기업부패 과정에 대한 시스템다이내믹스 접근:퍼컬레이션 모형을 중심으로

  • 본 연구에서는 기업 부패를 인과론적인 시각에서 벗어나, 총체적이고 시스템적인 관점에서 고찰하였다. 특히 기업 부패가 기업 환경 전반에 시스템적으로 만연하여 제도화되어가는 과정을 시스템다이내믹스를 통해서 탐구하였다. 기업 부패 과정에 대한 시스템다이내믹스 모형은 주인과 대리인의 양자관계에서 나타날 수 있는 부패 전이와 통제의 복합적 역학관계를 중심으로 구성되었고, 확산 과정을 설명하기 위해서 퍼컬레이션 규칙을 도입하였다. 그리고 양자관계에 의한 시스템다이내믹스 모형을 격자구조로 확장하여 퍼컬레이션 과정을 모형화하였다. 본 연구모형의 시뮬레이션 결과를 통하여 첫째, 시스템적으로 만연되어 있는 부패의 형성 및 발전과정을 다이내믹스로 나타내고, 둘째, 이러한 부패 과정의 다이내믹스를 통해서 기업 부패 과정을 4가지 구조적 유형으로 설명하며, 셋째, 부패는 제도화를 통해서 다시 미인식의 영역으로 순환하게 되면서 사회전반적인 불신으로 정착하게 됨을 설명함으로써, 기업 부패 과정에 대한 이론적 함의뿐만 아니라 정책적인 시사점을 도출하였다.

부패라운드와 부패에 대한 한국 기업인의 인지도 조사

  • 국제적으로 국가간의 거래가 활발해지고 자본이동이 자유화되면서 부패문제는 더 이상 특정지역의 문제로 국한되지 않고 국제적으로 큰 파급효과를 야기하고 있다. 세계 각국은 부패로 인한 윤리적.경제적 폐해를 방지하기 위해 OECD 부패방지협약이라는 국제규칙을 마련하였다. 본 연구에서는 부패방지협약의 구체적인 내용과 후속 및 이행조치를 검토하고, 한국 기업인들의 부패인지도 조사를 통해 이러한 국제적 상황에 대처하고 기업부문에서 부패를 척결할 수 있는 방향을 제시하였다. 조사결과 한국 기업인들은 부패라운드에 대하여 거의 인식하지 못하고 있었으며 그에 대한 대응조차도 이루어지고 있지 않았다. 기업문화 역시 부패가 발생할 가능성을 내포하고 있어 기업인의 의식 전환이 필요하였다. 그러나 문화의 인위적 변화 가능성은 의문의 여지로 남는다.

A Comparative Study on the Foreign Corrupt Practices Act (FCPA) and Article 21.6 of the KORUS FTA (미국 해외부패방지법(FCPA)과 한미 FTA 제 21.6 조 비교연구)

  • Numerous discussions on the KORUS FTA has been centered around issues on trade in goods, services, or dispute settlement mechanisms. On the other hand, little attention has been given to Chpater 21 of the KORUS FTA on transparency, especially Article 21.6 which states about anti-corruption. Article 21.6 and the Foreign Corrupt Practices Act shares the common purpose to prevent corruptive business practice, and they show similarities in many aspects. The FCPA enforcement has dramatically increased over the past ten years by the U.S. Department of Justice and Securities Exchange Commission stretching its jurisdiction to foreign nationals and companies. Korean business professionals and corporations are exposed to both Article 21.6 and the FCPA on corruption issues. Thus, it is imperative to understand Article 21.6 to be equipped with anti-corruption compliance programs. This paper examines the FCPA and Article 21.6 through comparative analysis and proposes appropriate measures for Korea to take.

