Images of Law and Reality in TV Legal Series: Focusing on (TV 법정 프로그램에 나타난 법 이미지와 현실구성: <실화극장-죄와 벌>을 중심으로)

  • Can law be combined with television entertainment programs? This paper explores the ways in which law systems and law culture are reflected in and reflect the television legal series. TV legal series, such as legal dramas and infotainment shows, provide platforms for the audiences, who otherwise have few opportunity in real life, to engage with legal systems in societies. Adopting loosely dramatized reality programs, these legal series not only entertain and inform audiences but also educate citizens. This paper combines analyses of theoretical debates on law and television with analysis of TV text. The result shows that , dramatized enactment based on true stories and criminal cases, may have an important ideological role in which fictionalized dramas mask the hard realities and authoritative legal systems. By doing so, TV legal shows play their roles not as mere symbolic representation but as powerful institutions that construct the image of law and reality.

  • 척추의 기본적인 생체 역학적 기능은 신체 부분간의 운동을 허용하고 척수와 신경근을 보호하는 것으로서 이러한 기능을 수행하기 위해서는 척추의 역학적 안정성이 필수적이다. 척추의 안정체계는 수동적 근 골격계, 능동적 근 골격계, 그리고 신경계의 세 가지 하부체계로 나누어지며 이들 하부체계는 각각 독립적으로 안정성에 관여하고 있다. 경추의 불안정성의 문제는 비정상적으로 증가된 추간관절의 운동에 의해 염증성의 신경을 압박 또는 신장하거나 또는 통증수용기가 많이 분포하는 인대, 관절낭, 섬유륜과 종판에 비정상적인 변형을 일으키는 것을 말한다. 안정성의 장애는 근육의 기능적 측면에서 국소적 안정체계와 포괄적 안정체계의 문제로 구분할 수 있다. 불안정한 경추 환자의 임상적 양상은 일반적으로 머리가 앞으로 나오고 전방 전위된 자세로 견갑대와 승모근 상부의 과활동성을 나타낸다. 또한 능동운동은 감소되지 않으나 수동운동에서 분절의 회전운동과 병진운동의 증가와 종말감의 변화가 있다. 경추의 불안정성을 관리하기 위한 실험적 연구로 전반적인 근육 훈련, 고유수용기 훈련, 그리고 도수치료의 세 가지 주된 접근법이 있고 실제적인 접근법으로는 고유수용성 재활프로그램, 칼텐본-에반스 접근법, 그리고, 슬링운동법 등이 있다. 각 방법들은 임상에서 나름대로의 이점이 있으며 환자의 상태에 따라 이들 방법을 단독으로 또는 병행해서 적용할 수 있을 것이다. 그러나 경추에서 이러한 방법들의 효과를 입증하는 증거는 부족하여 앞으로 이러한 방법에 대한 임상적 경험보다는 그 효과를 입증할 수 있는 연구가 필요하다고 본다.

Study on the legal system alignment of Invention Promotion Act and Its Relationship with the Framework Act on Intellectual Property (발명진흥법 법체계 정비와 지식재산 기본법의 관계에 관한 연구)

  • The Invention Promotion act is one of the acts that have been frequently revised. Such frequent revisions have been pointed out as a major cause of the recent ongoing discussion on the alignment of the Invention Promotion Act. For proper alignment of the Act, diversified perspectives and issues have been discussed. Of them, the talk considering the effect of the 2011 Framework Act on Intellectual Property establishment on the Invention Promotion Act has received increasing attention. In this situation, this paper examined the relationship between the Framework Act and Invention Act with special focus on the relationship between the framework-formed law and an individual act that has existed prior to such a framework act. Based on this analysis, this study examined the alignment goal of the Invention Act. In addition, by studying the relationship between the recently-established framework act and the individual act along with revision case examples thereof, this paper aimed to produce a standard reflecting the legal reality. This study assumed that, although it is difficult to recognize any formal superiority in the Framework Act on Intellectual Property in the present South Korean legal regime, some practical superiority or practical supremacy is still deemed to be acknowledged. Under this assumption, it was found in this study that the Invention Promotion Act would also need to be managed in an appropriate relationship with the Framework Act within the range of such an attitude. Moreover, the structure would need to be reorganized. As discussed partially at the practical level, however, the Invention Promotion Act is an execution act of the Framework Act on Intellectual Property. Furthermore, it is inappropriate to seek to converge the full structures completely, given the limitations of the South Korean legal regime and the fairness balance with other legal cases. It is deemed that, although the provisions of the Framework Act on Intellectual property should be considered at the practical level, the Invention Promotion Act will need to be respected for its legislative purpose in itself.

