광산업에 대한 정부 지원의 법적 제도적 기반이 되는 '광융합기술 개발 및 기반조성 지원에 관한 법률'(광융합기술개발법)이 지난 9월 21일 시행에 들어갔다. 광융합기술개발법은 정부 차원으로 광융합기술 진흥과 경쟁력 강화를 위한 종합발전계획을 수립하고 광융합기술 정책연구 및 정책수립 지원, 연구 개발 지원, 광융합기술 표준화, 전문인력 양성, 국제협력 및 해외시장 진출 지원 등을 추진하는 내용이 담겼다.

This study reviews the life cycle models considering legal and technical characteristics of personal data respectively. Based on the reviews, this research proposes 'consent and management based model of personal data' which is applicable to the domestic IT companies. The model suggested in this paper has characteristics that 'Consent' and 'Management' factors are ㅁpositively considered, which is overlooked in the other models. The validity of the model is examined by two methods, validation of the model of excellence by contrast of the other models, and 'consent' and 'management' factors cover all the life cycle processes. Using this model, IT companies will be contributed to the analysis of the personal data utilization and the development of IT system protection.

선행 연구개발한 집단감시 디지털 시스템(Group Digital Surveillance System for Fishery Safety and Security, GDSS- F2S)은 대단위 양식장에 침입하는 도적을 방어하기 위하여 레이더 추적정보와 적아식별 정보를 제공하는 시스템이다. 그러나 GDSS-F2S에서 제공하는 두 가지 정보만으로는 도적행위를 입증할 수 있는 법적 증거자료로 미흡하다. 본 논문에서는 이러한 문제점 해결방안의 하나로 CCD 카메라를 이용한 영상획득 장치를 개발하여 GDSS-F2S에 부가한 연구내용을 기술한다. 영상획득 장치 개발에 앞서, 실험지역의 지리적인 특성을 고려한 도적침입 예상경로 분석과 도적행위 시나리오를 기반으로 유효한 대응수단을 검토한 결과, 영상획득 장치가 유효한 대응수단임을 확인하였다. 영상획득 장치는 저가이변서 성능이 우수한 0.0001 룩스의 초저조도 CCD 카메라와 부가장치를 이용하여 개발하였다. 6개월 이상의 장기 현장실험을 통하여 본 연구에서 개발한 시스템을 평가한 결과, 주간은 물론 1 미터 앞도 식별할 수 없는 야간에도 차량의 행동과 번호판 및 사람의 행동과 인상착의 등의 영상정보를 확보할 수 있었다.

In this paper, we presented a strengthening plan to prevent personal information leakage incidents by securing legal compliance for personal information impact assessment and suggesting measures to strengthen privacy during personal information impact assessment. Recently, as various services based on big data have been created, efforts are being made to protect personal information, focusing on the EU's GDPR and Korea's Personal Information Protection Act. In this society, companies entrust processing of personal information to provide customized services based on the latest technology, but at this time, the problem of personal information leakage through consignees is seriously occurring. Public order management is one of the most important areas in policing. Drawing on the legal framework and policy, this study aims to assess practices of criminal justice practitioners, especially, police and prosecutors, in England and Wales. Using qualitative interviewing, four main themes are identified: (1) an emphasis on a right to protest, (2) police practices on public order management, (3) the development of police/prosecutor liaison, and (4) the value of video evidence. Based upon these findings, several legal, policy and practice implications are drawn. These implications involve a wide range of aspects concerning strategic, operational, and tactical interventions by the police, as well as collaboration between police and prosecutors. Although the criminal justice context in England and Wales is very different to South Korea, some practices and distinctions can be useful to consider in the Korean context. This study suggests that more gains can be made if legislation, policy, and practice across criminal justice nodes can be coordinated and approached holistically.

