특허제도는 "발명을 보호하고 그 이용을 도모함으로 기술발전을 촉진하여 산업발전에 이바지함을 목적"<특허법 1조1항)으로 한다. 따라서 신기술을 발명한 사람은 배타적인 재산권이 부여되고 그러한 기술이 공개됨으로 인해서 공공의 산업이 발전된다는데 특허제도의 의미가 있다. 더불어 해당기술에 대한 중복 투자 및 연구를 방지해 불필요한 낭비를 없앤다는 효과도 있으나 이런 측면은 장점과 단점이 공존한다고 할 수 있다. 이러한 특허제도의 목적 및 효과를 잘 이용해 지적재산권 및 기술을 보호하고 나아가 개발된 기술을 적절히 이용해 좀더 발전지향적인 사회를 이루는 것이 현대 산업사회를 살아가는 기업과 개인의 필수적인 요건중의 하나이다. 이에 선진국의 특허제도 이용을 살펴봄으로써 기업과 개인의 특허의식 고취에 작은 도움이 되고자 한다.

사이버스페이스에 음란물이 홍수처럼 밀려들면서 전통적인 법과 규제의 한계를 드러내고 있다. 인터넷을 통한 O양과 B양의 비디오 파문은 이를 단적으로 보여주는 사건이다. 사이버스페이스에서의 이러한 음란물은 법적으로 윤리적으로 보호할 가치가 없으므로 마땅히 규제의 대상이라는 주장과 이것 역시 보호돼야 하는 표현의 자유라는 일부의 주장을 어떻게 조화롭게 대처할 것인가는 21세기 사이버스페이스 시대가 해결해야 할 새로운 문제로 부각되고 있다. 자유와 책임이 동전의 양면관계로 대립하는 음란한 표현은 사이버스페이스에서도 선악의 한계로 서로 밀고 당기면서 오늘에 이르고 있다. 이런 음란의 문제를 관련 법과 판례를 중심으로 고찰하면서 새로운 사이버스페이스에서의 대책과 합리적 체계는 무엇인가를 살펴보자.

The distribution model of multimedia content is proposed, This solves the problems which are occurred by various multimedia content and the complex distribution structure. The online distribution processes in wireless environments contain many different, companent from the of offline and wire networks. The multimedia content can be very easily propagated illegally. Under these environments the seneme to protect the copyrights of multimedia content and rights of distribution entities is needed. In this paper a distribution framework of content in wireless environment based on MPFG-21 framework if proposed. This model can be adapted to DRM(digital rights management) and utilized to protect the rights of distribution entities.

Digitalized multimedia contents is changing active digital contents in form passed from manufacturer directly to consumer though digital network of high speed, also face with big problem that is protection of rights to protect digital contents, to protect those and effort to active digital contents process height. Also, in situation that require change to more efficient system, the efficiency of rights document that is basic intermediate to be used in business of digital contents field is emphasized. Therefore, the design of common business model to share contents that have same purpose without depending on specific system to offer contents with another system is required. This paper designed adaptable rights business model to general digital contents, and designed and implemented rights document editing system to editable document for Right management according to designed business model.

This study has developed a preventive launcher from smartphone addiction for the digital generation and the contents recommendation based on machine learning which used multiple and collective intelligence. This could provide convenient digital nurturing experience for the parents who fear their children's over use of digital devices and also suggest individually adaptive digital learning methods that enhance the learning efficiency and pleasurable and safe learning environment for the children. Suggested application is a kind of gamification launcher that protects children from harmful contents and from smartphone addiction with time limit settings. For parents who find difficulty choosing from various kinds of contents and applications for education, this suggested system could provide a learning analytic report based on big data after collecting and analyzing the data of their children's learning and activities and recommend contents necessary for their kids using recommended algorithm by collective intelligence.

새로운 패러다임은 소유에서 접근으로 변모하고 있으며, IT분야에서는 특히 소유보다는 접근과 아웃소싱이라는 새로운경영 패러다임이 형성되고 있다. ASP(Application Service Provider)는 소프트웨어의 구입보다는소프트웨어의 사용권을 취득하고 이를 네트워크를 통해 서비스하는 비지니스 모델이 도입되고 있다. 즉, 일종의 소프트웨어 임대사업이라고 할 수 있는 ASP는 기본적으로 패키지 프로그램을 구입하는 것보다 저렴하게 사용할 수 있는 장점이 있다.

대부분의 인터넷 사이트들은 회원 등록시 상세한 개인 정보 기재를 요구하고 있다. 문제는 거기에 있다. 보안이 완벽하다 해도 사이트관리자의 모럴헤저드(도덕적 해이)에 의한 유출은 어떠한 방법으로든 막을 길이 없다는 것이다. 때문에 인터넷 사용자들은 웬만하면 회원 등록을 하지 않거나 거짓으로 기재하는 경우가 많다. 따라서 자사의 회원 정보가 모두 알짜배기라는 것을 믿는 회사는 그리 많지 않다.

영상물의 연령등급을 심의하는 영상물등급위원회(영등위)에 온라인게임이 연신 두들겨 맞고 있다. 관련업계는‘중세 마녀 재판이 재현되고 있다’고 강하게 비판하고 있고, 영등위는‘청소년보호’를 대의명분으로 내세우며 눈도 깜짝 안하고 있다. 대표적인‘메이드 인 코리아’상품으로 우뚝서야 할 때 빨간불이 켜진 것이다. 영등위 파문과 관련된 양측의 의견을 들어 보고, 온라인게임 등급분류제도의 문제점은 없는지 짚어봤다.
