A Comparative Legal Study on Safety and Transportation Convenience of Mobility Disadvantaged Persons (항공교통약자 안전 및 이용편의를 위한 비교법적 연구)

  • Ago the passenger who using a wheelchair was denied boarding from the airline. The ACT ON THE PROHIBITION OF DISCRIMINATION AGAINST DISABLED PERSONS prohibits discriminatory treatment of persons with disabilities in transportation. But there are situations that limits the movement on persons with reduced mobility. The international community promote to protect disabled persons and persons with reduced mobility against discrimination and to provide them with assistance when travelling by air. According to news report, the governing Council of the International Civil Aviation Organization (ICAO) has established new global core principles on air transport consumer protection. The principles cover three phases of a customer's experience: before, during and after travel, and will now be considered by ICAO's 191 Member States when they develop or review their applicable national regimes. The international community are recognizing that passengers can benefit from a competitive air transport sector, which offers more choice in fare-service trade-offs and which may encourage carriers to improve their offerings, passengers, including those with disabilities, can also benefit from consumer protection regimes. In accordance with these we will also be provided to regulations that can prevent and protect the air passenger. In this paper analyze the regulations of the international air passenger rights, point out the lack of policy.

  • 물관리는 밀레니엄개발목표(Millennium Development Goals)의 달성과정에서 가장 강조되는 주제 중의 하나이다. 물관리의 최종목표는 물관리 그 자체가 아니라 자연적으로는 유한한 수자원의 지속가능성을 유지하고 사회적으로는 계층간의 형평성을 실현하는 것이다. 그러나 개발도상국들은 한정된 국가재정으로 기반시설의 투자가 부족하고 기후변화에 따른 자연재해의 빈발로 인하여 인간다운 삶의 질을 보장받기 어려운 상황에 직면하여 있다. 이러한 인식 아래, 미국, EU, 일본 등의 선진국은 물론 이웃 중국도 개발도상국을 대상으로 물 관련 사업의 공적개발원조(ODA) 프로그램을 활발하게 추진하고 있다. 최근 우리나라의 대 개도국 협력사업은 한국국제협력단(KOICA)이 수행하는 ODA 사업을 중심으로 큰 폭으로 늘어나고 있다. 우리나라의 물 분야 지원사업도 식수개발, 댐건설, 관개시설 개발, 수질오염처리, 재해방지 예 경보 시스템 및 홍수조절사업 등으로 다방면에 걸쳐 활발하게 진행되어 왔다. 그러나 우리나라의 물 분야 ODA 사업은 정책 및 제도에 대한 컨설팅이나 교육훈련 등 소프트웨어 기반의 원조개발협력은 상대적으로 미진하고 물리적 인프라 위주의 지원사업이 대부분을 차지하고 있다. 최근에는 전문가 파견 및 연수생 초청 등의 인적협력의 사례가 증가하고 있으나 아직까지는 사업내용의 대부분이 건물, 시설물 및 기자재 등의 구조적인 지원 형태로 이루어지고 있다. 이러한 형태는 일찍이 대개도국 물 분야 사업을 추진한 미국이나 일본 등의 선진국들이 원조협력사업의 일관성과 지속성을 평가하기 위하여 제도적이고 정책적인 지원을 확대하는 것과는 거리가 있다. 1992년 KOICA가 네팔 모디강 수력발전소 실시설계 지원으로 시작된 우리나라의 물 분야 사업도 이제 20년에 이르고 있다. 물 분야 지원사업도 새로운 방향전환이 필요한 시점이다. 본 연구에서는 우리나라의 물 분야 ODA 지원사업의 현황과 문제점을 파악하고 향후 나아가야 할 정책방향을 제시한다. 이를 위하여 먼저 아시아의 스리랑카와 아프리카의 에티오피아의 2개 국가를 사례지역으로 선정하고 물관리의 현황과 문제점을 파악한다. 그리고 사례지역에 대한 우리나라의 물 분야 ODA 지원사업의 현황과 당면과제를 분석한다. 마지막으로 선진국과 우리나라의 물분야 지원사업의 추진방향을 비교분석하여 우리나라 물 분야 ODA 지원사업이 지향할 방향성을 제시한다.

