Korean Style System Model of Financial ADR (한국형 금융ADR의 제도모델)

  • "Financial ADR" system in South Korea can be represented by so-called "Financial Dispute Resolution System", in which Financial Supervisory Service (FSS) and Financial Dispute Resolution Committee are the principal actors in operation of the system, and this is discussed as an "Administrative Financial ADR System". The system has over 10-year history since it was introduced in around 1999. Nonetheless, it was not until when financial consumer protection began to be highlighted after the 2008 financial crisis that Financial ADR system actually started to draw attention in Korea. This was because interest has been rising in "Alternative Dispute Resolution (ADR)" as an institutional measure to protect financial consumers damaged via financial transactions. However, the current discussion on the domestic Financial ADR system shows an aspect that it is confined to who is to be a principal actor for the operation of Financial ADR institution with main regards to reorganization of supervisory system. This article aims to embody these facts in an institutional model by recognizing them as a problem and analyzing the features of the Financial ADR system, thereby clarifying problems of the system and presenting the direction of improvement. The Korean Financial ADR system can be judged as "administrative model integrated model consensual model quasi-judicial model non-prepositive Internal Dispute Resolution (IDR) model". However, at the same time, it is confronted with a task to overcome the two problems; the system is not equipped with institutional basis for securing its validity in spite of the adopted quasi-judicial effect model; and a burden of operating an integrated ADR system is considerable. From this perspective, the article suggests improvement plans for security of validity in the current system and for expansion of industry-control ADR system, in particular, a system of prepositive IDR model. Amongst them, it suggests further plans for securing the validity of the system as follows; promotion to expand the number of internal persons and to differentiate mediation procedures and effect; a plan to keep a financial institution from filing a lawsuit before an agreement recommendation or a mediation proposal is advised; and a plan to grant suspension of extinctive prescription as well as that of procedures of the lawsuit.

Usefulness of Reverse Flow Prevention Valves for Back-flow Prevention of Gadolinium Based Contrast Agent in Dynamic Examination of Magnetic Resonance Imaging (자기공명영상 동적검사 시 조영제 역류방지용 밸브의 유용성)

  • The purpose of this study is to seek an alternative method to prevent the contamination of normal saline caused by the back-flow of Gadolinium Based Contrast Agent(GBCA) by the use of auto-injector for dynamic MRI. The research method is to manufacture the non-return valve as an alternative to the existing, and to examine the usefulness of the normal saline by dividing the state of normal saline into three groups. The signal intensity were compared. As a result, there was no statistically significant difference between normal saline before injection of group 1 and group 3 non-return valve (p> 0.05). It is analyzed that the self-produced non-return valve completely blocked the GBCA back to normal saline when the GBCA was injected. In conclusion, the application of the non-return valve presented in this study for dynamic MRI imaging using the auto injector can prevent normal saline contamination due to GBCA back-flow.

  • The purpose of this study is to present and identify the relationship for the effects of performance-based human resource practices on the organizational effectiveness with focusing on small and medium-sized enterprises around Shandong province of China. The performance-based human resource practice factors include selective employment system, education training system, evaluation system, compensation system and the career promotion ladder opportunity system. As a result, among ten hypotheses, six hypotheses turned out to be the meaningful approaches. In addition there exist some human factors that interfere with the fairness of the evaluation due to the regional and personal factors, assessment system difference among firms. Finally the compensation system and organizational investment for increasing or decreasing will critically affect the enthusiasm of the staff members of firms, and the less invested for thema, the greater the likelihood of their turnovers.

  • Purpose: The aim of this study is to reveal necessity of orthoptist system in Korea, by comparative analysis between the orthoptist system of developed countries and the present condition in Korean ophthalmic clinics. Methods: Choosing 4 developed countries, we surveyed their education systems, license requirements and process, and service coverage. An inquiry into desirable Korean orthoptist system was added on the basis of the comparative survey. Results: The developed countries have systems in which professional orthoptists, who have got their licenses after official education, do the eye examination under the supervision of ophthalmologists. On the other hand in Korea, a problem is revealed that opticians play a role of eye-examiner in the ophthalmic clinics without any institutional support. Conclusions: The legalistic basis is quite needed in Korea that permit optometry graduates to be eye-examiners in the ophthalmic clinics, by introducing the orthoptist system.

