A Study on the Perception of the Right to Vote of Persons with Developmental Disabilities in College Students: Based on the Experience of Disability Related Education (발달장애인 선거권에 대한 대학생의 인식 연구: 장애관련 교육경험 유무를 중심으로)

  • The purpose of this study is to examine the perception of the right to vote of persons with developmental disabilities in college students. College students attending in A University and B University in Gwangju Metropolitan City were selected using convenience sampling and 370 samples were finally analyzed. The results were as follows. First, the subjects who took a disability course had high perception of the right to vote of persons with developmental disabilities. Second, it was discovered that the more times people participated in the volunteer work related to disabilities, the more recognition they had on the voting rights of people with developmental disabilities. Third, the subjects who responded for the need for the political rights of persons with developmental disabilities had more positive perception of the right to vote of persons with developmental disabilities than those who did not responded. Based on the findings, it was suggested that methods should be investigated to establish positive attitude and perception of the right to vote of persons with developmental disabilities in persons without developmental disabilities including college students.

  • With increase of Korean economy scale and globalization, permanent alien residents in Korea are increasing day by day. Living in Korea, they maintain their original nationalities, but their life in Korea is greatly affected by political decision made by Korea. It has been taken for granted that foreigners's suffrage were not recognized due to national sovereignty. The claim that foreigners should not be allowed to participate in government has constantly been met with counterargument on the basis of instability of sovereignty principle, trends of advanced countries, intrinsic differences between federal and regional governments, or actual state of foreigners. It is unreasonable to deal with foreigners' suffrage and eligibility for election differently in that the current public offices election law does not allow foreigners to be eligible for election without any special reason while allowing foreigners to vote in the local election. It is discrimination against foreigners not to allow foreigners to be eligible for election when there is no rationale to differently deal with foreigners' suffrage and eligibility for election. This paper deals with constitutional argument regarding foreigners' electoral eligibility, takes a look at legislative cases of Japanese and European countries, and examines possibilities of including foreigners' eligibility for election in our public offices election law.

  • 공정하고 투명한 선거를 이루기 위해서는 비밀성(privacy), 선거권(eligibiligy) 등과 더불어 전체검증(universally verifiability)과 매표방지(receipt-freeness) 속성이 반드시 제공되어야 한다. 그러나 전체검증은 누구나 투표내용을 확인할 수 있는 방법을 제공하는 것이고 매표방지는 투표내용과 투표자를 연결할 수 있는 방법을 차단하는 것으로 두가지 특성은 상호표리적 관계에 있어서 두가지 특성을 동시에 만족시키기가 어렵다. 이 논문에서는 신뢰할 수 있는 제3자인 정직한 랜덤마이저(Honest Randomizer, HR)와 최소한의 물리적 가정인 HR에서 유권자로 가는 도청 불가능한 채널(untappable channel)을 이용하여 전체검증과 매표방지를 제공하는 효율적인 전자선거 기법을 제안한다.

  • 3월 8일은 '세계 여성의 날' 이다. 1908년 당시 미국의 여성노동자들은 먼지 자욱한 현장에서 하루 12~14시간씩 일해야 했으나, 여성이라는 이유만으로 선거권과 노동조합 결성의 자유가 주어지지 않았다. 굶지 않기 위해 일하면서도 인간 이하의 삶을 강요받아야 했던 것이다. 그러던 1908년 3월 8일, 전 의류노동자들의 시위를 계기로 의류노동자연합이라는 조직이 탄생됐다. 이를 기념해 1911년부터 3월 8일을 '세계여성의 날'로 선정해 세계 곳곳에서 여성의 날 기념행사를 펼쳐오고 있다. 여성의 날에는 '그녀에게 빵과 장미를'이라는 구호를 외치는데, 여기서 빵은 생존을, 장미는 인간 존엄을 의미한다. 세계 여성의 날을 맞아 예전보다는 많이 호전됐지만 이직도 갈 길이 먼 여성경영활동 여건과 여성인쇄인에 대해 알아본다.