International Comparison of Re-start up Support system for Failed Businessmen (실패기업인의 재창업지원 제도에 관한 국제비교연구)

  • The Korean government is building a virtuous cycle of startups and venture businesses for a dynamic, innovative economy. This ecosystem is made possible when a social environment that embraces tolerance and turn business failure into re-startups and challenging venture startups by outstanding entrepreneurs are present. Due to the government's efforts to promote start-ups and venture businesses, their number has been increasing annually, but the efforts to create a social environment for re-startups and establish a relevant institution have recently started. This study is aimed at providing policy direction for re-startups by getting policy implications after identifying the current status of domestic failed businessmen' re-startups based on previous researches on failed businessmen. This study also reviewed advanced nations' cases and made international comparison of re-startup policies. Before the startup culture that recognizes failure as the stage for success is formed as in the U.S., it is necessary to create a legal basis for continuously pushing for the rechallenge policy of EU's Small Business Act and establish and operate the private sector-driven revitalization council of SMEs in Japan. It is also necessary to consider the guarantee of failed businessmen' livelihood. If additional research and government policies are added to the conclusions made on the policy implications, this research will provide an in-depth insight for revitalizing domestic re-startup.

  • Unexpected massive disasters have occurred around the world, causing enormous socio-economic damage. The military has long been enacting laws, organizing organizations and establishing systems for crisis and disaster management, but it did not consider the situation when military essential functions were suspended due to unpredictable and massive disasters. With the September 11 terrorist attacks, the U.S. military has developed COOP strategy aimed at continuing military essential functions in all crisis, and is contributed to national continuity by ensuring uninterrupted national security functions. Korean military has established a crisis and disaster management system, but focuses on managing and controlling disasters and crisis situations. Korean military needs a system to guarantee military essential functions even in national crisis beyond its management capabilities. In this study, We compared and reviewed the U.S. administration and military COOP guidelines and directives, ISO22301 international standards., and developed planning guidelines suitable for the Korean military situation by responding to detailed items based on ISO22301. In particular, the U.S. military(DoD, Army, Navy, Air Force) COOP guidelines were drawn and incorporated into the guidelines(such as protection and succession of command authority, the fulfillment of essential functions and operational security, etc.). The planning guidelines are expected to be used as reference materials for the introduction of COOP systems in the military and the establishment of plans in the future.

A study of the income inequality of the aged in OECD 10 countries - Focusing on the life course perspective (OECD 10개국 노인의 소득불평등에 관한 연구 -생애주기관점을 중심으로-)

  • This study views the aged inequalities according to the inequality hypothesis of the life course perspective in OECD 10 countries. Focusing on educational level which is early social status and welfare state regime which is social structure factors of inequality, this study analyzes income inequality for the aged who have transformed into old age period from non-aged period. The analysis is based on the data SHARE of Europe and HRS of USA. The main results of this study are summarized in four points. First, the income inequality is quite high by welfare system and the educational level. Second, the income inequality is somewhat reduced in case the people move from the period of non-aged to the period of aged. However, gini coefficient is still high(0.475). Considering welfare state regimes, although the income inequality is high in conservative regime of non-aged period, this would be higher in aged period. This result supports cumulative advantages/disadvantages hypothesis. The liberal regime remains high income inequality which supports the theoretical argument of status maintenance. Social democratic regime provides evidence to offer some support for the status leveling hypothesis. In there, income inequality is lower in aged period even though income inequality of non-aged period is low. Third, the cumulative advantages/disadvantages of disposable income according to educational level are strengthened and heterogeneity is grown in case people transition from the late period of non-aged to aged period. But public pension has been more equally distributed than gross income. Fourth, seeing welfare state regimes, public pension of aged-period is more inequally distributed than that of non-aged period in liberal and conservative regime. Specially in conservative regime, inequality of gross income is very high and public pension is also inequally distribute So this might show that the social security system strengthens the cumulative advantages/disadvantages. However, in the social democratic regime, public pension is more equally distributed than gross income and it could be much more equally distributed in aged period, which can support the status leveling hypothesis.

