A Study on Introduction of Private Investigation (민간조사(탐정)제도의 도입방향 - 경비업법 개정을 중심으로 -)

  • In the developed countries, the private investigation system which is part of private security has developed together with police, and OECD countries except South Korea has developed the private investigation system establishing by the Private Investigation ACT. In Korea, there was several attempt to establish the Private Investigation ACT but it was not accomplished because of private security circumstances. In this study, the chapter Iis introduction, theoretical background is in chapter II, chapter III is the operation of private investigation of the developed countries, analysis and direction of the Private Investigation ACT in chapter IV, and conclusion in chapter V. To introduce the private investigation system, it is required to discover the problem of the Private Investigation ACT mentioned in this article and to develop the private investigation system by collecting the opnion of citizen, academic world, and the related agency. It is necessary to associated interest and effort of citizen, academic world, and the related agency for introdection of the private investigation system.

  • As modern society has become specialised and complex in all areas of politics, economy and society, it has reached a point where it is difficult to control crime with the general public power. Private security, which began to fluctuate after the 19th century, has expanded its scope to subsidise public power in various areas, sometimes beyond public power. Among these private security activities, the private investigate system has long been used to provide private investigate services that are safe from personal human rights protection and crimes. This study investigate the private investigation system in the United Kingdom and South Korea focusing on the missing person investigation system by using the qualitative content analysis of research methods. First, the results of the qualitative content analysis are described through methods such as literature reviews and interviews on how the British private investigation system and the missing persons search system are implemented. Next, the results of the content analysis are presented through the methods of literature reviews and questionnaires on how the implementation of the civilian survey in Korea and the search for missing people is proceeding. It is a very important field in both countries, and there is a very limited study, especially from a Korean perspective. Therefore, it is expected that this study will not only facilitate discussions for the successful legalisation of the private research system, but also provides a basic foundation for future research. The study of the private research system should be ongoing and periodic, not temporary. In addition, in order to introduce Korea's private survey system, the private investigation system should be developed by discovering the problems of the Private Investigation Law mentioned in this study and collecting opinions from citizens, academics and related institutions. The introduction of the private investigation system requires the connection of the efforts and interests of citizens, academia and related institutions.

  • The private investigator service in Korea is to protect our legal market from personal right, creation of job, legal opening via OECD and FTA as well as the prevention of negative private investigation such as service center and private investigator operated without any control. Therefore, this study compares the civil research systems of advanced countries, reviews the legal process to introduce private investigator service as well as considers the previous studies to suggest the work sectors of private investigator service appropriate to Korea. As a result, it distinguished the private investigation work into corporate, finance, insurance, medical service, Cyber, traffic accidents, intellectual property right, lost and forensic science.

  • There are various discussions about introducing private investigation in South Korea these days, and training private investigators is one of the main topics. Training private investigators, unlike other training, is required to instill expertise and ethical quality into the trainees since the major task of the investigators includes protecting the lives of the citizens as well as their properties. Therefore, many agree to the idea that systematic educational programs need to be organized to produce private investigators with expertness and morality. In this study, we explored the opinions of those who are concerned with this issue of establishing private investigation in the university education and analyzed the data by using the NVivo 2 program. The result revealed that the reasons that people supported the idea of launching private investigator services were as follows. First, there is lack of manpower to maintain peace and public order in the country. Second, the police does not intervene actively and help harmed victims unless it is a consequential incident. Third, in position to wield public power, police officers cannot get involved in civil affairs. Also, absence of an academic institution to educate private investigators and lack of the police and clients' trust in private investigation were the two biggest reasons that people approved the proposal to introduce department of private investigation in universities. The interviewees of the study believed the outlook and future direction for private investigation would change depending on the status of the licensed private investigation business bill. Before the bill passes, they thought that the work of private investigators will be performed by insurance companies, foreign private investigation businesses, domestic consulting firms, and security providers which supply similar services. On the other hand, after the bill passes, they believed that numerous private investigator corporations resembling existing security corporations will be founded in addition to the current market, and that private investigation in the academic field will also be vitalized.

A Study on the Which Facilities will Assume Charge of Management for the Private Investigation Business (민간조사업 관리.감독 기관 선정에 관한 연구)

  • For the introduction of domestic private investigation act, with beginning of private investigation act bill by Ha Soon-bong in 1999, congressmen Choi Jae-chun, Lee Sang-bae, in 2005, Lee In-gi in 2008, and Kang Sung-chun in 2009 initiate the each bill, and many researches and studies in the academia about the private investigation act bill makes have a bright prospect toward to the bill. However, up to the present, there is a debating which services will charge for management for the private investigation business. It is important that which facilities will assume charge of management for the private investigation business because this is a cornerstone to set up a successful investigation act which fulfills a nation's needs in the future. According to the other countries which induced the act earlier, they, by perceiving the act as a part of the private security, manage the act by setting the police or the separate services such as committees. In municipal laws, there was a case suggesting The National Police Agency and The Justice Department as the facilities for the management and supervision, however, for the unification of administration for the whole private security, similarities of the private investigation and police service, privacy of police services, and development for the domestic private security business, the national police agency, taking care of the private security business, should be assigned as the department for management and supervision, additionally, suggestion to establish "The Management Committee for Private Investigation Business" as a separate facility under the national police agency is needed.