A New Universally Verifiable and Receipt-free Electronic Voting Scheme Through Public Channel by Using Smartcard (스마트카드를 이용하여 공개채널로 매표방지와 전체검증을 제공하는 전자선거기법)

  • 선거를 전자적으로 구성하기 위해서는 비밀성(privacy), 선거권(eligibility) 등과 함께 전체검증(universal verifiability)과 매표방지(receipt-freeness) 속성을 반드시 제공해야 한다. 지금까지 제안된 전자선거 기법은 매표방지와 전체검증을 제공하기 위해 도청 불가능한 채널이라는 물리적인 가정 하에 이루어지거나 하드웨어 장치를 이용하더라도 장치에 대한 신뢰가 가정되었다. 본 논문에서는 믹스 서버나 랜덤마이저의 역할을 스마트카드와 같은 안전한 하드웨어 장치가 하므로 물리적 가정 없이 효율적으로 구현한다. 제안한 시스템은 표를 섞는 과정에서 permutation matrix를 사용하여 증명하므로 증명의 회수가 적고 간단하여 효율적이다. 또한, 지금까지 제안된 대부분의 선거 기법은 ElGamal 암호시스템의 준동형 특성을 이용하여 모든 표를 결합한 다음 해독하여 집계를 계산하는데 이는 이산대수 문제를 효율적으로 해결할 수 있어야 가능했다. 이 논문에서는 ElGamal 암호시스템과 다차잉여 기반 암호알고리즘인 Naccacne 암호알고리즘을 결합하여 표를 인코딩 함으로써 유권자의 수가 많은 선거에 대해서도 다항 시간 내에 집계가 가능하다.

Der Verlust der Amtsfähigkeit bzw. des Wahlrechts und das Gebot der Individualisierung der Strafen (선거범에 대한 자격제한과 형벌개별화원칙)

  • Wer wegen eines Wahldelikts zu Geldstrafe von mehr als 1 Million Won verurteilt wird, verliert nach ${\S}$ 18 Abs. 1 Satz 3, ${\S}$ 19 Satz 1, ${\S}$ 266 des Koreanischen Wahlgesetzes $f{\ddot{u}}r$ die Dauer von $f{\ddot{u}}nf$ Jahren die $F{\ddot{a}}higkeit$, ${\ddot{o}}ffentliche$ ${\ddot{A}}mter$ zu bekleiden und Rechte aus ${\ddot{o}}ffentlichen$ Wahlen. Bei Verurteilung zu Freiheitsstrafe wegen eines Wahldelikts ${\ddot{A}}mter$ sich die Dauer des Verlusts der $Amtsf{\ddot{a}}higkeit$ und des aktiven bzw. passiven Walhrechts auf 10 Jahre. Dies erfolgt kraft Gesetzes. Das $hei{\ss}t$, dass die Entscheidung ${\ddot{u}}ber$ das Ob und die Dauer des Verlusts nicht im Ermessen des Gerichts steht. Allerdings sollte $diesbez{\ddot{u}}glich$ nicht verkannt werden, dass ein deratriger Entzug von $Amtsf{\ddot{a}}higkeit$, $W{\ddot{a}}hlbarkeit$ u.s.w., mit dem eine Straftat geahndet werden soll, selber von Natur aus eine Art Strafen darstellt. Der im ${\S}$ 41 des Koreanischen StGB geregelte Strafen-Katalog $enth{\ddot{a}}lt$ $n{\ddot{a}}mlich$ eine zeitlich begrenzte Aberkennung des oben genannten ${\ddot{o}}ffentliche$n Rechtsstatus als eine Art Ehrenstrafen. Nicht einleuchtend ist, warum das Wesen der Sanktion $gem{\ddot{a}}{\ss}$ ${\S}$ 18 Abs. 1 Satz 3, ${\S}$ 19 Satz 1, ${\S}$ 266 des Koreanischen Wahlgesetzes, die den gleichen Zweck und die gleiche Rechtsfolge wie die im ${\S}$ 41 des Koreanischen StGB geregelte Ehrenstrafe hat, nicht als Strafe aufgefasst werden sollte. Handelt es sich bei der oben genannten Sanktion um eine Art Ehrenstrafen, so stellt sich die Anforderung, sie je nach der Eigenart der begangenen Tat bzw. des $T{\ddot{a}}ters$ zu individualisieren. Das Gebot der Individualisierung der Strafen, welches $haupts{\ddot{a}}chlich$ vom materiellen Rechtsstaatsprinzip ableitbar ist, kann im Grunde nur verwirklicht werden, wenn das Gericht dazu befugt ist, unter $Ber{\ddot{u}}cksichtigung$ der konkreten $Umst{\ddot{a}}nde$ jedes Einzelfalls ${\ddot{u}}ber$ eine angemessene Strafe zu befinden. Somit ist der kraft Gesetzes eintretenden Verlust der $Amtsf{\ddot{a}}higkeit$ und der $W{\ddot{a}}hlbarkeit$ nur schwer mit dem Gebot der Individualisierung der Strafen vereinbar. Es $w{\ddot{a}}re$ deshalb $w{\ddot{u}}nschenswert$, wenn der Gesetzgeber eine Reform in Betracht ziehen $w{\ddot{u}}rde$, welche den Ersatz des kraft Gesetzes automatisch eintretenden Entzugs der $Amtsf{\ddot{a}}higkeit$ bzw. des Wahlrechts durch die gerichtliche fakultative Aberkennung von diesen Statusrechten beinhaltet.

