A Study on Actual Conditions of Industrial Safety Regulations - Based on Petrochemical Plant - (산업현장에서의 안전규제 적용실태 연구 - 석유화학공장을 중심으로 -)

  • Without a special mineral resources in Korea, such as petrochemical industries, electronics and automotive industries to supply the basic material, but remains a key industry locations. Gongjeongsang dealing with hazardous materials, such as a fire or explosion hazard, and from this site sangjonhae safety regulations to protect human and material disaster prevention activities are focused. However, depending on the actual implementation of standardized safety regulations as necessary if not originally intended, proper objectivity and reliability of safety regulations, as well as impaired resulting in a waste of public and private administrative power and petrochemical industries and the competitiveness of the entire drop factor will. Accordingly, this study petrochemical plant is applied to a representative safety regulations, items for their safety are needed and these regulations as being implemented that was identified, according to a study, some of the need for regulation and implementation both in terms of reliability was low.

  • 대단위 건축물 및 구조물 철거작업시 철거사업 참여 주체인 발주자, 감리자, 시공자 및 근로자등의 안전사고 예방을 위한 사전 위험성평가 및 안전대책 수립, 수립된 안전대책 이행에 대한 역할이 매우 중요하다. 건축물 및 구조물 철거작업 공법은 인력철거공법 및 장비철거공법, 발파철거공법으로 구분되며 발파철거공법 적용시 발생되는 소음 및 진동을 계측하여 환경규제 기준내로 준수해야 한다. 본 연구는 발파공업에 의한 철거작업시 국내·외 소음 규제치 비교를 통해 국내의 발파공법에 의한 소음 규제치를 합리적으로 조정하여 건축물 및 구조물의 철거작업시 발파공업의 채택이 활성화 되기를 기대한다.

  • Since accidents of hazardous material transport vehicle on roadways cause severe damage in the form of disaster, foreign countries have long been engaged in systematic management and establishment of relevant laws and policies for the road safety. Recently, over 10-kilometer long tunnel, such as Inje-Yangyang Tunnel and Geumjeongsan Tunnel, has been opened on the expressway and the production of various hazardous materials is increasing with the development of chemical technology. However, road laws related to the safe operation of hazardous materials transport vehicles are still lacking, and policy measures for managing them have not been specified. It is an important task to recognize the risk of accidents of hazardous material transport vehicles and to secure road safety by establishing a management plan for road managers. Therefore, this study analyzed the feasibility of the traffic regulation of expressway tunnel in South Korea and suggested a direction for management. The results of this study can be utilized as the primary data for the revision of law related to hazardous materials transport vehicles on roadways and the derivation of optimal route of hazardous materials transport vehicles.

  • How can a regulatory policy to address potential hazards be made legitimate in the face of scientific uncertainty? The precautionary principle has been gradually regarded as the most persuasive answer to this intricate question in Europe since the 1970s and generally recognized as a guiding principle in international environmental law. This principle, however, has often been subject to diverse concerns and criticisms due to its vague definition. This article tries to elaborate the precautionary principle while reviewing both the validity and unreasonableness of these criticisms over this principle. Then, this article explores the policy relevance of this principle by applying this elaborated definition to the concrete case of risk governance such as the risk assesment of food safety. In the end, this paper emphasizes the fact that the precautionary principle can be applied in the field of risk governance, refuting the argument that the precautionary principle is only a moral attitude or a political position.

The Impact of BIS Regulation on Bank Behavior in Asset Management (신 BIS 자기자본규제가 은행자산운용행태에 미치는 영향)

  • The primary purpose of this study is to examine the impact of new BIS regulation, which is the preparations to incorporate not only credit risk but also market and operation risk, on the bank behaviors. As methodology, SUR(seemingly unrelated regression) and pool unit test are used in the empirical analysis of banks survived in Korea. It is employed that quarterly data of BIS capital ratio, ratio of standard and below loans to total loans, ratio of liquid assets to liquid liabilities, allowances for credit losses, real GDP, yields of corporate bonds(3years, AA) covering the period of 2000Q1~2009Q1. As a result, it could be indicated that effectiveness and promoting improvements of BIS capital regulation policy as follows; First, it is explicitly seen that weight of lending had decreased and specific gravity of international investment had increased until before BIS regulation is built up a step for revised agreement in late 2001. Second, after more strengthening of BIS standard in late 2002, banks had a tendency to decrease the adjustment of assets weighted risk through issuing of national loan that is comparatively low profitability. Also, it is implicitly sought that BIS regulation is a bit of a factor to bring about credit crunch and then has become a bit of a factor of economic stagnation. Third, as the BIS regulation became hard, it let have a effort to raise the soundness of a credit loan because of selecting good debtor based on its credit ratings. Fourth, it should be arranged that the market disciplines, the effective superintendence system and the sound environment to be able to raise enormous bank capital easily, against the credit stringency and reinforce the soundness of banks etc. in Korea capital market.

