The purpose of this study is to examine the appropriateness of Regulatory Impact Analysis(RIA) in terms of the technological regulation impact assessment in order to confirm whether the current RIA process reflects the important characteristics of technological regulation. This paper develops a logical framework for analysis of technological regulation and evaluates the appropriateness of the RIA statements submitted by the government departments. From the viewpoint of [technological feasibility of regulation], [synthesis of domestic technological norms], [synthesis of international technological norms], as a result of evaluating the contents of the actual RIA statement on the basis of objective facts, feasibility of alternative analysis, and expert judgment, only 23.4% of the RIA statements were judged "appropriate", and there were no particular differences among the government. As a result of reviewing the appropriateness of RIA statements according to regulatory attributes, the appropriateness of RIA statements on technological regulation with social regulatory and indirect regulatory attributes was rather high. In sum, the level of Korean RIA statements is insufficient to carry out the practical meaning of technological regulation impact assessment. That is, as each government department adopts technological regulation, the understanding of the technological properties of the regulation may not be complete. The RIA statement that does not adequately reflect the technological rationale, hinders the careful review of other regulatory alternatives by exaggerating the feasibility of the technology regulation, at the same time leads to the serious problems that impede the acquisition of competitiveness of companies and the public in the global competition system.

본 논문은 규제정책의 관점에서 전기통신분야 기술기준규제의 성격을 규명하기 위하여 우선 정부규제론에서 논의되고 있는 경제적 규제와 사회적 규제에 대한 논의를 검토하고 이러한 논의를 바탕으로 현재 정부 규제로서의 기술기준의 성격과 그 함의를 도출하여 전기통신분야 기술기준규제의 바람직한 정립 방향을 모색코자 한다.

This paper attempts to explore the impact of technological regulation on technological innovation and performance of Small and Medium Enterprises(SMEs) by analysing a survey data of 286 Korean SMEs. The 3-step mediated regression analysis results reveal that the perceived regulatory burden is negatively associated with SMEs' R&D investment and innovation of product and process. Moreover, the level of regulatory burden may affect the objective and subjective performance of SMEs. The results suggest that regulatory policies for reducing regulatory burden need to be designed and implemented in order to enhance technological innovation and performance of SMEs.

국내·외 안전규제기술요건의 현황 및 기술현황 분석 평가 결과를 토대로 안전목표, 안전원칙, 일반안전요건, 상세기술요건, 안전규제지침 및 안전심사지침 등으로 구성된 안전규제기술요건 체계가 구축되었으며, 궁극적인 안전의 지향목표로 부터 구체적인 안전규제방법론에 이르는 일련의 계층을 제시하고있다. 각 계층별 체계설정의 개념, 방법론 및 상세체계도 구성과 이들 구성항목들에 대한주요요점 및 참조 국내·외 규제요건 등이 도출되었으며, 이들은 구체적인 안전규제기술요건의 단위요건 설정에 기본방향을 제공하게 될 것이다. 또한, 안전규제기술요건의 실제적인 설정에 필요한 추진 전략 및 방법을 개략적으로 제시하고 있다. 특히 개발될 안전규제기술요건의 규제위상 정립 및 유관기관의 의견수렴 방안등은 신중히 고려되어야 할 것이며, 산업기준과의 연계방안은 국내에서 개발하고있는 산업기준의 위상을 정립할 수 있는 좋은 계기가 될 것이다.

This paper aims to review the regulations in the field of science and technology administration, especially the legal regulations in the management of public technologies. For this purpose, after reviewing the legal system and contents of regulation, analyze and estimate the adequacy and validity of them. So that, in this paper it is layed emphasis on that whether the regulation system is proper in point of legalism or theory of regulation law, and the regulations are appropriate when comparing with that of foreign countries, and the improvement is necessary in operating regulation system itself.

4차 산업혁명 시대에는 산업간 경계를 뛰어넘는 혁신적 융합기술 기반 신산업 창출 및 성장동력 확보의 필요성이 제기되고 있으며, 이를 위해 관련 규제 개혁을 통한 창의적 기업활동 생태계 조성이 선행되어야 한다. 그동안 규제 개선을 위해 다양한 시책들이 추진되었으나 기술 발전의 속도를 따라잡지 못하고 있으며, 상대적으로 타 국가에 비해 과도한 규제로 인해 4차 산업혁명 대응에 있어 보다 혁신적인 변화가 요구된다. 이에 네거티브 규제 방식, 규제 샌드박스 등에 대한 검토를 통해 4차 산업혁명 시대에 적합한 규제 패러다임의 변화에 대해 분석하고자 한다.

기후변화 및 환경보호에 대한 관심이 커지면서 각국은 에너지절약, 탄소배출량 감축 및 환경보호 등을 명분으로 기술규제 도입을 확대하고 있다. 2011년도 전 세계 TBT(무역기술규제) 통보문 수가 1,101건에 달하는 가운데 에너지 환경 관련 기술 규제는 2004년 99건에서 2011년 200건으로 2배 이상 급증했다. WTO에 제출된 TBT 중 개도국 비중이 2004년 51.6%에서 2011년 81.2%까지 상승할 정도로 그 비중이 크게 높아졌다. 여기서는 에너지 및 환경 관련 전세계 규제동향을 조사하고 특히 올해 새롭게 시행 적용되는 각국별 환경 규제와 그 영향을 분석하여 우리 기업의 대응방안을 모색해 본다.

전통적으로 정보통신산업에서는 요금규제방식으로 최종 서비스 시장에 대해서는 보수율규제, 중간재 시장에 대해서는 공통원가 배분방식을 채용하는 것이 일반적 경향이었다. 그러나 최근 선진국에서는 전자의 시장에 대해서는 가격상한규제, 후자의 시장에 대해서는 장기증분 원가방식으로 옮겨가고 있다. 본 고에서는 이들 최종 서비스 가격에 대한 두 가지 규제방식과 접속료에 대한 두 가지 규제방식을 짝 짓기 하여 4개의 규제조합을 만들고, 각 규제조합이 정부의 규제목표에 어느 정도 기여하는지를 논의하고 우리 나라의 현실에 부합되는 규제조합을 제시하였다.

원자력산업계에서는 원전 계측제어계통의 디지털화를 위해 많은 노력을 기울이고 있으나, 원자력산업의 특수성인 시스템 안전성 확보에 필요한 소프트웨어 개발기준과 규제방법이 정립되지 못하고 있다. 뿐만 아니라 디지털 계측제어계통의 핵심 기반기술인 고신뢰도 소프트웨어 개발 방법론이 확립되지 못하여 소프트웨어 공통모드고장 문제, 정량적인 소프트웨어 신뢰도 보장 문제 등이 논란의 대상이 되고 있다. 이와 같이 원전 계측제어계통 디지털화 성공을 위해서는 소프트웨어 신뢰도 확보가 관건이며 고신뢰도 소프트웨어 확인 및 검증 기술 개발이 절실히 요구된다. 본 기술보고에서는 디지털 계측제어계통 소프트웨어에 대한 규제요건을 소프트웨어 신뢰도 보장을 위한 개발자, 사용자, 규제자 사이의 합의 기준측면에서 분석하였다. 또한 최근의 미국 원자력규제위원회의 디지털 계측제어계통 소프트웨어에 대한 규제방법과 규제동향을 살펴보았으며 마지막으로 고신뢰도 소프트웨어 개발과 확인 및 검증 방법, 규제 요건, 규제 방법 등에서 공통적으로 고려해야 할 기술적 측면의 현안과 이의 해결을 위한 연구 현황등을 파악하였다.