Study on Analysis and Improvement of Head of Ri Election Rules & Regulations -Focusing on Eup/Myeon Regional Village Codes of Jeju Special Self-Governing Province- (이장(里長)선출 규정 분석 및 개선에 관한 연구 -제주특별자치도 읍·면지역 향약을 중심으로-)

  • This study is a literature review that analyzes the head of Ri election rules and regulations described in the village code, identifies problems, and proposes solutions for these problems. For data collection, a total of 146 village codes was collected from January 2019 to August 2019. The results showed people in most villages vote for the head of Ri according to democratic electoral processes. For system improvement, a one-person, one-vote system was proposed instead of a one-family, one-vote system in order to enhance gender equality and political rights. As for the appointment system, the following changes were proposed: First, candidate eligibility should be improved as only people who were born in that village are eligible; Second, the maximum age of candidacy for the head of Ri should be established as under 65 years old by considering physical ability in the event of disaster occurrences and physical activity required for running village businesses; Third, consecutive terms of the head of Ri when there is no successor should be limited in order to prevent indigenous forces from settling in the local community; and Fourth, education should be provided for building the head of Ri's stature in order to devote to promote public interest for village development.

A New Universally Verifiable and Receipt-free Electronic Voting Scheme Using Only One-way Untappable Channels (일방향 도청 불가능한 채널만을 이용하여 전체검증과 매표방지를 제공하는 새로운 전자선거 기법)

  • Electronic voting schemes must provide universal verifiability and receipt-freeness, as well as basic properties such as privacy, eligibility, to make the election fair and transparent. But it is difficult to provide both universal verifiability and receipt-freeness because they are mutually contradictory in their objective. To date, most electronic voting schemes provide only one of these properties and those few that provide both properties are not practical due to heavy computational load. In this paper, we present an efficient electronic voting scheme that provides both properties. The proposed scheme uses a trusted third party called HR(Honest Randomizer) and requires only one-way untappable channels from HRs to voters. Among the schemes that assume only one-way untappable channel this scheme requires the least amount of computation. Among the schemes that provide both properties, this scheme uses the weakest physical assumption. We also discuss the security of the system and compare our scheme with other related schemes.

Review of the principle of election - Focusing on the Estonia e-voting case (선거의 원칙에 대한 재고찰 - 에스토니아 전자투표 사례를 중심으로)

  • The March 2022 presidential election held at the peak of the COVID-19 pandemic drew flak for undermining the principle of universal suffrage by failing to guarantee properly the voting rights of confirmed and quarantined persons. Guaranteeing their voting rights requires thinking about e-voting that can fundamentally overcome the temporal and spatial limitations of current paper voting polling stations. The question is how to deal with the increased possibility of contradicting or violating the principles of equality and direct and secret suffrage due to the expansion of universal suffrage. In order to obtain implications for this, we looked at the case of Estonia, which has been holding 11 national elections without any problems since the introduction of e-voting in 2005. Estonia was successfully building trust in the system, government, and society through the institutionalization and routinization of the overall socio-technical system of e-voting, along with political and constitutional agreements on the principles of elections. Therefore, we should not only consider the possibility of e-voting in terms of technological development and level but also discuss the establishment of trust by mediating conflicts between election principles from a normative point of view to reach a social consensus.

Importance-Performance Analysis on Human Rights of the Disabled of Living Rehabilitation Social Worker in Housing Facilities of the Disabled (장애인거주시설 생활재활교사의 장애인 인권에 대한 중요도-실행도 분석)

  • The purpose of this study is to verify the difference of importance-performance about human right of social worker who works in housing facilities of the disabled. Based on our result, we suggest strategies to implement human rights for the disabled. We collected data from 344 social workers in Busan. We analyzed descriptive statistics, and employed T-Test and Importance-Performance Analysis. Results found the importance level was higher than the performance level of human rights for the disabled. Second, agreement of residential space open and vote right guarantees, the importance level was higher than performance level. Items, excluding ensuring religious activities, prohibiting corporal punishment, strengthening the facility monitoring system and improve facility environment and strengthen program, featured a higher performance level than the importance level. Third, based on the IPA analysis, we derived action strategies for each IPA analysis matrix. We examined 10 items, including free communication included in the first quadrant, improvement of facilities management policy in the second quadrant, prohibition of corporal punishment and strengthening of facility monitoring system in the fourth quadrants.
