본협회, '98 "공정거래제도의 운용현황과 개선방향"에 대한 세미나 개최

  • 본 협회는 지난 ''98년 10월 28일(수)부터 29일(목)까지 양지파인리조트에서 ''98년도 공정거래세미나를 개최하였다. $\lceil$공정거래제도의 운용현황과 개선방향$\rfloor$을 주제로 개최된 이번 세미나에는 공정거래법 총론, 경제력집중 및 기업결합규제재도, 불공정거래행위와 부당한 공동행위의 규제 및 불공정하도급거래행위의 규제 등 공정거래법 및 제도 운영상의 주요쟁점사항에 대하여 공정거래위원회 총괄정책과장, 기업결합과장, 경쟁촉진과장 및 하도급기획과장의 주제발표와 고려대학교 이기수 교수의 특별강연이 있었으며, 회원사 및 비회원사 임직원 65명이 참여하였다.

지적재산권 보호와 경쟁정책에 관한 소고

  • 현재까지 우리나라에서는 지적재산권의 일탈남용과 관련된 불공정거래행위에 대한 케이스는 없는 실정이다. 그러나 지적재산권의 중요성이 점차 증가하고 있는 실정에 비추어 조만간 지적재산권 관련 불공정거래행위에 대한 실제 케이스가 많이 발생할 것으로 예상된다. 따라서 구체적 심사기준 등을 보다 명확하게 정비해 나갈 필요성이 있다고 본다. 한편, 지적재산권의 정당한 행사와 일탈$\cdot$남용간 명확한 경계 또는 구분기준을 보다 명확히 정립하기 위해서는 지적재산권 보호 관련 법률과 공정거래법을 전체 체계 하에서 단일의 기준에 의해 그 보호대상과 금지대상을 파악하고 경쟁제한효과를 분석해 나가야 할 필요가 있다고 할 것이다.

Assessment of the Effectiveness of Unfair Trading Prevention Acts in Construction Industry (건설공사 불공정거래 방지제도 실효성 평가 및 개선방안)

  • Since unfair trading practices between participants in construction project are common, the government has enforced several policies and systems to prevent or minimize the unfair trading practices in construction industry. However, not much attention has been paid to figure out which policies or acts are working or not. This paper analyzed the effectiveness of the policies and acts which are being implemented to prevent unfair trading practices and provided several suggestions to improve the performance of those acts. Survey was conducted to industry experts to collect data regarding their perceptions on those policies and acts. Then the effectiveness of the policies and acts were analyzed in terms of their importance and performance through IPA (Importance-Performance Analysis) based on the survey result. It was found through IPA that execution related acts such as investigation, exposure, and punishment for unfair trading practice have shown low effectiveness in entire construction process and dispute arbitration and mediation related center operated by authority showed low performance too. To improve the effectiveness of those acts, dispute arbitration system improvement, investigation & reporting system consolidation and enhancement practical binding force of punishment and penalty were suggested. Most of all, rules and culture for fair trading should become more established in construction industry by preventing conflict among participants through active communication.

A study on the regulation for unfairness and unfair trade practices in franchise business (프랜차이즈 거래의 불공정성에 대한 규제와 불공정거래행위에 관한 연구 - 공정거래위원회 심결례 분석을 중심으로 -)

  • The objective of this study is to establish the basic concepts for franchise agreements in consideration of both theoretical and practical conditions, to set the parameters for the discussion regarding the practical business matters pertaining to franchise agreements, and to analyze the criteria for determining the illegality of unfair trade practices based on research into actual practices in franchise transactions and on case studies of the implementation of laws by the Fair Trade Commission. The study aims to thereby contribute to the stabilization of laws in franchise transactions, benefiting all parties including franchise-related institutions, participants in franchise transactions, and related consumers. In conclusion, even in cases where regulatory exceptions are applied within the Fair Franchise Transactions Act when determining the illegality of franchised businesses, it is impossible to eliminate illegality unless all necessary and sufficient conditions have been included, and even if the procedure for evading illegality has been undertaken, illegality may not be eliminated unless the contents thereof are legitimate.