  • The application of 4th Industrial Revolution technologies in the defense sector is accelerating, leading to the rapid incorporation of information and communication technologies (ICT) into military systems. The biggest threat to these ICT-based military systems is an electromagnetic pulse (EMP) attack, which can result from nuclear explosions or EMP bombs. North Korea's ongoing nuclear advancements and EMP bomb capabilities pose a critical threat, necessitating South Korea's preparedness for such attacks to ensure the effective operation of its ICT-based military systems. Despite this urgency, the South Korean military currently lacks comprehensive standards for EMP protection, relying only on the design criteria for EMP protection facilities for buildings. This gap highlights the absence of sufficient legal and regulatory measures and the lack of focused research to develop EMP protection performance standards for safeguarding military systems. Therefore, this paper aims to analyze existing EMP protection performance standards and relevant laws and regulations. It proposes improvements and establishes necessary standards to enhance the EMP resilience of military facilities and equipment.

미국 전자정부 정보보안 법제 동향

  • 미국은 전자정부 구현을 위하여 각종 법규를 제정하였고 이를 통합하여 2002년에 전자정부법을 제정하였다. 그리고 동 법을 제정하면서 전자정부의 성공이 정보보안에 있다는 사실을 인식하고 전자정부법에 연방정보보안관리법을 삽입하여 통과시켰다. 이를 통하여 전자정부의 실현과 관련하여 연방 각 부처로 하여금 정보보안의 이행을 실질적으로 추진하고 보고하도록 하는 연방 정부의 체계적인 정보보안 정책을 확립하였다. 이러한 미국의 전자정부에 대한 정보보안 정책 확립은 우리나라 전자정부의 구현과 실행에 있어 체계적인 정보보안 정책 수립의 필요성과 중요성을 다시금 일깨우고 있다고 할 것이다.

  • The purpose of this study aims to provide possible suggestions for the improvement KDC 5th ed. as a system. After analyzing and evaluating time & space devices of KDC 5th ed.(including DDC 22th ed. and NDC 9th ed.). such as main schedules, common auxiliary tables, internal tables and notes, suggestions for the improvement were proposed. If above suggestions are adopted, effective literature classification scheme which is suited to domestic circumstances will be certainly prepared.

핵산 유도체들에 대한 in vitro 항바이러스 약효검색

  • 바이러스 치료제 개발을 위하여 합성된 핵산유도체 11개에 대한 in vitro 항바이러스 약효검색을 수행하였다. 검색대상 바이러스로서 외피보유 DNA 바이러스인 human herpesvirus에 속하는 herpes simplex virus type 1과 type 2에 대해서는 Vero 세포체계에서 3일 후 CPE 저해정도를 MTT 검색법으로 cytomegalovirus에 대해서는 HEL 세포체계에서 7일 후 Giemsa 염색법으로 약효를 측정하였다. 외피비보유 RNA 바이러스인 picornavirus에 속하는 poliovirus type 1과 type 3과 coxsackie B virus type 3에 대한 약효를 HeLa 세포체계에서 2일 후 CPE 저해정도를 MTT 검색법으로 측정하였다. 아울러 selectivity index를 구하기 위하여 Vero와 HeLa 세포에 대한 약물자체의 독성인 cytocidal effect를 MIT 검색법으로 측정하였다. 그 결과 항 herpesvirus 약효는 어떤 물질에서도 발견되지 않았으나 한 물질이 poliovirus type 1과 3에 대하여 selectivity index 10정도 (CC$_{60}$ 38 ug/ml, EC$_{50}$ 1-4 ug/ml)를 나타내었고 자세한 기작은 좀 더 조사할 필요가 있다.

  • 최근의 국내 정보보호 인증체계는 암호검증제도의 시행과 CCRA 가입으로 큰 변화를 맞이하였다. 이런 변화는 국가기관의 정보보호제품 도입체계에도 많은 영향을 미치고 있다. 본 고에서는 정보보호제품 인증 체계 변화, 이 후의 개편된 보안적합성 검증제도에 대한 간략히 소개하고, 보안적합성 검증제도와 암호검증제도의 신청을 위한 제출 문서 작성법을 제시하여, 보안적합성 검증제도와 암호검증제도 신청 또는 연 도움을 주고자 한다.

A Study on the Link between the Severe Accident Punishment Act and ISO 45001 of SMEs (중소기업의 「중대재해처벌법」과 ISO 45001의 연계방안 연구)

  • Purpose: This study proposes a plan for linking the Severe Accident Punishment Act and the Occupational Health and Safety Management System so that SMEs can meet the requirements of the Severe Accident Punishment Act only by maintaining and implementing the Occupational Health and Safety Management System. Method: Conduct a theoretical approach, such as a literature review. First, as a theoretical approach, the safety and health management system of the Serious Accidents Punishment Act was examined, the requirements of ISO 45001 were analyzed, and the statistics of small and medium-sized enterprises (SMEs) from 5 to 49 to which the 2024 Serious Accidents Punishment Act was applied and the number of accident deaths were investigated. Result: No problems were found in linking with the Serious Accident Punishment Act when constructing Occupational health and safety management systems (ISO 45001). Conclusion: It is judged that the establishment of Occupational health and safety management systems (ISO 45001) and management of implementation performance will be able to satisfy the Act on the Punishment of Serious Disasters.