  • 전력산업 구조개편이후 송전체제, 특히 송전요금체계에 관한 연구가 미흡한 가운데 자연적 독점을 유지하게 될 송전에 대한 정부의 규제가 중요성을 가지게 되었다. 본 연구에서는 여러 정부 규제방안들을 비교 검토하여 최적방안 모색을 위한 방향을 제시하고자 한다. 송전요금은 비용반영 투명성, 비(非)차별, 경쟁 등의 원칙을 지켜야 하고 이런 송전요금에는 경제적 효율성 사회 복지, 비용 최소 운영 등의 증진을 위해 한계비용이 반영되어야 한다. 하지만, 송전 네트웍은 규모의 경제에 종속되는 장기 투자로 구성된다. 이런 조건에서는 한계비용은 정의되기 어렵다. 그러므로 송전요금은 단기적 한계비용들의 신호와 장기적으로는 적절한 비용회수의 보장들과의 타협조정을 해야 한다. 네트웍 요금은 경쟁 정책의 원칙을 준수할 필요가 있으며 어떤 한 네트웍 회사도 과도한 요금을 부과한다든지 또는 사용자들을 차별한다든지 또는 약탈적(predatory) 방식으로 행동할 시에는 지배적 지위 남용에 대해 벌칙을 당하게 되어있다. 송전요금에 관한 결정은 공공서비스 의무비용, 특정 소비자그룹 우대를 위한 국가 정책들과 같은 사회적 목적들에 의해 제한을 받는다. 현존하는 대표적인 정부규제방안인 가격상한제와 투자보수율 규제방식을 검토한 결과 유도된 중요한 사실은 가격상한제 규제방식이 기업들로 하여금 위험(risk)에 좀 더 종속되게 만들지만 반면에 비용절감을 위한 강력한 인센티브를 주어 효율성 향상을 기할 수 있게 만든다는 것이다. 이러한 사실은 가격상한제 규제방식이 정부규제의 기본원칙에 더 많이 부합되며 궁극적인 경제체제의 목표인 자원의 효율적 배분에 더 가깝다는 것을 의미한다.

The Air Space System and UVA's Regulation in Japanese Civil Aeronautics Act (일본 항공법상의 공역체계와 무인항공기 규제)

  • An amendment to Japanese Civil Aeronautics Act came into effect December 10, 2015. The Act prohibits flying drones over residential areas or areas surrounding an airport without permission from the Minister of Land, Infrastructure and Transportation. Flying drones during night time and during an event is also prohibited. The term "UAV" or "UA" means any aeroplane, rotorcraft, glider or airship which cannot accommodate any person on board and can be remotely or automatically piloted (Excluding those lighter than a certain weight (200 grams). Any person who intends to operate a UAV is required to follow the operational conditions listed below, unless approved by the Minister of Land, Infrastructure, Transport and Tourism; (i) Operation of UAVs in the daytime, (ii) Operation of UAVs within Visual Line of Sight (VLOS), (iii) Maintenance of a certain operating distance between UAVs and persons or properties on the ground/water surface, (iv) Do not operate UAVs over event sites where many people gather, (v) Do not transport hazardous materials such as explosives by UAV, (vi) Do not drop any objects from UAVs. Requirements stated in "Airspace in which Flights are Prohibited" and "Operational Limitations" are not applied to flights for search and rescue operations by public organizations in case of accidents and disasters. This paper analyzes some issues as to regulations of UAVs in Korean Aviation Safety Act by comparing the regulations of UAVs in Japanese Civil Aeronautics Act. This paper, also, offers some implications and suggestions for regulations of UAVs under Korean Aviation Safety Act.
