어즈 조직, 어느 기구를 막론하고 거기에는 항상 우열이 존재하기 마련이다. 아무런 탈없이 이상적으로 잘 이끌어 나가는 경우가 있는가하면 정반대로 잘 될 것 같으면서도 잘 안되는 사례가 더러 있는 것이다. 그러나 아무래도 우열이란 우연의 산물은 아닌 모양이다. 그래서 사실을 찾아 나섰다. 서울특별시 성동구 왕십리동의 왕십리시장운영위원회 엄기방회장을 관리사무실에서 만났다.

Acute traumatic shoulder injuries related to motor vehicle accidents and industrial accident has shown a steep increase recently. In regard to the causal relationship and the previous illness, the rotator cuff tear and SLAP lesion are the mostly debated among shoulder injuries related to trauma. Both the possibility of spontaneous occurrence related to their degenerative etiology and the discordance between the extent of injury and the symptom of the rotator cuff tear and SLAP lesion, make it difficult and obscure to estimate the extent of involvement of accident. Therefore, the Insurance Committee of Korean Shoulder and Elbow Society performed a questionnaire for the shoulder specialists to investigate their criteria about deciding the treatment modalities and SLAP lesion and reviewed literatures regarding the causal relationship between the accident and the rotator cuff tear and SLAP lesion. The committee recommended the diagnostic criteria to judge contribution of the accident on traumatic shoulder injuries, and to offer a guideline for disabilities.

현재 일본 내에 거주하고 있는 외국인 중 재일 한국인/조선인(이하, 재일코리안)이 제일 많은 부분을 차지하고 있다. 재일 코리안 중 65세 이상이 13%가 넘는다(재일고령자 조사위원회, 2003). 이런 재일한국인/조선인의 고령자(이하, 재일코리안 1세라고 말함)는 대부분 식민지시대에 조국에서의 생활기반을 잃어버리고 일본에 건너오게 되거나 혹은 강제연행으로 인해 일본에 거주하게 되었다. 재일코리안 1세는 연령적으로는 후기 고령자이며, 문화의 차이, 언어적 문제 그리고 경제적인 문제 등의 어려움이 있다. 이런 많은 어려운 점 중에서도 특히 개호의 문제(노인수발 문제)는 가장 심각하다. 이런 문제들 중 먼저 역사적인 경위에 대해 선행연구 등을 통해 논해 보고자 한다. 또한 문화적 차이와 언어적 문제가 개호보험 서비스 이용에 있어서 장애가 될 가능성도 있을 수 있으며, 대다수가 무연금자인 점(길영(吉永), 2004), 개호보험과 재일코리안 1세의 경제적인 요인이 심각한 문제인 점인것(북촌(北村), 2004)을 말하고 있다. 이를 배경으로, 후꾸오까/나가사키 지역의 재일동포 1세에게 직접 설문조사를 실시했다. 조사 결과 재일코리안 1세는 일본의 고령자보다 훨씬 개호보험 서비스 이용에 소외될 가능성을 가지고 있었다. 재일코리안 1세의 개호의 문제는 한국에서가 아니라, 거주하고 있는 일본에서 해결되어 져야만 하는 문제이며 그 개선책 또한 논하였으며 향후의 방향성에 대해서도 고찰해 보았다.

Recently with making of 'The Consumer Insurance (Disclosure and Representations) Act 2012(hereunder CIA)', the UK revised the duty of disclosure especially with the consumer insurance contract. According to the CIA, if the misrepresentation was careless, the insurer may have the three options based upon what the insurer would have done had the consumer taken care to answer the question accurately; a compensatory remedy, avoidance of the insurance contract or, amendment of the contract. I realized that the establishment of CIA has been exposed to pro-actively relieve the breach of Warranty and Disclosure, Representations as far as required by the Global Insurance market. It was found that it is expected to bring significant changes in UK Insurance Act system of the 21st century, and prepares competition from neighboring countries. On the other hand, in the common law system, countries under MIA(1906) are trying to address the breach of warranty and Disclosure, Representations, except the UK cannot completely adhere with a positive attitude.
