The Procedures and Methods for Selecting and Establishing Control Criteria for Accountability Information (설명책임정보 선별 및 관리기준 수립의 절차와 방법)

  • The basic rights of the public for sustaining public accountability relations between public sector organizations and the citizens is the accessibility to information of public sector organizations. Public organizations in Korea get checked under multiple public accountability relations, which increases steadily the information provision requests from stakeholders. To respond these requirements effectively and efficiently, public sector organizations are required to transform their information management regime to comply with accountability-oriented settings. This study (1) suggests procedures and methods to select 'information for accountability' from the organization's whole information as an important object to be managed, (2) suggests procedures and methods to establish control criteria for the organization to manage its information for accountability in appropriate ways, and (3) gives an example of applying the procedures and methods to the specific context of universities' information disclosure. The procedures and methods suggested are described from a viewpoint of the consulting for the accountability information management regime.

  • On Dec 1, 2008, according to the special law for the information disclosure of education relevant institutes, the educational information of each university is opened at their homepages and at portal web sites. Every university, thus, is in the moment to set up strategies to consistently respond to following information disclosure as well as the one already disclosed. The strategy should contain the assurance of the basic accountability mechanism of the university. On the occasion of the public announcement of the university information, the present study has a purpose to examine the structure of the university accountability and to suggest a mechanism, which is necessary for effectively and efficiently executing the increasing accountability practices in disclosing and announcing the information. To meet the purpose, this study introduces how to redesign university jobs as practices focused on evidence information for the accountability and also suggests solutions how to improve the mechanism for the accountability responsibility, which include clarifying the roles and responsibilities for accountability jobs, revising the process of information disclosure and building the information systems for an accountability.

  • This study focuses on resetting the direction of the universities' accountability introducing the notion of accountability which is a new paradigm in the setting of records management.. First, we analyze the notion and structure of accountability, and then demonstrate the need of accountability in the university. And we try to deduce factors for accountability through cases of foreign universities. Based on this, we analyze the present status of records management of domestic universities. Based on the results of analysis, this study suggests several proposals. First, university records need to be reset. Second, regulations related to tasks in the university should be improved. Third, the function of university archives should be strengthened. Forth, the process of university records management should be reset. Fifth, in order to settle down accountability of the university in a right way, proper systems and procedures to regulate it are necessary so that the university can perform accountability properly outside the university.

  • Corporations report their economical, environmental, social influences and achievements through sustainability reports. Apart from the financial reports, which are subject to legal restrictions, sustainability reports inform non financial achievements of a corporation, thus the reliability of the information is solely dependent on the corporation itself. The current sustainability reports are of types that cannot include proof or source of the index data, thus they are tended to be regarded as means of publicity. The reliability of the reports is often questioned. This research applied the concept of Evidence-Based Accountability, which will allow the confirmation of accountability through records including contents and context of the tasks. Evidence-Based Accountability means producing and accumulating witness records of actions, then managing the records as usable information and use them as accountability information. Index data from sustainability reports of domestic corporations and web based reports of Vodafone was reviewed. Measures to link task records as proof of index data was studied. To make this possible, record production and acquisition system was redesigned in order to secure required records as evidence. Linked build-up of SR system and RMS was proposed. The proposed system will allow collection and management of records as SR accountability information, and provide the data when necessary. Also, corporate infrastructure was proposed. This infrastructure will build a professional records management system in stages, through organizational system and regulations. Cooperation of staff in this infrastructure will support reliable corporate accountability.

Public Service Broadcasting and Accountability: Case Study on NHK (공영방송의 '설명책임'에 관한 연구: NHK의 '개혁재생사업'을 중심으로)

  • This paper analyzes an NHK's 'Performances of Reform and Revival'. As a result of analysis, it was focused on reinforcement of the management such as audit, corporate governance, compliance, and thus the accountability was insufficient. Generally speaking, public service broadcasting is the form of organization of mass media that is most directly accountable to society. Therefore, the efforts is required for public service broadcasting to figure out to endow the social roles and responsibilities to themselves differentiated from other commercial broadcasters. And it is necessary that the concrete systems and activities based on an answerability model so that public broadcasters fulfill the accountability. Answerability means that broadcasting organizations and journalists both take account of and are accountable to the public. In such a process, the positive and voluntary civic participation is indispensable.

