Current Status of Digital Sex Crime Forensic Technology for Children and Adolescents (아동·청소년 대상 디지털 성범죄 포렌식 기술 현황)

  • 디지털 기기의 발전에 따라 우리에게 이로운 효과를 주고 있으나 음지에서는 디지털 성범죄의 피해자가 속출하고 있는 실정이다. 사회적으로 지속해서 대두되고 있는 디지털 성범죄는 그 피해사례가 연간 약 2배 증가하고 있으며, 전체 아동·청소년 성범죄 사례 중 디지털 성범죄가 차지하는 비율은 2018년 6.5%에서 2019년 13.9%로 2.13배 증가하였다. 본 논문에서는 디지털 성범죄의 사회적 인식을 각인시키며 국내외 성범죄 피해사례와 관련 디지털 포렌식 고도 기술 연구에 관한 내용을 제안한다.

Psychological Characteristics of Adult Sexual Offenders in South Korea (한국 성인 성범죄자의 개인 수준 심리적 특성 연구)

  • This research study was aimed to identify the psychological characteristics of sex offenders. In order to achieve those objectives, 123 sexual offenders, 102 common criminals, and 162 normal people were surveyed. We reviewed the previous studies examined the psychological characteristics of sexual offenders and summarized main variables related sexual offender at the individual level. Those variables included depression, anger, self-esteem, empathy, impulsivity, shame, psychopath, alcohol dependence. Results showed that the levels of depression, self-esteem, impulsivity, impulsion-cognitive, psychopathy were significantly different among the groups. The limitations and implications of this study and suggestions for future research are discussed.

A Study on the Habitual or Repeated Sexual Offenses in School (학교에서 발생한 상습·반복적 성범죄에 관한 연구)

  • Based on the sexual offenses committed in school, the present study investigated differences between habitual/repeated sexual offenses and one-off sexual offenses in terms of offender characteristics, victim characteristics, and offense characteristics. We examined a total of 218 sexual offense cases committed in school. As a result, we found significant differences in the age, job, and residential area between habitual/repeated and one-off sexual offenders in school. In addition, notable differences were found between habitual/repeated and one-off sexual offense cases in the age and alcohol use of the victim. Moreover, habitual/repeated and one-off sexual offenses in school differed significantly by offense planning, method of approaching the victim, type of sexual behavior, and victim resistance. Furthermore, we conducted regression analyses and identified multiple factors that contributed to lasting of the sexual offense in school. Finally, we discussed limitations of the present study and made suggestions for future research.

  • This paper is a preliminary literature review to give lights on the importance of academic research on sex offences. First, definition and etiological factors of sex offences were introduced and then it was attempted to classify offensive behaviors. Furthermore, it was explored on which aspects of our criminal justice system the research results in the Western societies could be applied. Related to recidivism research, risk factors were explored again and intervention strategies were investigated to reduce the future risk of sex offenders. Finally, these findings were evaluated for the applicability to Korean criminal justice system.

  • Sex offense by medical practitioners has been occurring continuously in Korea leading to not only patients but the general public expressing anxiety and increased distrust in the medical field. The government has been pushing ahead with the legislation or revision of law to increase the penalties on sexual offenders in response to requests for a stricter legal framework to address sex offense cases and has expressed a strong commitment to actively resorting to administrative corrective measures towards sexually offending medical practitioners. Unlike such an overall social atmosphere, the Judiciary that is in charge of applying the law seems not to perceive the seriousness of sex offense cases committed by medical practitioners. A doctor who had sexually assaulted a middle school female student during medical treatment at a pediatric hospital was found innocent by the supreme court, which was a ruling in direct contrast to overall public sentiment. As such, this study seeks to analyze the precedent on cases involving sex offense by medical practitioners with a focus on the above-mentioned case and present implications. The study seeks to dispel distrust in the overall medical field by addressing the gap in legal interpretation towards sex offense committed by medical practitioners and thus provide basic data that can help the general public receive quality medical services in a safer environment.