Analysis of Determinants on the Entry Modes of Multinational Firms: Focused on the Effects of Corruption and Political Instability (해외진출 기업 유형의 결정요인 분석: 부패와 정치적 위험 영향을 중심으로)

  • This paper aims to analyze the effects of external uncertainty on the entry modes decision of multinational firms. On the basic assumption that the entry modes of the firms are dependent on ex-ante or ex-post perceived risk, we empirically analyzed the impacts of perceived risk factors on the investment patterns of firms. We found that the larger the population, the higher the level of GDP per capita, and the larger the trade volume as a ratio of GDP resulted in increased M&A FDI and greenfield FDI. The economic growth rate variables were found to be significantly positive effect on only greenfield entry mode. Regarding the main variables, lower levels of corruption and increased stability regarding political issues resulted in the host country receiving increased M&A investment. However, we found only a positive statistical significance of the political stability variable on the explaining greenfield FDI. Results show that M&A entry mode is affected by both corruption and political instability level. However, the greenfield FDI featuring sunk costs, seems more responsive to political instability.

  • This study explores the process of corporate corruption via a percolation-based system dynamics model. The preliminary model is an agent-based model constructed in the terms of the corruption networking between ego and other. In the model, the agents behave depending on percolation rules, which represent (1) passing on the corruption opportunities and (2) accepting it. To describe the percolation process in the networks, we develop a further complicated model by combining the basic model with the Bethe lattice. Through the complicated model, we suggest (1) the dynamics of the systemic corporate corruption, (2) 4 patterns of the corruption, and (3) the institutionalization of the corruption. These simulation results provide theoretical and practical implications.

  • We study the relationship between the closedness of public service recruitment system and the corruption rampant between private firms and public servants. Empirically we test our claim that the closedness of public service recruitment system tends to heighten the corruption level of each country. Our results show that the closedness is positively correlated with bureaucracy corruption levels indexed by IMD, WEF, and World Bank.

Exploring on 'Go Global' Barriers of Chinese Inner Mongolia Cashmere POEs (중국 내몽고 캐시미어 민영기업의 해외시장 진출 장벽에 관한 탐색적 연구)

  • This study explores the barrier factors of Chinese private-owned enterprises in overseas expansion in terms of corruption, political risk, market fluctuation, cultural difference, and firms resource endowments. To explore the existing practical backgrounds, it was investigated to private-owned enterprises dealing with foreign export companies where run business in Hohhot, Baotou and Ordos, Inner Mongolia, China. The result shows that the corruption and political risks of host countries do not have significant influence on business performance in 'Go global' strategy, while the market fluctuation of host countries has a negative effect on business performance. Cultural difference has a negative effect on business performance, and enterprises' resource endowments have a positive effect on business performance in 'Go global' strategy. Additionally, interviewees provide several substantial suggestions regarding the government policy and industry ecosystem to surmount the barriers of POEs' going global. Lastly, the authors discuss managerial implications and provide several suggestions for the future studies.

  • The Korea-EU FTA has substantially escalated the volumes of South Korea's export and investment in the United Kingdom since its ratification. Coupling with the FTA effect, the ease of doing business in the United Kingdom will increase even more trade and investment by South Korean multinational corporations. In the meantime, the UK Bribery Act 2010 was enforced to end bribery by individuals and business entities which have close connection with the United Kingdom. The punishment of violating the Act is severe than ever because of "unlimited" fine. Without fully understanding the Act and have compliance measures as described in the Guidance issued by the UK Ministry of Justice, South Korean corporations may risk its whole business. Therefore, this paper will analyze the UK Bribery Act in details to provide critical implications for South Korean corporations under the Korea-EU FTA.

  • 일각에서 우리 경제현실을 감안하지 않은 재벌에 대한 과도한 규제 및 이로 인한 외국기업과의 역차별성을 강조하는 반론도 만만치 않았던 것이 사실이나, 무엇보다도 간과할수 없는 것은 이러한 재벌규제의 논리는 자본주의 경제의 부패를 방지하기 위한 불가피한 선택으로서, 결코 재벌기업에 대한 자유의 구속이 아니라 오히려 그 동안 자유방임에 의한 구속으로부터의 모든 경제주체의 경제적 자유와 자율성 보장을 위한 것이며, 장기적으로 우리 경제의 체질을 강화하는데 기여하게 될 것이라는 점이다.
