Legal Deposit and Preservation of Digital Materials in Various Countries (디지털자료의 납본과 보존을 위한 각 국가의 노력)

  • Legal deposit system is an essential tool for a national library to ensure the preservation and access to a nation's intellectual heritage over time. Substantial amounts of digital materials of national cultural value are already being published. There is a global trend towards extending legal deposit to cover digital materials in order to maintain comprehensive national archives. This paper gives a progress report of some countries around the world whose legal deposit laws have already updated or are under revision. Some strategies are suggested for the digital collection building of the Korean National Digital Library which will open in 2008.

  • This study empirically analyzed the recognition and current status of university libraries related to the legal deposit of thesis and dissertation and investigated the ways to activate legal deposit to National Assembly Library. As a result, most universities conduct legal deposit of thesis and dissertation. However, most librarians face difficulties resulted from the duplication of deposits to many institutions. In the case that the deposits are not made, the main reasons are the university library's policies, duplication and inefficiency of the deposit procedures, and the limitation of obtaining copyright agreements. In order to address these limitations and to maximize the social and informational values of thesis and dissertation, this research proposed approaches to legal deposit of thesis and dissertation, including strengthening digital deposit system through the establishment of independent legal deposit law, preparing the effective ways of preservation. constructing an integrated deposit system, and developing professional collection of thesis and dissertation which can consolidate National Assembly Library.

Suggesting the Reasonable Legal Deposit Operating Plan through Analyzing the Legal Deposit Process of National Libraries of the World (국내외 국가도서관 납본절차 분석을 통한 납본업무의 합리적 운영방안 도출)

  • All publications of a country is a cultural heritage with the spirit of humanity, each National Library has to collect and preserve all publications produced in each country. Acquisition activity(Collection development) of each National Library is supported by a powerful legal deposit system. Therefore, this study has analyzed the legal deposit systems of the world countries, especially focussed whether or not the compensation for legal deposit, whether or not any sanction against not-depositing, Fine collection procedures against not-depositing, and the specific process for legal deposit. Based on these investigations, this study was to seek ways to contribute the legal deposit rates of National Library. It has proposed the following suggestions; Performing of legal deposit duty by itself, developing the system for supporting the legal deposit, establishing newly of legal deposit department, and improving the compensation for the legal depositor.

Comparative Analysis of Laws and Regulations for Legal Deposit in Major Countries (주요국의 법정납본 법규 비교 연구)

  • The legal deposit is a comprehensive and systemic method for acquiring a country's publications. This study aims to compare laws and regulations about legal deposit among several countries that have different histories and traditions and to supplement laws and regulations of Korea's legal deposit. To do this, research papers and laws, regulations, guides, web sites and online systems about legal deposit of eight countries including USA, United Kingdom, Canada, Australia, France, Japan, Singapore, and Korea were reviewed. This study tried to compare and analyse several categories including publications to be deposited or not deposited, requirements, due dates, expenses, and numbers of copies for deposit, and penalty for noncompliance with legal deposit. Also, online publications to be deposited or not deposited, requirements and methods for deposit were compared and analysed. At last, some suggestions were also made for improvement in laws and regulations of in Korea.

  • The research aims to propose improvement to legal theses deposit system in S. Korea by conducting comparative analysis of legal theses deposit systems in eight other countries including the US, the UK, Canada, Australia, France, Taiwan, Japan and S. Korea. The research used documentary research method including literature review by collecting and analyzing the legal regulations, ordinances, practical processes, and guidelines related to thesis submissions at national libraries and academic institutional depositories, as well as practical cases of thesis submissions at major universities in each country. Based on the analysis results, the key issues are identified and discussed, and corresponding suggestions for solving the issues are presented. For the improvement of the legal theses deposits systems, the research recommends legal amendments to the Library Law and Higher Education Law. On the practical side, the research proposes strengthening the legal foundation for KERIS, in collecting and providing theses, improving the operation of the dCollection system, and proposing a submission method focused on electronic theses.

A Study of the Strengthening Legal Deposit Collection of the National Library of Korea (국립중앙도서관 납본수집력 강화방안 연구)

  • The legal deposit for the national library in all countries is the most important mean for acquiring the country's off-line and on-line publications. Because of many limitations of legal deposit system, however, the National Library of Korea does not properly collect the useful materials produced or manufactured in Korea. In order to solve this problem, the author analyzed the status of collection development by legal deposit and estimated the total amount of domestic publications. Based on the these results, author suggested five plans for strengthening the national collections in terms of the provisional 'deposit law', the further development and complementary of current legal deposit regulations (guidelines and standards), desirable amendments of the legal deposit provisions in library act, reasonable division of the deposit targets, and optimization strategies of acquisition scope by material types.

  • Legal deposit is a system that a person who publishes in the country a work shall deposit a certain copies of publications in designated libraries or institutions in order to preserve and transfer national knowledge and culture heritage. Under "Libraries Act" and "National Assembly Library Act", depositors shall present books to the Library and the Library shall properly compensate him/her for such copies presented. This study focuses on presentation and proper compensation of books. This study has reviewed laws and regulations about them in major countries and our country, and analyzed the current status and some problems of our country. This study has analyzed the constitutionality of legal deposit, the refusal of copies presented, and the meaning of proper compensation through analyzing cases on legal deposit. Based on these analyses, it has proposed the modification of regulations on presentation and proper compensation of books, the establishment of specific rules on proper compensation, and the penalties on unfair presentation.

  • Legal deposit system is an important legal instrument for national libraries. But the law or act based on print materials in many countries predates the current information age and requires a new legal framework in order to encompass electronic publications. Many national libraries, therefore, are seeking to encourage their governments to establish legal deposit for publications in the whole range of formats. The purpose of this paper is to analyse a world-wide trends of the legal deposit system for on-line publications as well as off-line materials. The result of this analysis will be used to develop a new model of legal deposit system in Korea.

  • The purpose of this study is to suggest guidelines for legal deposit process on online digital materials and use of the deposited materials both in National Digital Libraries and other places. At present, two Acts -- 'Act on Legal Deposit Process and Use of Online Digital Materials, ' 'Act on Partially Revised Library Law' -- are still pending in National Assembly. For the establishment of the guidelines in this study, advanced countries' legal deposit Acts in this area are searched and investigated. Also, in order to present various opinions from many parties immediately interested in the guidelines and Acts, survey, visitation, and consultancy methods are used.

  • The National Library of Korea recently proposed a draft of an Act on Legal Deposit and Use for the Online Digital Products and researches about deposit system and remuneration of the digital products are in progress. Based on the law of library and copyright, remuneration of deposit and use products is paid. A draft of a proposed law include information about the remuneration payment. For these reasons, the method for efficient remuneration management is required. In this paper, we propose effective remuneration management system which follows a draft of an Act on Legal Deposit and Use for the Online Digital Products.