  • This thesis is the study of the analysis about Direction of Promote and Acquisition Program of Human Strength. Now we have question 'How we should develop the human resources program to gain human strength in the strategic environment of the future?' We know that if we don't estimate our project precisely, then we can't get good human resources. The purpose of this study is to find the way that how to gain excellent human resources now and in the future. The Ministry of National Defense to study US military Acquisition system. Korean military strategy in the situation of the confrontation between South and North Korea and in the situation of the international relationship and the way of constructing the military strength for the future. To improve Acquisition Program of Human Strength, we must develope and assess the future strategic environment of the Korean Peninsula especially Acquisition Program of Human Strength.

Employment Support for the Low-income Elderly in the OECD Countries: Implications for Senior Employment Policy (OECD 국가의 저소득 고령자 고용지원정책 : 노인일자리사업에 주는 함의)

  • The Korean government has implemented the senior employment policy as a direct job creation policy since 2004. A realistic discussion of policy alternatives and orientation for this has been given little attention even though senior employment policy has been carried out for the last 10 years and it will be expanded next year. This study tries to examine active labor market policy especially focusing on direct job creation programs and policies for the disadvantaged low-income elderly in OECD countries, and then it suggests some developmental alternatives for senior employment policy based on the study's results. The main results from this analysis are summarized in two points. Firstly, except pension policies, employment policy for older workers in the OECD countries is highly proportional to the tackling of objective factors reducing the demand for older workers (wage subsidies, reduced social security contribution rate etc). And the strategies of improving employability have not been relatively important and direct job creation policy has been marginal. Secondly, employment support policies for the low-income elderly can be divided into three types: support for the low-income elderly, alleviating early retirement and support for full employment according to the criteria which are determined by policy objectives and the social economic index. Korea's employment support policies belong to the type of direct job creation among them. This seems to be due to the fact that the rate of elderly poverty is extremely high and an income security system has not been developed in Korea. However, the policy objective is still uncertain. Therefore, this policy needs to set up clear objectives and establish a proper system for the achievement of its goals. If we focus on the strength of its employment characteristics, we need to modify the policy's plan in the perspective of labor market policy. But if we intend to keep both of the current objectives, it is better for this policy to be divided into two parts: social participation and income supplements. Or it also may be a solution to transform the system into an employment service, a training system which supports participants to move into unsubsidized jobs such as SCSEP in the U. S.

International Case Study on the Public Participation Procedure in Environmental Impact Assessment (환경영향평가의 시민참여 절차에 관한 해외사례 연구)

  • Various policies and institutional efforts are being made for mature democracy and more sustainable administration of our society. In this respect, the importance of civic participation, considered essential in environmental impact assessment, has been consistently emphasized in the relevant theories and practices. Although various methods and forms of public participation are taking place in Korea, criticism is widely understood that collecting citizens' opinions in the decision-making process has become ineffective and formal. Starting from these issues, this paper seeks to learn lessons from the foreign cases in the international context. Extensive literature review was conducted to examine the meaning and objectives of public participation in EIA and the tactical principles. Based on this, the participatory systems and procedures in the United States, Britain, Germany, Japan, and Canada were critically reviewed, and the implications were derived through specific cases. The results are, first, the provision of specific public participation guidelines, second, the securing of transparency in the decision-making process, third, the expansion of procedural participation levels, and lastly, the guarantee of participation opportunities. This paper is meaningful as a basic study to enrich discussions on public participation in the domestic EIA hoping to help research through more diverse empirical cases in the future.

