공정거래위원회(위원장 백용호)는 지난 7월 25일 건설공제조합이 원수급자와 체결하는 하도급 대금지급보증계약상 보증책임의 범위를 지나치게 제한한 조항이 "약관의 규제에 관한 법률" (이하 "약관법"이라 함)에 위반된다고 판단하고 사업자에게 이를 60일 이내에 수정.삭제하도록 시정권고 조치하였다. 이에따라 건설공제조합의 불공정약관이 개선되면 앞으로 설비건설업체들이 하도급대금지급보증서를 받고서도 건설공제조합으로부터 보증금을 받지 못하는 폐단이 사라지게 될 것으로 보여진다.

The study attempts to consider L/G(Letter of Guarantee) in a different angle, which is internationally used as a way of commercial customs and practices in a case when the consignee wants to receive the goods without the original Bill of Lading, Thus, this study focuses more on verifying the usage of L/G in Mixed Payment System and the range of guarantee responsibility by an issuing bank through case analysis. This case uses a mixed payment method of L/C(Letter of Credit) and T/T(Telegraphic Transfer) in the transaction of goods. The issuing bank of L/C issues L/G with the amount of L/C which is the same as the amount as C/I(Commercial Invoice). However the carrier deliver all goods laden under both L/C and T/T payment with the production of L/G. In this case, because the buyer is unable to pay, the seller makes a claim for damages to the carrier that the carrier delivers the goods to the buyer against L/G. Finally, the judge gives a decision that the issuing bank of L/G should pay the whole amount of the goods. In this case, the main issue of the dispute is the range of guarantee responsibility by the issuing bank of L/G. As a result of the case analysis, the study suggests two counter strategies for smooth utilization in international trade environment. First, in the case of mixed payment system, a seller should issue a commercial invoice separately based on the amount of each settlement plan in order to clarify the liability of guarantee. Second, banks should establish a new form for L/G including a sentence for verifying liabilities of the bank's side in the current form of L/G.

기업의 제품책임(PL)은 사전책임(PLP)과 사후책임(PLD)으로 크게 나눌 수 있다. 제품책임에 대한 선진국 기업의 조직구조를 분석해보면 안전책임, 품질보증책임, 제품정보 공개책임, 피해보상 및 A/S, 제품책임 보험, 제품책임소송 등을 담당하여 처리하고 있음을 알 수 있다. 본 논문은 ISO-9000에서 요구하는 사항중에서 기업의 제품책임에 관한 내용을 살펴보고, 이에 대한 기업의 대응방향을 고찰하고자 한다.

Construction demands will become high. Defects liability is treating with a consumer on a defect. Maintenance bond is overlooking excessive responsibility of construction industry participants. This study classified the problem that are divided to systematic and internal matter. And this study presented an improvement proposal. An improvement proposal of a process may reduce a financial burden of contractors and sub-contractors. And improved rate decision will do additional consideration of the study result, so that it is appropriated a rate rationally.

2013년부터 본격적인 성과보증계약방식의 도입에 따라 ESCO 산업은 성과보증 계약방식으로 전환하게 됨에 따라 위기와 기회를 동시에 맞이하게 되었다. 따라서 이제부터 성과보증방식으로 가려면 ESCO기업의 책임있는 자세가 더욱 필요하게 되었다. 이번에 전주대학교 산학협력단 조성환 교수가 추진한 ESCO산업 발전 방향 연구용역과 관련한 인터뷰를 통해 각 업체에서 준비해야 할 부분과, 2011년 ESCO산업에 대해 전망해보고자 한다.

This study has been carried out in order to observe the status of performance warranty contracting system currently being implemented at the advanced countries including Europe, U.S.A., and Japan, review the introduction feasibility and possibility. For this purposes this study has surveyed the concept and necessity of performance warranty contracting system as well as the status of domestic performance warranty contracting system. Especially the application environment for the performance warranty contracting system of Europe, U.S.A., Japan and Korea in terms of maintenance guarantee liability system, performance warranty regulations for design-build contracting system, selection method of successful bidder, performance warranty means, project contracting system including maintenance cost, and specifications and contract conditions for performance warranty system have been comparatively evaluated. And introduction methods of performance warranty contracting system were suggested.

최근 들어 시스템이나 부품에 대한 고객의 요구조건이 다양해지고 제품책임과 품질보증 등의 사회적 요구가 점차 엄격해지고 있다. 이에 기업에서는 위험을 줄이고 제품의 합리적인 정보를 얻기 위해 제품 관련 보증데이터 수집 시스템을 구축하고 분석과 예측을 위한 다양한 연구가 진행되고 있다. 그러나 데이터 수집체계 구축에 많은 시간이 소요되고 데이터 유형에 따른 분석 방법에 익숙하지 못하여 데이터를 수집하고 분석하는 대에 어려움이 되고 있다. 본 연구에서는 보증데이터의 분석방법에 대한 연구 동향과 적용 현황을 조사하고, 보증데이터를 통한 효과적 분석방법과 활용방안을 모색 하고자 한다.
