According to the change in media environment, a support plan for local broadcast has been required. In terms of legal and institutional support for the development of local broadcast, the enactment of special Act for local broadcast has become a breakthrough. In this point of view, we analyzed the performance and the limitation of the special Act. As a literature research, analyzing the literature and related-ordinances, we have sought legal and institutional support plans for the local broadcast. As a result, with the Local Broadcast Development Council being in charge of legislative right and responsibility, a plan to empower them to have legal and institutional authority should be drawn; another plan to secure independence in operating a fund and to promote the capability to produce local broadcast programs and the distribution system should be drawn; the other elaborate plan for the locality index that assesses the locality is required. Local broadcast should be on a way to secure not only public interest and concern but locality and diversity; legal and institutional plans should be sought.

The purpose of this article is to demonstrate that Hegel's philosophy of right is a dialectic critique of liberalism. The dialectical criticism in this article does not mean the formal logical denial, but a return to self by self-negation. Thus, if Hegel's philosophy of right is a dialectical critique of liberalism, Hegel's philosophy of right will be critical of liberalism and at the same time, it will not reject liberalism, but rather have aspects of liberalism. The criticism of liberalism implies that individual freedoms and rights can not be realized subjectively through individual free acts, but are realized intersubjectively through social mediums. And this is also found in controversies among modern liberalists because modern liberalism requires the government's role and institutional arrangements for the realization of individual freedoms and rights. We can find the aspects of liberalism in Hegel's philosophy of right since Hegel's ethical life entails ultimately the concrete realization and extension of individual freedom and rights.

In autonomous car, significant progress has been achieved in technical aspects, but it is deadly slow to solve its various legal problems for commercialization of autonomous car. This paper surveys the road driving eligibility, a typical legal issue in autonomous car. Problems on current laws and regulations are analyzed, and some remedies are suggested. Technical development should be performed collaboratively with law and regulation revision, and understanding these legal issues would be very helpful to the engineers who develop autonomous cars.

This study aims to provide implications for future research on cryptocurrency through examining domestic research trends in cryptocurrency. As a result of the study, domestic research on cryptocurrency has been in full swing since 2018, but research is still lacking, with a total of 30 academic papers and 14 dissertations. By detailed topic, research on legal, taxation and market aspects is relatively more than research on acceptance. In this study, research on legal, taxation, crime, market, and acceptance, which are classified as research topics, will have academic value, and future research on virtual currency needs to be actively conducted.

최근 사이버스페이스에서의 범죄가 큰 문제점으로 대두되고 있다. 사이버스페이스에서의 피해를 최소화하기 위해 관련법의 재정 및 개정이 필요하고, 법규 위반자에 대한 엄격한 법 집행이 요구되고 있지만, 사이버스페이스의 특성상 실효성이 약하기 때문에 시민의 자율성에 의존하는 사이버스페이스의 윤리를 강화하는 측면으로 추구해야 한다. 이런 논점에서 본 논문은 사이버스페이스 기술의 발달로 발생되고 있는 범죄의 종류, 법 적용의 범위 및 한계점, 사이버스페이스에서의 법적 규제와 윤리의 상관관계, 사이버스페이스의 질서를 형성 하기 위한 자율적인 윤리 통제의 중요성 등의 이슈들에 대해 고찰해 보았다. 또한 사이버스페이스의 건전한 윤리의식을 정착시키기 위해 가장 이상적인 이슈를 판가름하는 방법론을 제시하였다. 사이버스페이스를 하나의 신천지 즉 유토피아로 건설하기 위해 네티즌들 모두가 법적인 통제보다는 자율적인 윤리의식 함양으로 건전한 정보문화를 확립하고 사이버스페이스의 주인으로써 최선을 다해야 한다.

해상교총관제는 해상운송에서의 운영적 ${\cdot}$ 환경적 위험을 강소시키기 위한 수단으로써 전 세계 여러 주요 항만과 수역에서 이용되고 있다. 현재 각 국에서는 자국연안에서의 선박통제제도를 적극적으로 실시하고 있으며, 해운의 활성화와 더불어 항만의 안전성 확보를 위하여 각국은 VTS에 관한 국내법을 제정하여 이를 시행하고 있다. 우리나라도 VTS와 관련하여 여러 규정들을 두고 있으나 각 개별입법 내에 산재해 있는 실정이며, VTS를 운영하는 관제요원의 책임과 권한을 명확하게 규정하고 있지 아니하다. 이에 향후 VTS 운영과 관련한 법제의 정비에 관한 논의를 촉진시키는 선행연구로써 현행 VTS 운영과 관련한 법적 문제점을 지적하고 개선방향을 제시한다. 우선 VTS 관제범위에 관한 논의는 국제법적 측면의 법리 정토가 필요하리라 생각되며, VTS 관제요원의 권한과 책임에 있어 적극적 관제에 대한 개념의 정립과 더불어 관제요원의 재인책임과 중과실 경과실에 대한 해상고유의 특성을 반영한 해석이 되어야 할 것으로 생각된다.

