SW사업의 고유특성에 따른 하도급 만연과 대 중소 SW기업간 하도급계약의 협상력 불균형 등으로 인한 불공정 하도급 거래관행이 지속되어 국내 SW사업의 다단계 위계화 하도급구조가 지속되고 있는 실정이다. 이로 인해 SW사업 결과에 악영향을 미치고 역량있는 중소 SW기업의 사업의지를 약화시켜 SW산업 발전을 저해할 수 있어, SW사업의 하도급관련 국내외 법제를 조사 분석하고 그 시사점을 도출하여 SW사업 주체간의 공정거래를 담보할 수 있는 SW사업 하도급관련 법제 인프라 개선방향을 제시한다.

연말부터 원도급 업체는 하도급 계약시 하도급 업체에게 15일 이내에 선급금을 지급해야 한다. 또 선급금 미지급이나 추가공사에 대한 비용 전가 등 하도급 업체에 대한 부당특약 유형이 확대되고 하도급업체에 대한 보호장치가 강화된다. 국무총리실은 국토해양부와 함께 이같은 내용의 '건설하도급 규제합리화 방안'을 마련, 관련 규제를 정비키로 했다. 정부는 건설산업법 개정안을 오는 10월 중 국회에 제출할 예정이다. 본지는 건설하도급 규제합리화 방안의 구체적인 내용에 대해 살펴본다.

공정거래위원회가 지난 해 12월 31일 건설업종 표준하도급계약서 개정을 공포하고 시행에 들어갔다. 개정된 건설업종 표준하도급계약서는 ${triangle}$부당특약 무효 ${triangle}$하도급대금지급보증제도 강화 ${triangle}$계약변경 시 하도급자의 권리 보호 강화 ${triangle}$선급금 사용제한 금지 등의 조항을 신설하고 ${triangle}$하도급자의 공사 중지 요청 권한과 계약해제 해지 요건 등의 확대 ${triangle}$하도급대금 지급 규정과 대물변제 금지 규정 등의 조항을 명확히 했다. 이러한 개정은 대한설비건설협회가 불공정 하도급 거래관행 개선과 회원사의 권익을 보호하기 위해 공정거래위원회에 건설공사 하도급계약에 사용되는 표준하도급계약서 개선을 지속적으로 건의한 결과 우리협회의 의견이 반영된 것이다.

공정거래위원회는 하도급거래에서 서면계약 문화와 공정한 하도급 거래질서의 조기정착을 위해 건설업 표준하도급계약서에 수급사업자의 계약이행 보증부담 경감조항(장기계속공사 연차별 계약 이행 완료 시 이행완료부분에 대한 계약이행보증금 반환)을 신설하는 등 '건설업종 표준하도급계약서'를 대폭 개정해 지난 1월 5일부터 시행에 들어갔다. 이번 표준하도급계약서 개정은 그동안 대한설비건설협회가 수차례 건의한 것으로 공정거래위원회가 의견수렴 및 협의를 거쳐 추진됐다. 공정거래위원회는 원사업자와 수급사업자간의 공정한 하도급거래 질서의 정착을 위해 하도급법 제3조의2에 따라 건설업 표준하도급계약서를 작성 보급하여 사용토록 권장하고 있다. 이 자료는 협회 홈페이지(www.kmcca.or.kr)의 <커뮤니티-협회내공유자료>에서 다운로드 받을 수 있다.

건설산업 참여주체 사이의 고질적 문제들을 해소하고 건설산업의 재도약을 지원하기 위해 지난 1년 동안 운영해 왔던 건설산업 공생발전위원회(이하 공생발전위원회)가 하도급대금 지급보증제도 개선 등 많은 성과를 남기고 지난 10월 19일 제7차 위원회를 끝으로 활동을 마무리했다. 정해돈 대한설비건설협회 회장은 공생발전위원회 위원으로 참여하며 설비건설업계의 애로사항을 역설하고 ${\bigtriangleup}$공공공사 저가하도급심사제도 개선 ${\bigtriangleup}$하도급공사대금의 지급실적 점검 및 부당특약유형 확대 ${\bigtriangleup}$하도급대금지급보증서 보증약관 개선 및 발급감독 강화 ${\bigtriangleup}$주계약자 공동도급 대상범위 확대 ${\bigtriangleup}$산업재해 은폐에 대한 제도개선 등을 건의한 결과 저가하도급심사제도, 하도급대금 지급보증제도 등의 제도가 개선되었다. 특히 저가하도급 심사제도와 하도급대금 지급보증제도 개선 성과는 그동안 건설협회가 강력히 반대했으나 정해돈 회장을 비롯한 제8대 집행부가 똘똘 뭉쳐 일궈낸 성과라 더욱 의의가 크다. 본지는 공생발전위원회의 지난 1년간 활동을 점검해 본다.

