This study was to examine the recognition and guarantee for psychiatric patients' rights of mental health care workers. The participants of this study were 231 mental health care workers from 10 mental health care institutions located in J city, Korea. Data was collected using questionnaires consisting of one instrument measuring participants' recognition and guarantee for psychiatric patients' rights, and participants' characteristics. Collected data were analyzed using descriptive analysis, t-test, one-way ANOVA with SPSS 12.0. The results of this study showed the mental healthcare workers' recognition and guarantee were significantly different in every subscales. Besides, the difference between recognition and guarantee toward psychiatric patients' rights was significantly associated with participants' occupations. Based on the findings, guiding where nursing education efforts should be focused to help putting in place the psychiatric patients' rights.

채권자대위권은 채권자가 자기의 채권을 보전하기 위하여 채무자에 속하는 권리를 행사할 수 있는 권리이다(민법제404조). 채무자의 권리는 채무자가 행사함이 원칙이나 채무자가 제3채무자에 대한 권리를 행사하지 아니함으로 채무자의 책임재산을 제대로 보전하지 않아 총채권자의 공동담보에 부족한 부분이 생길 때에는 채권자로 하여금 채무자의 권리를 행사하여 책임재산의 보전을 꾀할 수 있도록 할 필요가 있고, 이러한 목적을 위한 제도가 바로 채권자대위권제도이다. 그러나 채권자대위권제도는 채권자 취소권에 비해 상대적으로 주목받지 못하고 있는 것이 현실이다. 즉 실제와 현행민법 규정사이에 커다란 괴리가 존재하고 있고, 행사의 범위, 효과에 관한 규정을 두고 있지 않고 있다. 이는 전적으로 학설과 판례에 위임되어 있는 실정이므로 따라서 본 논문에서는 채권자대위권에 관한 문제점을 검토해보고, 정확한 명문규정이나 제도적 장치를 마련하는 제도의 취지 및 목적에 합당할 수 있도록 합리적인 방안을 제시하고자 한다.

In this study, collecting data in real retail-premium market and the influencing factors were extracted explored the formation of retail-premium. This should identify the level of retail-premium through an objective estimate of expenses, revenues, etc. A hierarchical regression analysis was conducted focusing on how the operating profit affected the formation of retail-premium. Store operators will have to be accompanied by the management of the operating profit to keep the initial payment and in order to receive a raise retail-premium. Through this process, It is possible to prevent the gap between retail-premium calculated through the appraisal and market practices. Ultimately, I believe and achieve the objective, transparent, the advancement of retail-premium market.

There has been a growing number of research about children's development indicators and child well-being indicators. After the Convention on the Rights of the Child (CRC) and concluding observations on the second report of Korea, the effort to monitor and measure children's rights and the use of child rights indicators has increased within policy and academic research. However, few indicators provide a realization of children's rights. The purpose of this paper was to analyze children's own perceptions of their rights and to develop a children's rights index to measure children's rights. In this study, a children's rights index was developed from 38 indicators categorized into nine components and four domains (survival rights, development rights, protection rights, and participation rights) to measure children's rights. Data were gathered from 17,000 elementary and middle school children and their parents in 16 cities. The survey revealed significant differences in the children's rights index by region and age group. There was also a correlation between the economic circumstances of both households and communities and the children's rights index. In the light of the findings, it is suggested that there is a need to increase public investment on children and to raise awareness of children's rights in order to improve children's rights and to decrease disparity.

미국정부는 공공정보의 상용화와 관련한 주도권을 적극적으로 민간기업에 이양함으로써 공공정보를 통한 고부가가치 창출에 성공을 거두고 있다. 미국 법률은 공공정보의 상용화를 보장하고 있으며, 이는 공법상 공공정보 관련 근거법은 존재하지만 실제로 공공정보의 상용화를 위해 필수적인 공공정보 활용 권리는 찾아보기 어려운 우리나라의 법률 실정과는 매우 대조적이다. 민간의 공공의 파트너십을 통한 공공정보의 상용화 모델은 정부 업무의 효율성 증진과 국민의 알권리 충족을 만족시키고, 참여 민주주의를 확대하고 경제적 측면에서도 큰 기대효과를 지니고 있다.