Terminological Misuses and Institutional Coherence in Electoral Systems (선거제도의 개념 오용과 정합성: 비례대표성을 중심으로)

  • In the process of changing the Korean electoral system, various terms such as representation, majority, minority, plurality, and proportionality are not used correctly, making normative judgment on its desirable electoral system difficult. This paper clarifies the concepts and terminology related to the electoral system in order to enable proper normative discussion. First, the misuse of the names of the electoral system is reviewed. This includes the majority representative system versus the minority representative system, the single-member constituency versus the multi-member constituency, the absolute majority system versus the relative majority system, and the majority representative system versus the proportional representative system. Next, the principles of representation, proportionality, democracy, direct ballot, and equal ballot are discussed to evaluate the decisions made by the Constitutional Court of Korea. In the current electoral system of the National Assembly, the equivalence between its constituency member and its proportional representation member is very low in terms of proportionality between votes received and seats allotted. Finally, the coherence between proportional representation and other political institutions is examined. Strengthening the proportionality of parliamentary elections alone does not necessarily increase the proportionality of the entire power structure.

Comparison of finite element analysis of the closing patterns between first and second premolar extraction spaces (상악 제1 및 제2소구치의 발치공간 폐쇄기전에 대한 3차원 유한요소 해석의 비교 연구)

  • The aim of this study was to compare the differences in closing extraction spaces between maxillary first premolar and second premolar extractions using 3-dimensional finite element analysis (FEA). Methods: Maxillary artificial teeth were selected according to Wheeler's dental anatomy. The size and shape of each tooth, bracket and archwire were made from captured real images by a 3D laser scanner and FEA was performed with a 10-noded tetrahedron. A $10^{\circ}$ gable bend was placed behind the bull loop on a $0.017"{\times}0.025"$ archwire. The extraction space was then closed through 12 repeated activating processes for each 2mm of space. Results and Conclusions: The study demonstrated that the retraction of anterior teeth was less for the second premolar extraction than for the first premolar extraction. The anterior teeth showed a controlled tipping movement with slight extrusion, and the posterior teeth showed a mesial-in rotational movement. For the second premolar extraction, buccal movement of posterior teeth was highly increased.

  • A "high-potential employee" is an employee who has been identified as having the potential, ability and aspiration for successive leadership positions within the company and identify employees who have the greatest future potential and make them future-ready to take your organization to success. The primary purpose of this paper is to investigate the relationships of corporate performance on the high potential employee system using the samples from HCCP panel data. This study seeks to identify a significant high potential employee system though empirical research as well. Results of empirical study are summarized. Finally suggestions, implications and limitations of the present study are also discussed. In this article, we explore the role of competitive strategy and technological environment in the introduction of high-potential employees and its link to impact of these performance.

Fundamental Study on the Strength Development of Cement Paste using Hardening Accelerator and High-Early-Strength Cement (경화촉진제와 조강시멘트를 사용한 시멘트 페이스트의 강도발현에 대한 기초적 연구)

  • The purpose of this research is to verify the performance of hardening accelerator in cement paste through mechanical performance evaluation and micro structure analysis on hardening accelerator for development of super high early strength concrete. The research results showed that hardening accelerator produced $Ca(OH)_2$ when hydrated with cement, enhancing the degree of saturation of Ca ion by using differential thermal analysis. Moreover, porosity was reduced rapidly as capillary pores were filled by hydration products of $C_3S$. According to the experiment using hydration measurement testing, when 1% and 3% of accelerator were mixed, hydration rate increased toward the second peak point compared to high early strength cement, before the first peak point disappeared. It turned out that adding accelerator accelerated the hydration rate of cement, especially $C_3S$. The shape of C-S-H is shown depending on the amounts of accelerator added and the production and age of $Ca(OH)_2$ by using SEM to observes hydration products. Therefore, it's evident that hardening accelerator used in this research increases amounts of $Ca(OH)_2$ and accelerates $C_3S$, it is effective for the strength development on early age.

  • The frequency of official injury of fire-fighting officers exposed to an extreme situation in disaster areas has been continuously increased. In spite of increase of injury, procedures of injury approval are complex, so the working environment of fire-fighting officers is very poor in terms of safety management. This study was, therefore, conducted to provide basic data for improvement of the injury management system for fire-fighting officers, by empirically analyzing the system for those in Busan city. The findings of the empirical analysis are as follows: first, the frequency of injury experienced by them is higher than that of other occupations; second, application for injury is not actively made; third, fire-fighting officers should bear the expense if injury is approved. On the basis of such an analysis on actual conditions, an analysis on policy factors for improving the injury management system shows; first, various high-risk matters should be considered in the review of application for injury, for improvement factors of the application for injury, while it is necessary to extend the benefit and support project for injured officers, for operation improvement factors of the injury management system, and the compensation act should be improved, for the improvement factors of the injury system. Second, it is urgent to develop damage prevention and coping education program for improving the injury management system. In addition, the simplification of administrative procedures of application for injury and the extension of benefit and support project for injured officers should be realized as soon as possible, moreover, the enhancement of directors' interest and support is also required.