The donation collection system to secure infrastructure and land necessary for public development projects has been actively applied as an effective means of realizing public interest and the concept of recovering development profits, and has contributed greatly to society in public difficult financial conditions. However, due to the ambiguous legal standards and lack of legal grounds for the operation of the donation collection system, it has been arbitrarily used for administrative convenience in the form of granting a donation collection assistant to install infrastructure. In addition, infrastructure is a facility that is constructed and donated within development profits to obtain licenses, and is promoted to minimize construction costs to improve profitability, posing a risk of poor infrastructure planning, design, and construction, resulting in increased safety and maintenance costs for citizens. Continuous system and legal improvement are needed to improve the excellence, convenience, and safety of facilities that citizens will use for half a century through the improvement of the donation system.

The legal dispute of electronic commerce and computer crimes are increasing because the electronic services like e-government and e-commerce are now widely used. Computer Forensics becomes the method for recovery, preservation, analysis and report regarding digital evidence essential to resolve the legal dispute and computer crime. In this paper, the developmental process of Computer Forensics is discussed. It is intended to elicit constructive discussion regarding the domestic Computer Forensics. And this discussion will be of help to establish the secure e-business and e-government services in the field of the research, legal system and technical skill of domestic Computer Forensics.

Today, the central government and an autonomies make an attempt to contracting out, restructuring, and renaming for public libraries in Korea. These attempts are plot for a disorganization of public libraries. The purpose of this study is to analyze an entity of the plot and to extricate from the disorganization crisis. Based of the analysis, the best alternatives to extricate the crisis are reinforcing the basis of popular support, establishing the identity for public library, finding out opposing logic, taking a legal actions, pressing for a formation of local committee of library development, and overthrowing the confusion of library administrative system.

최근 구축된 정보통신인프라를 이용한 금융수단이 보편화됨에 따라 금융인프라 역시 과거 ATM단말기나 FEDI 수준을 넘어서 급속히 본격화되고 있으며, 2000년대 이후 전자결제의 이용이 상당부분 보편화되고 있다. 이미 우리나라의 경우에도 전자화폐의 사용이 도입초기를 넘어서 상당부분 보편화 단계로 접어들고 있으며, 상법의 개정과 전자금융거래법의 신규제정 등 다양한 법적 기반 역시 어느 정도 정착단계에 정착되고 있다. 그럼에도 불구하고 비대면의 거래에서 발생할 수 있는 각종 문제점이 완벽하게 해결되었다고 보기는 어렵다. 이에 본 연구에서는 우리나라의 전자화폐 활용 현황 살펴보고 일본, 싱가포르의 최근 현황을 주요국의 선진사례로서 살펴본다. 이러한 선진국의 사례가 주는 시사점을 검토하고 이를 통하여 우리나라의 전자화폐 활용상의 활성화에 장애가 되는 요인을 규명함으로써 활성화 전략을 모색해 본다. 그리고 이와 함께 최근 야기되고 있는 각종 법적 문제점을 규명하고 대안을 발굴하는 방안도 함께 모색해 본다.

전자거래는 비대면적, 비서면적, 무형의 상품, 탈 국경화의 성격을 갖게 됨에 따라 전자거래의 활성화를 위해서는 서면거래에서와 같은 가치 인정을 위한 법적 마련이 필요하다. 또한, 시스템 측면에서도 정보 및 정보통신기반들이 적시에 적절한 방법으로 접근될 수 있고 이용될 수 있는 유용성, 정보의 프라이버시 보호를 유지하거나 선택된 수신자만이 정보에 접근하도록 허락하는 기밀성, 정보가 전송중에 변경되지 않았음을 보장하는 무결성, 정보의 원천지를 보장하는 진정성, 정보가 송신자에 의해 전송되었음을 보장하는 부인봉쇄 등의 기능구현이 필요하다. 이에 따라 전자거래로 발생할 수 있는 문제들과 전자상거래 유형, 전자거래시스템의 구성요소 및 기능, 전자거래기본법과 전자서명법의 특징 그리고 법 제정으로 발생한 법적 효과들을 제시하였다.