본 고는 국내에 적용할 수 있는 기술등급평가모델을 제시하고 이에 입각하여 이루어진 실제의 평가결과를 제시하였다 이 평가는 중소기업청에 의해 전국규모로 1998년과 1999년 두해에 이루어졌다. 등급평가는 기술의 권리적 측면 환경적측면 등 세가지항목으로 구성된 평점모델을 제시하였다. 이평가결과는 변별력이 약해 평가요소와 실제 경쟁력간의 인과관계등에 대한 보다 집중적인 연구가 필요함을 보여준다.

최근 세계 각국은 새로운 저작물 이용환경에 대응하기 위해 법 제도적인 방안을 강구하고 있으며 새로운 대안으로 저작권 정보관리시스템을 제시하고 있다. 저작권 정보관리시스템은 저작물의 내용, 권리자의 소재, 이용 조건 등 저작물의 이용에 필요한 각종 정보를 종합적으로 관리 제공함으로 저작물의 보호 및 이용에 편의성을 제공하고, 더 나아가 실제로 시스템상에서 저작물의 거래까지 지원하는 시스템이다.

Objective: The purpose of this study is to provide practical data to effectively implement day care that respects the rights of infants in day care centers by investigating the relationship between private day care center teachers' empowerment, job satisfaction, infant's right respect care, and examining the influence of empowerment and job satisfaction of private day care center teachers on Infant's right respect care. Methods: The 228 day care teachers who work in private daycare centers located in Seoul and Gyeonggi province were the investigated subjects. For the analysis of questionnaire, frequency, percentage, reliability, t-test, ANOVA, correlation, and regression were used as SPSSWIN 20.0 program. Results: First, the difference of empowerment according to the individual variables of teachers was different to career, monthly salary, marital status, and turnover intentions. The difference of job satisfaction according to personal variables showed difference to age, career, marital status, type of work organization, and number of teachers and classes. There was a difference in infant's right respect care to age and marital status. Second, in the relationship between empowerment and job satisfaction and between empowerment and infant's right respect care, there was a positive correlation. The relationship between job satisfaction and infant's right respect care showed there is a positive correlation between infant's right respect care and all other factors except for the pay and promotion factors of job satisfaction. Third, Expert extension, autonomy, fellow relationship and job self have a positive influence on infant's right respect care. Conclusion/Implications: This study suggests that specific efforts should be made at the daycare center to raise the level of expertise and autonomy of private daycare teachers and to give satisfaction to their fellow relationship and their job self factors to effectively implement infant's right respect care.

디지털 콘텐츠 소비자들은 자신이 소유한 여러 디바이스에서 콘텐츠를 실행할 수 있는 권리를 요구한다. 최근 DRM 시스템에서 이러한 소비자 권리를 기술적으로 지원할 수 있는 많은 연구가 진행되고 있다. 사용자 소유의 디바이스들은 family domain으로 정의할 수 있다. 기존의 family domain 관리기법들은 지정된 디바이스 외의 디바이스에서도 콘텐츠가 실행될 수 있거나 또는 도메인에 지정된 최대 디바이스 개수에 도메인 관리 키가 영향을 받게 되어 키 관리를 효율적으로 할 수 없다는 단점이 있다. 본 논문에서는 family domain에 현재 포함된 디바이스들의 누적된 식별자를 이용하여 지정된 디바이스 중 하나가 교체되어도 새로 지정된 디바이스를 포함하는 디바이스에서만 콘텐츠가 안전하게 실행될 수 있으며 지정된 디바이스의 최대 개수와 독립적으로 도메인 관리 키는 실제 사용하는 디바이스에 따라 동적으로 생성될 수 있는 family domain 관리 기법을 제안한다.

본 연구에서는 대단위의 도시개발사업을 시행하면서 사업완료 전에 토지를 분양받은 수분양자가 사업완료 전이라 분양 받은 토지의 지적공부 및 등기부가 없어 완전한 토지재산권행사를 하지 못하는 문제가 발생하여, 이에 대한 대안으로 환지예정지토지로 등기를 하여 권리행사를 할 수 있는 개선방안을 제시하고, 실제 도시개발사업시행지구를 대상으로 개선방안에 의거 환지예정지로 등기를 해보았고 분석결과 현행 법ㆍ제도로도 개선시행이 가능하다고 판단하였다.