동적 시뮬레이터에서 정속주행(70km/h)과 급출발(0km/h$\longrightarrow$70km/h)및 급제동(70km/h$\longrightarrow$ 0km/h)에 따른 운전자의 심리생리적 반응을 알아보았다. 피험자는 운전경력이 1년 이상인 20대 남자 12명을 대상으로 하였다. 실험결과 주관적인 쾌적감은 급출발에서 가장 높았고 각성감은 정속주행에 비해 급출발과 급제동에서 높았다. 주행시 뇌파는 모든 조건에서 알파파가 안정 상태(정차)일 때보다 감소하였고 베타파는 증가하였다. 피부전기저항은 모든 주행 조건에서 정차에 비해 증가한 반면 피부온도는 낮아졌으며 조건간에는 급출발일 때 피부온도가 더욱 낮았고 피부전기저항은 더 높았다. 이러한 결과로부터 정차, 정속주행에 비해 급출발과 급제동 조건에서 주관적, 생리적 반응의 변화가 현저함을 알 수 있었다.

공정거래위원회가 하도급계약 추정제에 따른 통지나 회신 방법 규정, 기술재료의 정의 등을 골자로 하는 '하도급거래공정화에관한법률시행령' 개정안을 마련하고 지난 7월 26일부터 시행에 들어갔다. 하도급계약 추정제는 하도급거래에서 수급사업자를 보호하기 위해 수급사업자가 구두로 맺은 계약에 대해 확인을 요청할 때 원사업자가 15일 이내에 이를 부인하지 않으면 계약이 있었던 것으로 추정하는 제도이다. 공정위는 또 수급사업자가 원사업자에게 위탁을 받은 작업의 내용과 하도급대금, 위탁받은 일시, 원사업자와 수급사업자의 사업자명과 주소 그밖의 원사업자에게 위탁한 내용 등으로 정했다. 개정된 하도급법에는 원사업자가 수급사업자에게 기술자료를 제공하도록 강요하지 못하도록 기술자료의 범위도 정했다. 또한 상습적으로 법을 위반하는 사업자의 명단을 공개하는 기준도 마련됐다. 명단 공개 기준은 최근 3년간 벌점이 4점을 초과한 자로서, 사업자명과 대표자, 사업장 주소 공개와 함께 공정위 인터넷 홈페이지에 이를 게시할 때는 그 기간을 1년으로 했다. 이와 함께 입찰명세서와 낙찰자결정 품의서, 견적서, 현장설명서, 설계설명서 등 하도급대금결정 관련서류를 의무적으로 보존토록 하고 하도급대금 지급보증기관에 소방산업공제조합을 추가해 원사업자의 지급보증기관 선택 범위를 확대했다.

The purpose of this study was to examine whether the effect of feedback would mask the performance differences that would result from different incentive pay distribution. Five critical service behaviors were identified and measured daily at a gas station located in Seoul. Participants were 5 employees working at the gas station. Independent variables were the types of incentive distribution and feedback. After baseline (A), equally-distributed group incentive condition (B) was introduced, and individual incentive condition (C) was introduced in the next phase. Then, after the withdrawal condition (A'), equally-distributed group incentive with feedback condition (B') was introduced and finally, the individual incentive with feedback condition (C') was introduced. The results suggested that all employees showed higher work performance under individual incentive than equally-distributed group incentive system when feedback were not delivered. However, there was no difference in work performance between two incentive conditions in the phases in which feedback were delivered. These findings suggest that feedback can reduce performance differences between equally-distributed group incentives and individual incentives.

To execute a construction project, many construction participants are engaged in the project. Especially many subcontactors role is very important, but their contract statute seems weaker rather than prime contractor. So to protect the subcontractor and to activate fair subcontract, Fair Transactions in Subcontracting Act was enacted. Direct payment to subcontractor clause of the act can protect subcontractor from the fear of insolvency of prime contractor, on the other hand can cause dispute about the interpretation of defect liability. Therefore the positive act and regulation were examined, and the effects of direct payment to subcontractor were analyzed. And the treatment direction of direct payment were suggested in this paper. Summary is as follows; (1) Statute of subcontractor for the ordering subject must be considered (2) Contract relationship must be reflected in the performance bond, subcontract bond, and subcontract construction conditions (3) To clarify the defect liability for the direct payment, retainage to guarantee the repair during contract period may be reflect on the subcontract construction conditions.

The effects of high levels of vitamin E and cholesterol feeding on the lipid composition of the plasma lipoproteins were tested between 4 experimental groups. The concentrations of vitamin E and cholesterol in the plasma lipoproteins were significantly increased with the feedings. But the concentrations of cholesterol and various lipid fractions showed significant low levels on the vitamin E feeding group, which vitamin E was fed after the cholesterol diet. Vitamin E showed the hypocholesterolemic effect when it was fed after the high cholesterol containing diet. But, vitamin E was less effective to decrease the content of cholesterol on the diet which contained the both vitamin E and 2% cholesterol. It also showed that vitamin E could stimulate the absorption of cholesterol and lipid when the both dietary factors were simultaneously fed. The vitamin E feeding also resulted in increase of the cholesterol concentration in HDL/LDL ratios.