Characteristics of Inclusive Playground Guidelines (통합놀이터 가이드라인의 특성)

  • The inclusive playground is a playground where disabled children and non-disabled children can play together, not a playground for the disabled. It started with the change of social awareness of the citizenship rights of disabled people in the 1960s and the resulting playgrounds. Since then, inclusive playgrounds have been developed in many countries, and these are organized in the form by guidelines. In Korea, social interest in inclusive playgrounds is increasing, but there are no systematic guidelines in Korea, and the application of overseas cases or guidelines is limited. The purpose of this study is to classify the concept of inclusive playgrounds and design guidelines, that were previously presented in inclusive playground design guideline of various countries and analyze the characteristics of, design scope, and design principles, and provide a basic framework for creating guidelines. The purpose of the design guideline was to present specific numerical values to the inclusive playground design guidelines, to link with academic research and industrial products, to present pursuit values, and to expand the value of pursuing design methods. The contents were covered by scope, conceptualization, principles of design and design process, design guidelines, and checklists. Most of the guideline covers specific autonomous governments or countries that can apply the related systems or laws, but the composition of the detailed contents is different. The guiding value of inclusive playgrounds presented in each guideline is not a playground for the disabled but a playground for all, and some guidelines refer to the difficulty in playgrounds considering non-disabled children. Based on these concepts, design guidelines are presented in each guideline. Improving the accessibility in design principles is a common theme and adds to the principles of safety, independence, convenience, and playability. None of the guidelines do not provide design guidelines. Although there is a difference in the degree and method of specificity provided by each of the guidelines, the design guidelines can be generally summarized as space, copper line, and unit facilities. As mentioned in many guidelines, an inclusive playground is not only a playground for children with disabilities. Therefore, in the design guidelines, it is also important to the support play of children with disabilities and to induce inclusive play. The design guidelines presented in the guideline can be rearranged into three stages of 'supporting the play of children with disabilities', 'securing the dimensions and materials of spaces and facilities', 'adding auxiliary devices' and 'designing new facilities'. There are three design guidelines for inducing inclusive play. First, by creating various difficulty levels and intersecting spaces, children with various abilities can play with each other, and at the same time, they can interact witheach other. Second, all children can cooperate and play without distinction between children with disabilities and non-disabled children. Finally, the guardian provides the conditions for efficient support so that the disabled child can fully enjoy the inclusive playground.

A Study on the Archives and Records Management in Korea - Overview and Future Direction - (한국의 기록관리 현황 및 발전방향에 관한 연구)

  • This study examines the status quo of Korean archives and records management from the Governmental as well as professional activities for the development of the field in relation to the new legislation on records management. Among many concerns, this study primarily explores the following four perspectives: 1) the Government Archives and Records Services; 2) the Korean Association of Archives; 3) the Korean Society of Archives and Records Management; 4) the Journal of Korean Society of Archives and Records Management. One of the primary tasks of the is to build the special depository within which the Presidential Library should be located. As a result, the position of the GARS can be elevated and directed by an official at the level of vice-minister right under a president as a governmental representative of managing the public records. In this manner, GARS can sustain its independency and take custody of public records across government agencies. made efforts in regard to the preservation of paper records, the preservation of digital resources in new media formats, facilities and equipments, education of archivists and continuing, training of practitioners, and policy-making of records preservation. For further development, academia and corporate should cooperate continuously to face with the current problems. has held three international conferences to date. The topics of conferences include respectively: 1) records management and archival education of Korea, Japan, and China; 2) knowledge management and metadata for the fulfillment of archives and information science; and 3) electronic records management and preservation with the understanding of ongoing archival research in the States, Europe, and Asia. The Society continues to play a leading role in both of theory and practice for the development of archival science in Korea. It should also suggest an educational model of archival curricula that fits into the Korean context. The Journals of Records Management & Archives Society of Korea have been published on the six major topics to date. Findings suggest that "Special Archives" on regional or topical collections are desirable because it can house subject holdings on specialty or particular figures in that region. In addition, archival education at the undergraduate level is more desirable for Korean situations where practitioners are strongly needed and professionals with master degrees go to manager positions. Departments of Library and Information Science in universities, therefore, are needed to open archival science major or track at the undergraduate level in order to meet current market demands. The qualification of professional archivists should be moderate as well.
