대외무역법 원산지표시위반 관련 벌칙에 관한 연구 (A Study on the Penalty of the Breach of Country of Origin Labeling in Korea Foreign Trade Act)

  • The Korea Foreign Trade Act(KFTA) was revised the penal provisions of the breach of the Country of Origin Labeling(COOL) recently. The ceiling of penalties became to 5 years for imprisonment, one hundred or three hundred million won for fine. The level of penalties are adjudged quite fair but the amount of penalty should be increased according to the profits from the breach or the nature of crime in some cases. The problems of the penalties are differences between KFTA and other related laws. There are related several laws on the breach of the COOL such as KFTA, Unfair Trade related Law, Customs Law, Consumer Protection Law, Law of COOL on Agricultural and Marine products etc. The penal provisions of the breach of the COOL has more heavier level than other the breach because of the criminal qualities. The problems are the penalty differences between the KFTA and the Unfair Trade Law under the Ministry of Knowledge Economy. The KFTA's penal provisions need to equate with Unfair Trade Law as long as same breaches on the COOL. The government can also consider some policies to rigid enforcement of breaches on the COOL. There are the Country of Origin Tracking system, the RoO Paparazzi System, Make public the names of habitual RoO Violators, Correction Order of breach of the COOL etc.

원산지표시위반 수입물품 유통으로 인한 피해의 연구 (A Study on Damage from the Distributed Imports with the Infraction of the Country of Origin Indication)

  • This study represents the current situation on the Korean Government's investigation into the imports with the infraction of the country of origin indication law, showing how much those imports affect the purchasers as well as the domestic competitors in Korea. According to the HS 4 unit, the range of imports with the country of origin indication should be 55.2% of all imports, but it turned out there were actually 87.6% of them, according to the number of the import declarations in the first half year of 2010. The government's investigation on the infraction of the country of origin indication is conducted in the stages of customs and distribution into market. As a result of recent 4 years government's investigation into the imports with the infraction of the country of origin indication, the rate of inspection was averagely 3.6% of the reported number of imports in the stage of customs, the rate of the infraction of the country of origin indication cases was 0.14% of the total reported number, and 3.85% of the total actually inspected number. The investigation in the stage of distribution was below 20% level of the stage of customs inspection, on the number of caught cases basis. A survey of 4 categorized imports such as Watches, Tools, Glasses frames, and Clothes, which are assumed to happened frequently with the infraction cases, shows that the decreased sales rate of the domestic competitors was averagely 18.8% and the extent of the damage on consumers was 34.7% of the purchased prices, with both rates resulted from the investigation in the stage of distribution into market.

대외무역법 원산지표시제도 쟁점사항 개선방안 (A Study on the Improvement of the Origin Marks Issues in the Korea Foreign Trade Act)

  • Country of origin is very important in terms of consumers right to know, protection of producer, national finance and tariff preference etc. The principal issues related to country of origin are breaches of origin mark, determination of origin of OEM products, domestic products using imported raw materials, exports products, and fairness of penalties. This study focus origin mark issues on key components and set products which have not been treated so far. First, Origin mark issues on key components need to introduce multiple countries of origin for the same products. Some specific products, which are considered important key components or materials, has to mark multiple country of origin in terms of portion and significance. Next, Origin mark issues on set products need to expand the objects from 15 listed items of Korea Foreign Trade Act to all items of HS tariff schedules of Korea Customs Act. A set products which below 15% of components can mark single country of origin like FTA agreement such as Korea-EU FTA, Korea-EFTA, Korea-US FTA and Korea-Peru FTA.

이달의 인터뷰 - 오리고기 원산지 거짓표시 신고, 소비자가 앞장선다! 양은선 감시원.김순이 감시원

  • 2010년 8월 오리고기 원산지 표시제가 제도화되어 시행중이다. 그러나 지난 연말 발생한 AI로 인해 오리고기 수급상황이 악화되면서 오리가격이 상승하였다. 그에 따라 중국산 훈제오리고기와 대만산 냉동오리의 수입량이 증가, 값싼 수입 오리고기를 재포장하여 국내산으로 둔갑 판매하거나 원산지 미표시 등 부정유통 사례가 크게 늘어나고 있다. 이에 협회는 국내 오리산업을 스스로 지키자는 취지에서 지난 5월 25일, 오리고기 유통 감시단을 발족하고 오리고기 원산지표시제의 조기정착을 위해 부정 유통 신고센터 운영을 본격 가동하고 있다. 지난 5월 전임 유통감시원으로 위촉된 김순이 양은선씨는 소비자 시민모임 회원으로 오리고기의 주요 소비처인 서울, 경기를 집중적으로 홍보 감시하면서 오리고기 원산지 표시제의 유통거래질서 확립에 기여하고 있다. 오리고기 유통감시원은 오리고기 원산지 표시 점검 및 부정유통을 감시함으로써 불법유통을 차단하고 오리고기 원산지표시제 정착을 위해 노력함은 물론 판매점 출입 시 명예감시원증을 제시, 방문목적을 밝히고 감시원으로서 품위를 유지하는 임무를 갖고 활동하고 있다. 오리고기 부정유통 사례를 막는 이들의 활동은 소비자와 오리 사육 농가를 보호하고, 올바른 정보전달을 통해 소비자의 신뢰를 구축할 수 있으며 이는 향후 오리고기 소비 확대에 기여할 수 있는 촉매의 역할이다. 평소 자발적으로 소비자 시민모임 활동에 참여하고 있는 김순이 양은선씨를 본지에서 만나봤다.