A Study on Management of Records for Accountability of University student body's autonomy activity - Focused on Myongji University's student body - (대학 총학생회 자치활동의 설명책임성을 위한 기록관리 방안 연구 - 명지대학교 총학생회를 중심으로 -)

  • A university is an organization charged with publicity and has accountability to the community for the operating process. Students account for a majority of members in a university. In universities, numerous creatures are pouring out every year and university students are major producers of these records. However, roles and functions of university students producing enormous amount of records as main agents of universities and focused concentration on produced records have not been made yet. It is reality that from the archival point of view, the importance of produced records of which main agents are university students has been relatively underestimated. In this background, this study attempted approach in archival point of view on records produced by university students, main agents. There are various types of records that university students produce such as records produced in the process of research and teaching as well as records produced in the process of various autonomy activities like clubs, students' associations. This study especially focused on university student autonomy activity process and placed emphasis on accountability securing measures on autonomy activity process of university students. To secure accountability of activities, records management should be based. Therefore, as a way to ensure accountability of unversity students autonomy activity, we tried to present records management systematization and records utilization measures. For this, a student body, a university student autonomy organization was analyzed and a student body of Myongji University Humanities Campus was selected as a specific target. First, to identify records management status, activities and organization and functions of the student body, we conducted an interview with the president of the student body. Through this, we analyzed the activities of the university student body and examined the necessity of accountability accordingly. Also, we derived the types and characteristics of records to be produced at each stage by analyzing the organization and functions of the student body of Myongji University. Like this, after deriving the types of production records according to the necessity, organization and functions of accountability and activities of the student body, we analyzed records management status of the present student body. First, to identify the general process status of activities of the student body, we analyzed activity process by stage of the student body of Myongji University. And we analyzed records management method of the student body and responsibility principal and conducted real condition analysis. Through this analysis, we presented the measures to ensure accountability of a university student body in three categories such as systematization of records management process, establishment of records management infrastructure, accountability guarantee measures. This study discussed accountability on society by analyzing activities and functions of a student body, targeting a student body, an autonomy organization of university students. And as a measure to secure accountability of a student body, we proposed a model for records management environment settlement. But in terms that a student body is an organization operated in one year basis, there is a limit that records management environment is hard to settle. This study pointed out this limit and was to provide clues when more active researches were carried out in the field of student records management in the future through presentation of student body records management model. Also, it is expected that the analysis results derived from this research will have significance in terms of school history arrangement and conservation.

Physician's Duty to Inform Treatment Risk: Function, Requirements and Sanctions (의사의 위험설명의무 - 법적 기능, 요건 및 위반에 대한 제재 -)

  • Under the Korean case law, physicians are obliged to disclose or inform the risk associated with a specific treatment to their patients before they perform the treatment. If they fail to do this, they are liable to compensate pain and sufferings. If the patient can establish that he or she would not have consented at all to the treatment had he or she been informed, the physicians are liable to compensate all the loss incurred by the treatment. In this article, the author examines the legitimacy of this case law from the perspective of legal doctrine as well as its practical affect on the medical practice and the furtherance of self-determination of the patient. The fundamental findings are as follows: The case law that has physicians who failed to inform treatment risk compensate pain and sufferings for the infringement of the right of self-determination seems to be a disguised and reduced compensation of all the loss based on the possible malpractice, which cannot be justified in view of the general principles of tort liability. It is necessary to adhere to the requirements of causation and imputation between the failure to inform treatment risk and the specific patient's consent to the treatment. If this causation and imputation is established, all the loss should be compensated. Otherwise, there shall be no liability. The so-called hypothetical consent defence shall be regarded as a part of causation between the failure to inform and the consent. The suggested approach can preserve the essence of physician-patient relationship and fit for the very logic of informed consent better.
