자율주행자동차 시험운행에 관한 각국 법안의 비교 및 정책적 시사점

  • 사물 인터넷, 클라우드 컴퓨팅, 인공지능, 빅데이터 등 첨단 정보통신기술을 활용하여 모든 사물들의 지능화와 초연결을 지향하는 것을 나타내는 4차 산업혁명에 대한 관심은 나날이 증가하고 있다. 4차 산업혁명과 관련된 다양한 분야의 기술들 중에서 인공지능을 활용한 자율주행자동차 기술과 관련하여 논의를 진행하고자 한다. 여러 국가에서는 자율주행자동차 시장선점을 위해 관련 기술의 발달에 몰두하고 있다. 그러나 자율주행자동차의 상용화를 위해서는 기술의 발달뿐만 아니라 관련 법제도의 정비가 더욱 필수적인 요소라고 본다. 자율주행자동차가 안전성을 보장할 수 있도록 시험운행에 대한 규제를 완화시켜야 할 것이며, 향후 상용화가 될 경우 야기될 수 있는 민사적 손해배상문제와 형사책임의 문제, 과실책임의 문제, 사이버 보안문제 등을 대비할 수 있는 법제도 마련을 촉구하고자 한다. 타국가와의 자율주행자동차 법제도 비교분석을 통해 우리나라의 도로교통법과 기존 법 제정상태를 고려하여 법안 마련에 방향성을 설정하는 데에 목표를 두고 있다.

Legal Basis and Suggestions on Road Driving Eligibility of Autonomous Cars (자율주행자동차의 도로 주행에 대한 법적 근거 및 개선 방안)

  • In autonomous car, significant progress has been achieved in technical aspects, but it is deadly slow to solve its various legal problems for commercialization of autonomous car. This paper surveys the road driving eligibility, a typical legal issue in autonomous car. Problems on current laws and regulations are analyzed, and some remedies are suggested. Technical development should be performed collaboratively with law and regulation revision, and understanding these legal issues would be very helpful to the engineers who develop autonomous cars.

  • Although there have been many studies on laws and systems for the proliferation of autonomous vehicles, studies on the activation of autonomous vehicles from a strategic perspective are insufficient. This study examines the issues and problem solving methods of autonomous vehicles. Based on this, plans to activate autonomous vehicles from a strategic point of view are proposed. In order to solve the issues and problems of autonomous vehicles, it is necessary to clearly establish legal and institutional standards based on the reinforcement of the safety of autonomous vehicles. In the event of a traffic accident, who is responsible for the accident and responsibility for compensation should be prioritized. Diffusion strategies are established according to the level of autonomous driving for the activation of autonomous vehicles in strategic perspective. In addition, governmental support policies should be used as triggers for initial activation, and marketing mix strategies should be implemented based on segmentation, targeting, and positioning strategies.

  • 자율주행차는 운전자가 직접 조작하지 않아도 자동차가 주변 환경을 인식해 위험을 판단하고 주행경로를 계획하여 운전자 주행조작을 최소화하며, 스스로 안전운행이 가능한 인간 친화형 자동차이다. 각국은 프로젝트 등을 통해 기술개발을 지원하고 법제화로 후원하고 있는데, 사람이 운전하지 않는 자율주행차가 도로 위를 달릴 수 있는지 논란이 되고 있어 '운전자가 제어하는 차'를 기준으로 관련법을 제정하고 있다. 업체들은 공공도로에서 주행할 수 있는 임시허가를 받아 자율주행차를 시험주행하는 등 개발에 박차를 가하고 있다.

Development of Dilemma Situations and Driving Strategies to Secure Driving Safety for Automated Vehicles (자율주행자동차 주행안전성 확보를 위한 딜레마 상황 정의 및 운전 전략 도출)

  • Most automated vehicle evaluation scenarios are developed based on the typical driving situations that automated vehicles will face. However, various situations occur during actual driving, and sometimes complex judgments are required. This study is to define a situation that requires complex judgment for safer driving of an automated vehicle as a dilemma situation, and to suggest a driving strategy necessary to secure driving safety in each situation. To this end, we defined dilemma situations based on the automated vehicle ethics guidelines, the criteria for recognition of error rate in automobile accidents, and suggestions from the automated vehicle developers. In addition, in the defined dilemma situations, the factors affecting movement for establishing driving strategies were explored, and the priorities of factors affecting driving according to the Road Traffic Act and driving strategies were derived accordingly.