  • Our society's modernization created many opportunities for us to need a private investigation service system. Variation of international environment due to joining in the OECD, opportunity of individual legal, collect evidence during judgement, prevention of damage criminal, security of business in company, free trade economy's system etc and don't need to enumerate how important of introduction of private investigation service system. In addition to there are lots of objection opinions, such as possibility of person's private life, invade of lawyer's area, confliction with investigation team, gap of wealth and poverty that make preponderance of information. So this research can be considerate from objective opinion, and can obtain conclusion just like below. First, private detective agencies that encroach on the individual rights will naturally deteriorate after the implementation of private investigation service system. Through this, the probability of civil rights encroachment will be lower, and for this to happen there needs to be a thorough maintenance of the system. Secondly, mutually beneficial solution should be found not by a conflict between two sides. Detective business sector should not cause social confusion from conflicts with other investigation organization such as police, or investigators, rather, it must get on the demand of the diversified citizen and maintain the diverse sector inter-cooperate right, and to do that law and institution must be made for the base. Thirdly, investigation used depending on the gap between wealth and poverty does not mean the actualization of the rights and interests of the citizen. If the duty of investigation sector is to find the evidence and collect or manufacture of the evidence, then the problems which the nation can't handle will be more enlarged and then finally end up with strengthening the capability of national public security demand.

A Study on the Iimplementation of the Civilian GIS Data Distribution Systems (민간GIS유통체계 구축에 관한 연구)

  • Despite of a huge amount of GIS data were distributed in the private sectors, they were gradually decayed due to lack of the legal preparation or civilian data distribution channels. In order to solve these problems this study was mainly focused on the civilian GIS data distribution and demonstrated a proposed direction through the requested questionnaire and analysis of the civilian enterprises and public sectors for the favorable civilian GIS distribution flow. The implementation of the civilian GIS data distribution center(provisional name) was proposed fir the civilian GIS distribution flow because of the fact that civilian sectors were seriously requested to build and to operate the civilian GIS distribution organization through the result of the requested questionnaire. The requested questionnaire items were selected as the civilian enterprises distribution, data implementation and management, low and regulations, NGIS distribution network business, and civilian GIS distribution renter build to activate and to participate civilian GIS distribution. Therefore, three implementation models and three implementation operation were proposed to guide a roll of the civilian GIS data distribution center and the distribution boundaries.

  • The society shows rapid change throughout various fields in the 21 century. These changes are in progress in Korea as well and the private security field is not in exception. The private security system has socially effective function by providing services, which the police cannot provide to citizen. However, it cannot be treated rightly the possibility of violation of human right during the actual action. The qualified person at least should take private investigation service considering privatization of criminal justice and considering that the Private Investigation Act submitted to the Congress could not affect its investigation authority to the citizen currently. The purpose of this study is examination of the private investigation system in Korea and other country and is presentation of its improvement. The chapter 1 composed of introduction on chapter 1, concept and service in chapter 2, private security system in other countryin chapter 3, private security system in chapter 4, problems and its improvements in chapter5, and conclusion in chapter 6. It requires not only consideration of government but also consideration of citizen and effort of both sidesto successful settlement of private security system in Korea.

A Study on Difference between Private Security and Private Investigation (민간경비업과 민간조사업의 차이점 연구)

  • In advanced country, private investigation system is made up of private security and in domestic, there is growing need constantly to introduce private investigation but it is not passed until now in assembly so a messenger office which is run illegally is growing because of demand by subdividing business areas. That is a proof that both the police and private security don't meet demand of public peace to the public. that's why the police has own businesses like a investigation, traffic, intelligence, crime prevention and private security's business areas are limited like a facilities security, escort security, protection of a person, machine security, special security as the Private Security Act. This study attempts to know structural difference between private security system and private investigation system in case private investigation system becomes one of the private security. on some question, respondents reply like that private security and private investigation is very different(71.2%), different(22.4%), average(6.3%), similar(0.0%), very similar(0.0%). the result seems like respondents recognize private security and private investigation as different businesses. In the result of non-quantity analysis, the differences seem like a business character, expense, business scope, public power, scale of organization, object of threat, legislation. In domestic, effort to legislate private investigation system has undergone difficulty since congressman Ha Soon Bong's motion in 1999 and today, congressman Yoon Jae Ok's All Amendments Private Security Act and congressman Song Young Geun's Private Inveswtigation Act are pending in assembly. This study's result is intended for examining difference in exploration between private security and private investigation and then there is going to propose to the policy in case private investigation system is passed in assembly by amending Private Security Act like congressman Yoon Jea Ok's All Amendment Private Security Act.

  • The object of this study is to propose a study on the Private Investigator usage for Cyber Crime. The latest trend of cyber crime is being evolve in sophisticated and complex way over the global, like internet fraud, cyber gambling, hacking and etc. Hence national investigative authority mobilize high specialized skills and method of criminal investigation by each nation. But it is hard to respond in rapid and effective way because of propoor, distribution of group and insufficient of related legal system. Already in other countries, not considerable amount of services are given to private investigators in detection and tracking part which is inefficient by nation. So it has significantly meaningful to compensate the defect and study about private investigator usage as companion of cooperation policing for effectively respond to cyber-crime. The way to effectively deal with the cyber-crime is reevaluate meaning of partnership policing and need of private investigator usage. Also it is to analyze the main issue about introduction of a system and suggest the effective way of introduction. First, legislation of private investigator usage which is based upon partnership policing should be made up. Moreover, to establish the range of private investigator's business and enhance the reliability, it is to propose introduction of leading professional global certificate and license system with sufficient education and test. We are expecting introduction of private investigator usage can improve efficiency of investigation and promote effective countermeasures of cyber-crime.