Effects, Perception, and Political Implication of Sexual Crime on Public Transportation (여성의 성범죄 피해경험이 교통행태에 미치는 영향분석 및 정책적 함의)

  • This study was performed to investigate the currents status of the sexual assaults on women public transportation users and to provide solutions in order to provide safe transportation services to women. Data was collected through in-depth interviews with career women in Gyeonggi-do. The main purpose of the interview was to understand their experiences about sexual assaults while using public transport and to investigate the extent to which their experiences affected their transportation-related behaviors. The effects of various related transport policies on women behaviors were also analyzed by estimating structural equation models. The results showed that among them, CCTV, accessible warning bells, and more police presence seemed to be more effective, but that woman-only sections were not as effective as others in reducing the number of crimes. The results implied that individual subjective norms and their perceived behavioral control, behavior intention were important factors. Based on these results, we recommended additional policies more effective in sexual crime reduction.

A Study on Sex Offenders Registration and Notification Act of the U.S. (미국의 성범죄자 등록 및 공개법에 관한 연구)

  • Congress enacted the sex offender registration and notification act in order to prevent sexual offenses and protect public safety in the U.S.. Namely, in 2006, the Jacob Wetterling Act and Megan's Law were integrated into the Adam Walsh Child Protection and Safety Act as a comprehensive sex offender supervision and management scheme. The AWA aims to eliminate loopholes and gaps formed by inconsistent state laws and statutes as well as to provide the federal standards for sex offender registration and notification. However, the AWA contains over-inclusive sex offender registration requirements and punishments. For this reason, the implementation of the AWA may cause problems for states, sex offenders, and citizens, both as taxpayers and as beneficiaries of the AWA. Therefore, the AWA that does not differentiate between violent and non-violent offenders should be reformed to allow law enforcement officials to focus on sex offenders convicted of violent and heinous crimes. That is, the AWA should not apply to sex offenders who are not dangerous, not likely to recidivate, and who committed non-violent crimes. In addition, because the AWA requires juvenile offenders to registrate on public notification forums, it may result in a greater risk to community safety and potential risk of reoffense. Accordingly, juvenile offenders convicted of non-violent sex offenses and not likely to recidivate will be provided appropriate treatments to be rehabilitated as members of community.

Test of the Scale Effect of MAUP in Crime Study: Analyses of Sex Crime Using Nation-Wide Data of Eup-Myon-Dong and Si-Gun-Gu (범죄연구에 있어 가변적 공간단위 문제(MAUP)의 스케일효과 검증 : 전국 읍면동과 시군구를 대상으로 한 성범죄 분석)

  • This study attempted to test the scale effect of MAUP, particularly focusing on the spatial autocorrelation of sex crime, correlations among neighborhood structural variables, and causal mechanism leading to sex crime. Analysis results of nation-wide Eup-Myon-Dong and Si-Gun-Gu data discovered that the spatial autocorrelation, correlations among independent variables, and determinant coefficient of multiple regression of Si-Gun-Gu level were generally bigger and stronger than those of Eup-Myon-Dong, which appeared to be due to the averaging effect. Regarding the causal effect to sex crime, two interesting results were found: First, the ratio of non-apartment residency lowered sex crime at both levels contrary to the hypothesis. Second, the ratio of food and lodging increased sex crime only at Eup-Myon-Dong level. These suggested that future research need to perform more detailed analyses dividing data into subsets such as urban vs. rural and/or economically advantaged vs. disadvantaged areas.

Comorbidity of Paraphilia and Personality Disorders in Sex Offenders (성범죄자들의 성격장애와 성도착증 중복이환 보고 연구)

  • Despite various treatments, there is a tendency of convicted sex offenders to recidivate by committing additional sex crimes. Especially when the offenders are diagnosed comorbidly with paraphilia and personality disorders, effective treatment is critical because this difficult condition can be harmful to their psychological well-being and the security of the communities in which these men live. The aim of this review is to examine the comorbidity of personality disorders and paraphilia in the male sex offender population. This study is highly meaningful as not only it is the first domestic research on the link between paraphilia and sex crimes, integrating the preceding data from both domestic and international research, but also as it synthesizes the studies of criminal psychology, social welfare and clinical psychology.

Design of Sex Offender Notify App for Socially Disadvantaged (사회적 약자들을 위한 성범죄 알림이 앱 설계)

  • An app is designed for the socially disadvantaged related to the Sex Offense. In 2013, The Republic of Korea claimed to exterminate four social evils. The first one of social evils is sexual assault. The app proposed in this paper will be used to prevent sex offenses. People may check the news related to the sex offense and search the sex offender. People may learn simple self-defense martial arts and use guidance service to go home safely. People may use this app trying to keep safety from the potential criminals by themselves.