  • As the development automated vehicles(AV) actively progresses around the world, the demand for a reasonable and systematic evaluation method for AVs is increasing. Research on scenarios, evaluation procedures, and methods for evaluating AVs conducted in simulations and proving ground(PG) is actively conducted internationally. In contrast, methods and procedures for evaluations on real roads are still in their infancy internationally. Therefore, it is necessary to conduct research on evaluating AVs on real roads in preparation for future use of AVs. This study aims to define the basic direction for evaluating the driving safety of AVs on real roads. To this end, the evaluation direction and process of AVs were presented on the real roads, and qualitative and quantitative evaluation indicators were selected to evaluate driving safety. A total of 38 items were selected based on the Road Traffic Act as qualitative evaluation items for evaluating the driving safety of AVs on real roads.

  • In the commercialization stage of level 4 or higher autonomous driving, the need for new legal system related to drive safely has increased in order to meet the improved level of technological development. Especially human drivers should not be legally accountable for road safety in the era of autonomous vehicles and thus safety standards for operation of autonomous vehicles are significant. To address this issue, the German Road Traffic Act was revised in 2021, adding provisions corresponding to the commercialization of self-driving vehicle of level 4 and in the similar context the Japanese Road Traffic Ac was amended in 2022. This Article draws implications for legislative discussions on driving-related responsibilities of driverless autonomous vehicle to ensure driving safety in Korea through recent amendments in Germany and Japan.

  • Last year, the Autonomous Vehicle Act was enacted to respond to deployment of autonomous vehicles. But the Act stipulates the operation of autonomous vehicle pilot zones, In addition, in order to analyze autonomous vehicle accidents and establish a reasonable damage compensation system, the Automobile Damage Compensation Guarantee Act was revised. But, It is necessary to seek plans for institutional development such as detailed concepts of self-driving cars and driving, a security certification system for securing safety of autonomous cooperative driving, and enhancement of the effectiveness of special cases related to personal information processing. I would like to seek ways to improve the legal system to respond reasonably to the deployment of autonomous vehicles.

  • Recently, the automobile industry is rapidly changing due to autonomous vehicles based on advanced ICT technology. As a result, studies related to autonomous vehicles have also been actively conducted. However, most studies are focusing on the autonomous driving technology so that the prediction of changes in road traffic safety and associated legal system due to the introduction of autonomous vehicles are lacking. The purpose of this study is to suggest improvement methods and priorities of road traffic safety projects according to the introduction of autonomous vehicles. As a result of the AHP analysis using the results of the questionnaire surveyed for autonomous driving car experts, it was analyzed that revision of the traffic safety inspection law and development of education system for autonomous driving motor drivers and operators should be given top priority.

  • 현시대에 자율주행 기술이 자동차를 단순 이동수단에서 이동성을 확보한 생활공간으로 자동차의 근본적인 개념을 변화시켜 새로운 산업 패러다임적 가치뿐 아니라, 사회 경제적 변혁을 예고하고 있다. 이미 전 세계적인 기업들은 자율주행 시스템을 구축하고 개발하여 실제 생활에서 활용도 하고 있다. 그럼에도 불구하고 상용화를 하기 위해선 아직 법/제도의 부재, 안정성, 가격 등 여러부분에서 문제점들을 극복해야한다. 본 과제인 라인트레이서와 GPS를 활용한 자율주행시스템이 목적지를 지정하면 자율적으로 길이나 도로를 따라 이동하면서 장애물을 피해가게 만들어 안정성을 확보하고 이동하는 시간에 개인 여가 시간이나 생산적인 활동을 할수 있게 만들어 삶의 질 개선에 기여할 것이다. 이러한 기술들을 적극 활용하여 목적지를 설정하면 자율주행 하는 자동차로 설정하였고, 장애물 감지와 현재 방향 감지를 추가하였다. 장애물 감지와 방향 그리고 위치를 수신받기 위해 5개의 센서를 활용하였고 한번에 구동을 시키기 위해 센서 쉴드를 활용하여 기능을 확장 시켰다.
