디지털 콘텐츠는 영상, 소리(음향ㆍ음악)문자 등 다양한 요소로 이뤄져 있다. 이런 디지털콘텐츠가 온라인을 통하여 유통되는 데에는 여러 가지 요소가 융합되어야 가능하다. 일단 구매가 된 다음에도 디지털콘텐츠는 복제가 가능해 불법적으로 유통되는 단점이 있다. 이 때문에 디지털콘텐츠의 보호기술이 등장하게 되었다. 물론 법적으로 보호장치가 있긴 하지만 일일이 단속할 수 없고 단속이 불가능하기 때문에 불법복제 자체를 방지하는 기술이 등장하게 된 것이다. 이에 디지털콘텐츠 보호기술에 대하여 살펴보기로 한다

기존의 DRM 보호기법은 특정 콘텐츠 포맷에 일부 제한적인 보호방식의 특성이 있기 때문에 현재 모든 디지털 콘텐츠에 대해서 범용적으로 DRM 보호기법을 적용할 수 없는 문제점이 있으므로, 아직도 많은 종류의 디지털 콘텐츠는 DRM 보호기능을 제공받지 못하고 있다. 또한, 기존의 DRM 보호기법은 암호화 알고리즘을 기반으로 많은 양의 데이터에 대해서 암/복호화를 수행하기 때문에 속도가 많이 소요되는 단점이 있다. 본 논문에서는 범용적인 DRM 보호를 위해 콘텐츠 헤더의 부분 암호화 방식과 분할된 콘텐츠에 대한 순열 재조합을 이용한 방법으로 모든 디지털 콘텐츠에 대해서 범용적으로 DRM 보호기능을 제공하는 기법을 제안하였다. 또한 이 기법은 콘텐츠의 암/복호화 수행 속도를 향상 시키고 동시에 기존의 보안성은 유지하는 기능을 포함하고 있으므로 다양한 형식의 디지털 콘텐츠에 대하여 유연하게 적용이 가능하며, 다양한 비즈니스 환경에 확장성 있는 통합 가능하다.

According to the development of the internet technology, many people can access many kind of digital contents. This approach can infringe the copyright and right owner-ship. Currently many people research the DRM(Digital Rights Management) for protect digital content after digital content downloaded. This paper propose the system that client player witch encrypted using PKI have symmetric key and CCI (copy control information), decrypt digital content witch encrypted when digital content created.

디지털콘텐츠와 데이터베이스의 상호접근점을 찾을 수 있는 것은 디지털콘텐츠 자체가 여러 분야의 데이터의 집합임과 아울러 정보서비스를 통해 제공되는 내용물의 구성체가 바로 데이터베이스이기 때문이다. 그렇지만 이러한 보호의 기본적인 전제는 저작권법리가 구성될 수 있는 요건의 명확화라고 할 것이다. 또한 데이터베이스가 보호돼야하는 당위성에 대한 명확한 이해 없이는 데이터베이스에 대한 보호의 논의자체가 부정될 수 있을 것이다. 즉 쉽게 말해서 데이터베이스를 왜 보호하는가에 대한 논의라고 하겠다. 정보산업의 기간이 되고, 인터넷 등 네트웍을 통한 전자상거래가 활성화되면 자연 유통되는 정보자체가 디지털콘텐츠 형태의 데이터베이스가 될 것이다. 각국의 정보산업에 대한 구체적인 수치를 제시할 수는 없지만, 그 중에서 데이터베이스가 차지하는 부분은 상당할 것으로 예견되기 때문이다. 특히 디지털콘텐츠 내지 데이터베이스는 정보산업에서 문화산업으로의 범주가 확대되고 있는 상황 하에서, 문화적 종속을 제어할 수 있는 법제도적 장치로서의 역할도 기대된다고 할 것이다. 이러한 복합적인 요인이 바로 데이터베이스의 보호에 대한 문제 제기와 필요성이다. 더욱이 데이터베이스는 많은 경우 구성하는 콘텐츠의 선택과 결합하는 데 있어서 기술, 노력 및 경험 등이 요구되고, 기술 등의 발전으로 비용 등의 지불 없이 복제가 가능하기 때문에 법적인 보호 등이 요구된다.