사용자의 편리함과 유익함 뒤에는 높은 위험성이 공존한다. 특히 자동차의 경우에는 빠른 속도로 장소를 이동할 수 있다는 장점이 있지만, 사고 발생 시에 생명을 위협할 만큼의 위험을 가지고 있다. 자동차 사고 발생 후에는 시시비비를 가리기 위해서 많은 분쟁이 발생하는 것이 일반적인 판례였다. 자동차용 블랙박스는 자동차 사고 발생 시에 정확한 현장의 영상, 음성 및 기타 센서 정보를 기록한다. 이를 이용해서 전후좌우, 차량의 상태를 분석하여 사건 발생의 실마리를 찾을 수 있는 중요한 단서로 사용된다. 하지만, 아직은 블랙박스 영상만으로는 법적인 자료로 사용될 수는 없다. 즉, 법적인 자료로 채택되기 위한 기밀성과 무결성 측면에서 약점을 가지고 있다. 이에 따라서 기록된 정보를 암호화하고, 접근 자에 대한 기록을 남기는 기능이 연구 및 표준화 제정되고 있다. 차량 내외에서 수집된 정보에 암호화를 적용하여 이종 기기간 데이터 공유를 차단하고, 자동차 정보기기 보안 인증서를 가지고 있는 단체를 통하여 보안키를 이용하여 정보를 활용하기 위한 시스템이 구성되고 있다. 이를 통하여 자동차 융합 정보통신 장치들로부터 기록된 정보를 법적인 객관적 근거로 활용할 수 있도록 자동차용 정보통신 기기들이 기밀성과 무결성을 준수할 수 있도록 발전할 것이다.

유역종합치수계획은 홍수유출을 조절시킬 수 있는 자연 또는 인공 시설물들을 유역 전반에 걸쳐 종합적으로 연계 운영하는 구조적 수단과 비구조적 수단을 동원함으로서 유역의 홍수피해 저감 능력을 극대화하고자 하는 계획이다. 하지만 유역종합치수계획의 비구조적 측면은 이상기후로 인한 극단적인 형태의 홍수, 제도적인 연계성 부족으로 관계기관, 유역주민, 법적 행정적 뒷받침 등의 문제점을 가지고 있다. 따라서 본 연구는 국내 유역종합치수계획과 하천기본계획과의 연계성 문제, 유역의 홍수방어 대책, 유역 협의체의 구성 등에 대한 문제점 및 개선방안을 검토하였다. 이를 위해 미국의 유역종합치수제도와 일본의 유역종합치수대책 및 특정도시하천유역치수계획의 선진 외국의 유역종합관리 현황 및 최근의 변화 과정을 비교 분석하여 국내 유역종합치수계획에 대한 적용성 및 개선방안을 분석하였다. 아울러 유역종합치수계획에서 지자체간의 연계성을 위한 통합적인 유역협의회 구성 및 운영의 문제, 유역분담 홍수량 저감시설물의 설치를 위한 법적 제도적 장치의 문제, 전국적인 유역종합치수사업의 시행에 필요한 법적 제도적인 문제를 확인하였으며 이에 대한 개선방안을 도출하였다.

최근 정보 및 산업사회의 발달에 따라 전기에너지의 이용이 양적, 수적으로 증가되고 있는 가운데 모든 전기.전자기기 및 전력설비에 전기에너지를 전달하는 전력선로상에서 불요전기신호에 의한 전원방해현상이 발생되는 경우가 빈번해 지고 있다. 따라서 기기의 정상적인 동작에 장애를 주는 증 PLD현상이 심각해지고 있는 실정이다. 그러므로 PLD현상파악 및 이에 대한 방지대책의 수립은 EMI/EMC문제의 가장 기본적이라고 할 수 있다. 먼저 PLD에 대한 실태조사가 뒤따라야 할 것이다. 또는 국내 여러지역을 전력수요가별로 구분하여 PLD현상을 측정할 필요가 있다. 그리고 측정된 데이터의 분석에 의해 각종 전기.전자기기 등의 효율적 운용을 보장하기 위해서는 PLD현상에 대한 대책을 법적규제의 측면과 잡음대책방안의 측면에서 제시해야 할 것이다.
