웹 콘텐츠의 특성상 분배, 복제 및 조작이 용이하기 때문에 원 정보의 저작권 침해로 인한 재산권 침해 피해가 나날이 증가하고 있어, 막대한 비용이 투자된 웹 콘텐츠의 무단도용을 방지하고 분쟁 발생시 소유권에 대한 분쟁을 해결하기 위한 노력이 계속되고 있다. 본 논문에서는 웹 콘텐츠의 소유권 및 저작권 보호를 위한 오디오 콘텐츠에 대한 워터마크 생성, 삽입 및 검출, 검증 시스템을 설계 및 구현한다. 본 시스템은 저작권 보호에 대한 전문지식이 없는 일반관리자도 용이하게 이용할 수 있는 사용자 인터페이스를 갖추고 있으며, 이러한 디지털 오디오 워터마킹의 적용을 통한 소유권 및 저작권 보호는 궁극적으로 콘텐츠 제작 의뢰자로 하여금 제작 의지를 강화하여 제작 의뢰 건수를 증가시킬 수 있을 것으로 기대되어 문화콘텐츠 등의 디지털 콘텐츠 제작업체의 매출 신장에 도움을 주게될 것이다.

This study was conducted to examine the effects of Internet ethics education. To do so, I compared the knowledge, affectivity and behavior of students on the copyright infringement between before and after Internet ethics education. The subjects of study were 150 students who had taken Internet ethics course in university. Upon comparing their knowledge and affectivity on the copyright infringement between before and after Internet ethics education, they scored higher after education than before, which was statistically significant. The subjects' behavior on the copyright infringement had a tendency to increase after education, but there were not significantly increased. This result showed that the current Internet ethics education has some limitation in making the students practice what they know. To resolve this problem, it is important to do early-childhood Internet ethics education. And more research on diverse teaching and learning methods in Internet ethics education is needed to produce educative results.

In the Korean litigation system, structural maldistribution of evidence still remains a conundrum. Numerous solutions have been discussed so far and, today, few people deny the need for adopting a system similar to the discovery procedure in the United States. In the intellectual property (IP) domain, a wide range of legislative attempts have been made to improve the litigation system, especially for patent litigation. However, the adoption of discovery in copyright litigation is seldom discussed, despite the fact that copyright infringement lawsuits increasingly involve highly technical issues, especially in case of copyrightable computer programs. The lack of discussion on discovery adoption forms a stark contrast with the active attempts to adapt and adopt discovery procedure for patent litigation. In copyright infringement lawsuits, especially for copyrighted computer programs, securing evidence takes on crucial importance. However, in reality, there are numerous obstacles. Some lawsuits proceed even without properly securing the infringed work. To address this issue, the current litigation system needs to be improved by adopting a procedure similar to discovery. This paper reviews what solutions are being utilized today, and how we should approach the issue.

The study aims to examine the UCC (User Created Contents) Copyright which use the broadcasting contents. UCC are classified by UGC(User Generated Contents), UMC(User Modified Contents), and URC(User Recreated Contents). Especially UMC and URC correspond to a problem of copyright. Following the Copyright Protection Center investigation in 2006, it reported that 83.7% UCC are infringement of copyright. In spite of remarkable the UCC copyright problem, the concrete resolution does not exist. Also it is difficult to apply the offline legal conformity because of online nature of the UCC. The study observes the UCC copyright dispute instances which use the broadcasting contents and investigates a resolution of the UCC copyright. Considering the online media nature, it tries to analyse CCL(Creative Common License) as the ODR(online Dispute Resolution). It is meaningful to search the possibility of UCC copyright problem through the online technical embodiment.

In knowledge-based society, various forms of visible and invisible works are produced and published. As production and distribution of those works are increased, importance and value of copyright are gradually emerged. In the light of importance, students must learn and understand the concept and the right use of copyright as early as possible. Scales that students experience in the introduction stage of the class take the role of Advance Organizer. Through these scales, students can combine concept of copyright into their existing recognition structure and are interested in study contents. According to test results, it is concluded that the proposed system is very useful to enhance copyright consciousness for students.

MP3 문제는 아직도 저작권 문제에 대해 논란이 많다. 하지만 뚜렷한 대안이 서지도 않고 법적으로나 기술적으로 저작권 침해라는 문제에 대해서 해결책이 없는 것이 사실이다. 분명한 것은 기존의 음반 업계나 냅스터와 같은 MP3 유통사 사이에 상호협력을 통한 해결책은 분명 있을 것이다. 분명한 것은 소비자들의 의식인데 이미 MP3는 인터넷 사용자들 사이에 보편화된 만큼 새로운 수익구조 창출을 통한 저작권 문제 해결책이 바람직할 것이다. 이에 미국의 MP3 저작권 문제에 대한 미국전문가의 글을 독자들에게 전달하고자 한다.

한국잡지협회(회장 이창의)는 지난 9월 8일 프레스센터 19층 기자회견장에서 회원 및 회원사 임직원 150명을 대상으로 2011 잡지발전세미나를 개최했다. '새로운 미디어 환경속에서의 잡지산업'이라는 대주제로 진행된 이번 세미나에서 박광무 한나라당 수석전문위원이 '문화산업정책의 방향과 잡지산업 발전전략'에 대해, 윤용근 법무법인 송현 변호사가 '잡지와 저작권 이야기(저작권 실무)'에 대해 발표했다. 본지는 윤용근 변화사의 '잡지와 저작권 이야기'발제를 요약 정리한다.