콘텐츠가 디지털화 되고 네트워크화 되면서 저작권 보호에 관한 문제가 중요해 지고 있다. 디지털 장치를 소유하고 네트워크에 연결이 가능한 사람들은 네트워크 상에 있는 디지털 콘텐츠를 적은 노력과 비용으로 보다 쉽게 접근하고 내려받고 복제할 수 있게 되었다. 반면 저작권법은 저작권자에게 콘텐츠에 대한 모든 권한을 인정하고 있다. DRM 기술에 대해 일반적으로 논한다면, 대체로 공격자가 똑똑해질수록 기술은 복잡해지고 무거워진다. 즉, 디지털 콘텐츠를 보호하기 위한비용이 증가하는 것을 의미한다. 따라서 콘텐츠 보호는 대규모의 블록버스트(blockbuster) 영화, 중요한 서류에만 적용되는 것이 바람직하다고 생각하기도 한다. 이러한 상황은 특정한 경우에 가장 적합한 보호의 수준을 결정하기 어렵게 만든다. 따라서 체계적이고 실용적이면서 디지털 콘텐츠 가치 사슬에서의 가치 평가, 위험성 평가를 위해 콘텐츠 공학적인 관점을 도입하는 것이 필요하다.

The research investigated definition, scope and feature of digital contents in order to discuss legal protection of digital contents. The protection law and current trend of protection of digital contents in United States of America, EU and Japan were examined. As the law which protects digital contents in Korea. the contents and characteristics, etc. of copyright act of Korea and online digital contents industry development act were examined and analyzed. And then relationship of digital contents and copyright, namely, the relationship of database and copyright, relationship of digital contents by translation. arrangement, alteration, dramatization, cinematization, etc. of an original work and copyright; relationship of other digital contents and copyright; relationship of file sharing of digital contents and copyright, were examined and copyright issues were discussed in library. And also the research suggested concretely necessary countermeasure of copyright which the library must take. Finally, this paper suggested the improvement direction for legal protection of digital contents we must aim ultimately.

자본과 노력의 결실로 이뤄진 온라인데이터베이스의 정당한 가치를 보호하기 위해 우리나라는 저작권법, 컴퓨터프로그램보호법, 온라인 디지털콘텐츠산업발전법 등의 관련법을 제ㆍ개정해 이에 적극적으로 대처하고 있다. 구체적으로 데이터베이스의 보호를 강화하기 위해 2003년에 저작권법을 개정했다. 이것은 저작권법이 그만큼 빠르게 변화하는 추세에 적응하기 위한 노력이라고 평가할 수 있다. 아울러 컴퓨터프로그램보호법과 온라인디지털콘텐츠산업발전법을 제정해 시행하고 있다. 이에 이번호에는 온라인데이터베이스를 보호하는 저작권법, 컴퓨터프로그램보호법의 주요내용을 살펴보고 법적 문제를 다루고자 한다.

The copyright law only protects the creative representation of works because it conditionally requires a creativity aspect of works. Due to the lack of protection regime in existing laws and the systems, the online digital contents industrial development act has been enacted to alternatively protect the digital contents providers based on a principle of preventive of illegal competition.

After entering the 4th Industrial Revolution, the digital content market, which was only dependent on existing contents supply enterprises, is providing various digital content through the participation of users like YouTube. Accordingly, it activated the digital content market, but it causes a negative influence on the digital content market due to the copyright of the creator and the indiscriminate illegal use and usage of the content. This study researched digital content management technology based on blockchain technology to protect digital content and the copyright of the creator. The suggested technology protects the digital content and the copyright holder and discerns the users and prevents the indiscriminate approach and illegal use of digital content. For the safe management of digital content, hash function applied as the certification technology of blockchain is used to certify the users and manage the digital content and provide integrity and authentication service.
