This study aims to propose a set of improvement devices for construction dispute resolution clause of public improvement project in Korea. To do so, the study addresses the system and procedure of construction dispute resolution in domestic and overseas, and reviews precedent cases, specifically focused of a selective arbitration case. In public sector's initiated contracts, the absence of c)aim procedure clause is unable to response to the claims in timely manner, and the ambiguity of clause o( selective arbitration make it difficult to resolve a dispute by arbitration. Thus, in this study alternative dispute resolutions are explored as a way to resolve various construction disputes of public-initiated project in developed countries.

본 연구의 목적은 국내 · 외 인터넷 도메인네임 분쟁의 유형을 사례별로 분석하여 도메인 사용권을 둘러싼 분규를 해소 및 예방하고, 국제적인 도메인네임 분쟁 발생시 국내 기업 등이 불리한 처우를 받지 않도록 하는 적정한 분쟁 해결 방법을 모색하는데 있다. 아직까지는 대부분의 국가에서 도메인네임 분쟁과 관련된 법이 제정되어 있지 않기 때문에 특정 회사명 또는 상표명을 사용하는 경우 분쟁이 발생하면 해당회사 또는 상표권 소유자에게 우선권이 있는 것으로 판결을 하는 추세이지만, 국내 ·외적으로 판결에 일관성이 있는 것은 아니다. 본 논문에서는 도메인네임 분쟁에 관한 법원의 소송 판례를 분석하고, 외국의 도메인네임 분쟁 해결 사례와 국내 사례를 분석하여 향후 분쟁 발생시 대처방안을 모색하도록 한다

Alternative dispute resolution(ADR) techniques, like negotiation, arbitration, meditation, have been used to resolve dispute in Korea construction industry with litigation. Nowadays, in construction, there are growing numbers of disputing cases, because of the different viewpoint of the owner and the constructor, great demand of opening market, and bad construction business situation. As the name implies, ADR plays an important roles after disputes have already arisen. This paper suggests the one of the solutions that prevents disputes befor they have been occurred. There are some proves that the partnering has a substantial effect on reducing disputes and time reduction and improving communication among the parties. This paper proposes the partnering model for the one of preventive methods to solve disputes.
