  • Subject matter of international trade are various. They contain not only tangible assets such as goods but also intangible assets including service, technology, and capital etc. Technology, a creation of the human intellect, is important as it is the main creative power to produce goods. It can be divided into Patent, Trademark, Know-how and so on. These Technologies are protected by the national and international laws on regulations for the Intellectual Property Rights(IPR), since technology development is needed a lot of time and effort, and the owner of the technology may have crucial benefits for creating and delivering better goods and services to users and customers. Therefore, any licensee who wants to use the technology which other person(licensor) owns, he(the licensee) and the original owner(the licensor) shall make Technology Transfer Contract. Differently from the International Sales Contract in which seller provides the proprietary rights of goods for buyer, in the case of International Transfer of Technology Contract, the licensor doesn't provide proprietary rights of technologies with the licensee, on the contrary the right of using is only allowed during the contract. The purpose of this paper is to examine the main issues in International Transfer of Technology Contract. This author focused on the main obligations of both parties, namely licensor's obligation to provide the technology and licensee's obligation to pay the royalty. As every country has different local mandatory laws about Intellectual Property Rights(IPR) and these mandatory rules and laws prevails over the contract, the related rules and laws should be examined carefully by both parties in advance. Especially the rules and laws about the competition limitation in the local country of licensee and the economic union(like the EU) should be checked before contracting. In addition, the contract has much more complicate and delicate aspects than other international business contracts, so both parties should review carefully before singing the contract.

중당(中唐) 승려(僧侶) 시풍(詩風)의 선구자(先驅者) 영일(靈一)의 시세계(詩世界)와 문학사적(文學史的) 의미(意味) 고찰(考察) (As a Pioneer of the mid-tang dynasty Monk's poem style of Ling-yi's Poem world & the significance in the history of literature)

  • This paper is to study the Tang Dynasty monk poet Ling-yi's poem world and his significance on history of literature. In Chinese literature history, "the monk poets" is a very unique literature creation group. The means of a word "the monk poet", from the literal can see " he is the monk that Can write poems", which is dedicated to professionally writing poetry monk. Buddhism spread to China, from the Wei and Jin Dynasty beginning has been writing poetry of the monks, but the real meaning of "the monk poet" (i.e., professionally poetry monk) appeared to the Mid-Tang Dynasty period. The monk Ling-yi is the pioneer of the monk poets group and Buddist monk creative poem in Mid-tang Dynasty period. Although the Lingyi life is very short, only 35 had died, and his poetry has not been too much, only 44 songs, but he in this life of 35 years and 44 poems, for the development of classical Chinese poetry left noticeable imprinting. He is not just as monk's high practice and by advocating for great Buddhist scholar, also through the daily meditation in poetry creation practice were obtained at that time of many men of literature and writing respected. This paper from the poem monk Ling-yi double identity - the first is a Buddhist monk, the second is addicted to poetry poet to proceed, step by step, in-depth study as the poem monk Ling-yi's poetry creation characteristic and the creative mentality characteristics. This thesis also explores the poem monk by the creation of poetry pursuit, exploration, finally realized "poem" and "Zen" together as one "Zen poetry" creation mechanism.

기문둔갑으로 보는 혼인 택일법의 사례분석 (An Analysis of the Choice of Wedding Time Based on the Gimundungap Theory)

  • 이 연구는 여러 가지 혼인 택일법 중에 기문둔갑으로 보는 혼인 택일법에 관한 연구이다. 특히 운곡 기문둔갑 이론을 바탕으로 혼인 택일법의 효용 가치와 타당성을 확인하고자 하였다. 즉 조선 시대에서 행사했던 관혼상제, 일반적인 공용(共用)의 날로 택일(擇日) 선시(選時)를 하는 것과는 확실히 다르게, 운곡기문 택일법은 본인의 사주에 맞게 개인만의 택일을 하는 차이가 있다. 운곡 기문학은 홍국수(洪局數)로 동양철학의 기본원리를 이용하여, 논리상 필연적(必然的)인 결론(結論)을 내게 한다는 연역법(演繹法)을 활용한다. 건명 또는 곤명의 결혼 날가림을 홍국수로 합생(合生)의 기본원리인 삼합, 반합, 육합, 생극, 그리고 형살(刑殺)과 삼살(三殺)을 이용하여, 시운(時運)은 일운(日運)에 귀속(歸屬)된다. 또한 일운(日運)은 월운(月運)에 귀속(歸屬)되고, 월운(月運)은 소운(小運)에 귀속(歸屬)되고, 소운(小運)은 대운(大運)에 귀속(歸屬)되고, 대운(大運)은 세(世)에 귀속(歸屬)된다. 이러한 논점의 운곡기문 혼인 택일법에 관한 이론 고찰 및 사례 분석을 통하여 타당성을 검증하였다. 연구의 결과는 운곡 기문둔갑의 혼인 택일법은 타 혼인 택일법에 비하여 다소 적중률이 높게 나타났음이 확인되었다.
