have any negative impacts on worms survival. With the feed with a mixture of by-products of algae producy and food wastes and a mixture of by-products of algae producy, sewage sludge and food wastes, pH shows stable 5.4 to 6.7, and 6.2 to 7.4 where is suitable for worms. But a mixture of by-products of algae producy and sewage sludge is out of proper scope for raising worms, in other words, extra care will be necessary. In case of Eh, a mixture of by-products of algae producy and sewage sludge make eh negative (-) in early stage so also when feeding worms, also extra care will be needed. NaCl ranged from 0.32 to 0.82% or form 0.23 to 0.61% when a mixture of by-products of algae producy and food wastes and a mixture of by-products of algae producy, sewage sludge and food wastes were fed. So taking care of salts will be essential whenever feeding.

This study aims to compare the government accounting reform of advanced countries and South Korea and suggest policy implications for South Korea. The reform steps are structured down to institutional introduction, institutional formation and institutional stability. I researched the literatures on the government accounting system and compiled research materials from the Finance Ministries, Audit Offices, and Government Accounting Standards Boards websites of New Zealand, US, UK and South Korea. Analysis showed that advanced countries and South Korea have adopted accrual accounting systems which have provided more comprehensive and objective financial information. But the government accounting system of South Korea compared with those of advanced countries needs reform. The suggestions of this study include: expanding range of whole of government financial statements; giving coherence to the public accounting standards; adopting government audit system; and introducing accrual budgeting. However, there are differences between business accounting and government accounting and the differences are considered for government accounting reform.

When the construction management method was introduced, there were arguments regarding the contractual responsibility of the construction manager. Accordingly, the provisions on damage compensation in the Construction Technology Management Act were revised in 2002, and the obligatory duty of care of a good manager is now required by the Framework Act on the Construction Industry. Even though the construction manager has a responsibility of a consultant in the CM-for-fee contract, however, the Korean construction environment does not clearly specify the consultant's scope of responsibility. In this study, the theory about the duty of care, which is a consultant's responsibility among the expert's responsibilities, was arranged. Based on the responsibilities of experts such as lawyers, the duties of care of a good manager of the construction manager were presented to provide the foundation for establishing the construction manager's responsibilities. To verify the resulting items, interviews with experts were performed to assess their importance levels.

Different from the previous studies which investigated seismic P-$\Delta$ effect in slender columns though comparison of response spectra according to stability coefficients obtained from the analyses based on the assumed moment-curvature relationship, the axial force and P-$\Delta$ effect in RC columns are investigated on the basis of the layered section method which can effectively consider the changes of stiffness and yield strength due to the application of axial force in RC members. Practical ranges of slenderness and stability coefficient are assumed, and sixty sets of horizontal/vertical earthquake inputs are used in the analysis. From the parametric study, it is noted that the maximum deformation of the slender RC column is hardly affected by P-$\Delta$ effect or vortical earthquake but dominantly affected by the applied axial force. Therefore, it can be concluded that no additional consideration for the P-$\Delta$ effect and vortical earthquake is required in the seismic design of a slender RC column if the axial force effect is taken into account in the analysis and design procedures.

In opportunistic networks, each message is delivered to the destination by repeating, storing, carrying, and forwarding the message. Recently, with the vitalization of social networks, a large number of existing articles have shown performance improvement when delivering the message and considering its social relational networks. However, these works only deliver messages when they find nodes, assuming that every node cooperates with each other unconditionally. Moreover, they only consider the number of short-term contacts and local social relations, but have not considered each node's average relation with the destination node. In this paper, we propose novel message sending techniques for opportunistic networks using nodes' social network characteristics. In this scheme, each message is delivered to the destination node with fewer copies by delivering it mostly through nodes that have high intimacy with the destination node. We are showing that our proposed scheme presents a 20% performance increase compared to existing schemes.

전차 선로용으로 적용되는 직류 피뢰기의 설계 기술을 소개하였다. 현재 국내에 사용되는 전차 선로 서지 보호용 직류 피뢰기는 전량 수입에 의존하고 있다. 안전한 피뢰기를 설계하기 위해서 적용 구간의 임펄스 서지 환경을 파악하고 이에 맞는 적절한 내량의 피뢰기를 설계하는 것이 요구된다. 특히 직류 구간의 경우 과도 서지 발생의 형태가 기존 계통 환경과 다르기 때문에 피뢰기 보호범위와 정격의 설정에 주의가 요구된다.

몇 년 전 제주도의 소나무 묘포장에서 급격히 생장이 떨어지다가 결국 나무가 죽는다는 피해 진단 의뢰가 있어 현지 조사를 하였다. 병원균을 동정(同定)한 결과 자주날개무늬병(Helicobasidium mompa)에 의한 피해로 밝혀졌다. 자주날개무늬병은 과수, 뽕나무, 느릅나무, 은행나무, 참나무류, 편백나무 등 넓은 기주범위를 가지며 특히 사과나무에 큰 피해를 주는 것으로 알려져 있다. 우리나라에서는 소나무에 공식적인 보고기록은 없으나 본병과 발생지의 특성을 파악하여 소나무 묘목관리에 주의를 요하는 의미에서 이 병을 소개한다.

본 자료는 도청에 관한 국내 언론에 비친 내용들을 발췌하여 정리한 것이다. 본 자료를 통해서 알 수 있었던 것은 공산주의 몰락으로 인한 각국의 첩보나 정보 수집 대상국이 적국이 아니라 이익이 된다면 어떤 국가라도 대상으로 한다는 점이다 또한, 대상 정보도 경제 전쟁으로 불리울 만큼, 군사용만이 아니라 과학, 기술. 금융. 경제 등의 경제 관련 정보로 확대되었다는 점이다. 그리고 개인들의 사생활 정보도 도청에 의해 쉽게 침해되고 있으며 기업대 기업간 국가대 국가간 해당범위를 가리지 않고 도청이 행하여지고 있으며 도청 기술도 상상을 초월할 정도로 발전하고 있음을 알 수 있었다.

윤리란 인간이면 누구나 지켜야 할 도리를 말하며, 비 윤리라 함은 정상적인 범주를 벗어나는 행위를 지칭한다. 문제는 사람에 따라서 정상의 범위가 다르다는 점이다. 사람마다 저마다의 가치관이 있고 자라온 배경이 있기에 윤리적이냐 비윤리적이냐의 기준이 때론 모호할 수가 있다고 본다. 대다수의 종교인들은 변하지 않는 윤리적기준이 있다고 믿기에 다분히 절대주의적 관점을 가지고 있으며 상황주의자들은 이 세상에 절대란 존재하지 않으며 상황에 따라 얼마든지 선악의 기준이 달라질 수 있다고 신봉하고 있다. 우리는 이러한 다양한 사람들이 함께 사는 세상에서 모두가 공감할 수 있는 윤리적 기준을 모색하여 이를 공유함으로써 적절한 윤리적 가이드라인을 만들어 내는 것이 시급한 일이라 생각된다.
