월간 <디지털콘텐츠>와 한국콘텐츠산업연합회는 '건강한 DC 유통환경 조성캠페인'의 일환으로 DC기업들이 경영일선에서 부딪히는 다양한 저작권 관련 사례들을 소개합니다.이번 호에서는 VOD 동영상 콘텐트 제작물에 관한 저작권의 권리 범위와 저작권이 침해당할 경우 이에 대한 법적인 대응방법에 대해서 살펴 봅니다.

The rapidly increasing use of the Internet and advancement of the communication network, the explosive growth of digital contents from personal home pages to professional information service the emerging file exchange service and the development of hacking techniques . these are some of the trends contributing to the spread of illegal reproduction and distribution of digital contents, thus threatening the exclusive copyrights of the creative works that should be legally protected Accordingly, there is urgent need for a digital copyright management system designed to provide centralized management while playing the role of bridge between the copyright owners and users for smooth trading of the rights to digital contents, reliable billing, security measures, and monitoring of illegal use. Therefore, in this study, I examined the requirements of laws and systems for the introduction of the centralized management system to support smooth distribution of digital contents, and also researched on the current status of domestic and international centralized management system for copyrights. Furthermore, 1 tried to provide basic materials for the standardization of digital contents copyright management information through the examination of the essential elements of the centralized digital contents management such as the system for unique identification the standardization for data elements, and the digital rights management (DHM) .

Various types of protection technologies have been developed for protecting copyrights of digital content and such technologies for protecting the digital broadcasting content as CAS, DRM have been introduced to the broadcasting industry. However, current rapid development of digital home network systems lets customers share digital content among home appliances, leading to the increasing needs for achieving interoperability among content protection technologies. This paper investigates previous research on interoperability among heterogeneous rights control informations by using MPEG-21 REL and then introduces a new approach to guarantee interoperability of rights control information.

인터넷의 확산과 더불어 디지털 컨텐츠의 유통도 확산되었다. 그러나 디지털 컨텐츠들은 쉽게 원본과 똑같은 품질로 복제할 수 있으며, 인터넷을 통해 빠르게 이동이 가능하고 사용자들은 얼마든지 불법으로 이용할 수 있다는 것이다. 최근 국내·외에서 이러한 문제를 해결하기 위해 디지털 컨텐츠들을 보호하고 관리할 수 있는 DRM 기술이 활발히 연구 중이다. DRM 기술은 암호화 기술을 이용하여 허가되지 않은 사용자로부터 디지털 콘텐츠를 안전하게 보호하고 디지털 컨텐츠 저작권 관련 당사자의 권리 및 이익을 지속적으로 보호 및 관리 할 수 있는 기술이다. 본 논문에서는 저작권 보호를 위해 안전한 DRM 메커니즘을 제안한다.

MPEG-21 is an open standard framework for creation, delivery and consumption of digital content in interoperable and rights-managed and protected way. Focusing on DRM technologies, this paper covers with concept and ongoing activities of MPEG-21's parts - Digital Item Declaration which is the base unit of trade and delivery, Digital Item Identification, Intellectual Property Management & Protection, Rights Data Dictionary, Rights Expression Language, Persistent Association Technology, Event Reporting, and so on.

Based upon the provision of limitation of copyrights, libraries may provide the document delivery service which supplies copies of journal articles and book chapters owned at other libraries by request of users. However, more proactive information service is required as more users want to use the digital delivery of documents published overseas. This study reviews copyright law of Korea and international conventions related to the document delivery service. It then examines foreign cases to see how overseas information centers clear copyrights. Finally this study suggests that copyright clearance methods be adopted to make a proactive information service. Through those methods, a new information service model may be planned, which meets various information needs while protecting copyright.

디지털방송, 특히 HD급 디지털방송이 본격적으로 시작되면 미디어 보호가 심각하고도 시급한 문제로 대두될 것이다. 고화질의 비디오와 뛰어난 품질의 오디오를 근간으로 하는 HD급 미디어를 무단복제해서 배포할 경우 미디어 제작자들이 양질의 미디어 제공을 꺼리게 될 것이고, 이것이 시청자의 피해가 돌아갈 것이라는 주장이 설득력을 얻어가고 있다. 한편 저작권보호 기술이 소비자의 권리를 침해하고 오히려 저작권 보호 기술의 발전을 저해한다는 의견도 있다. 그래도 저작권보호 기술이 많이 진보했지만 아직 그 기술들이 쓸만하다고 보여지지는 않는다.(중략)

정보통신부는 컴퓨터프로그램저작물의 저작권자의 권리를 보호하고 프로그램의 공정한 이용을 도모하기 위하여 각종 프로그램관련산업 육성시책의 일환으로, 프로그램 저작권에 관한 사항을 심의하고 프로그램저작권에 관한 분쟁을 조정하기 위한 분쟁조정기관인 (재)한국컴퓨터프로그램보호회를 설립, '95년 1월 1일부터 운영하고 있다. 이에 신청절차, 분쟁조정절차 등 이 제도를 소개토록한다.

최근 세계 각국은 새로운 저작물 이용환경에 대응하기 위해 법 제도적인 방안을 강구하고 있으며 새로운 대안으로 저작권 정보관리시스템을 제시하고 있다. 저작권 정보관리시스템은 저작물의 내용, 권리자의 소재, 이용 조건 등 저작물의 이용에 필요한 각종 정보를 종합적으로 관리 제공함으로 저작물의 보호 및 이용에 편의성을 제공하고, 더 나아가 실제로 시스템상에서 저작물의 거래까지 지원하는 시스템이다.

무선 인터넷이 활성화되면서 다양한 형태의 무선 컨텐츠가 상용화되고 있으며, 이와 동시에 불법적인 컨텐츠의 유통이 성행하게 되어 컨텐츠 보안을 위한 디지털 저작권 관리(DRM: Digital Rights Management)시스템이 요구되고 있다. 본 논문에서는 무선 인터넷 환경에서 유통되는 디지털 컨텐츠의 저작권 보호를 위한 모바일 보안 시스템을 제안하였다. 특히, 본 시스템에서 단말의 처리 능력을 고려하여 컨텐츠 부분 암호화 기법을 적용하여 신속한 복호화 수행이 가능하도록 설계하였다. 본 시스템을 적용할 경우 컨텐츠의 권리보호는 물론이며, 제한적인 모바일 디바이스에서 기존보다 신속한 수행이 가능해지는 효과를 기대할 수 있다.
