The purpose of this study is to empirically analyze the effect of cultural distance between partner firms on international joint venture performance, focusing on the moderating effects of the conflict resolution techniques and the competitive relationship between partner firms. We tested hypotheses based on joint venture firms that were surveyed which formed by equity investment between Korean and foreign firms in the manufacturing industry. The empirical analysis results of this study are as follows. First, in international joint ventures, the cultural distance between partner firms was found to have a negative effect on the international joint venture performance, and the higher the cultural distance, the lower the joint venture performance. Second, it was found that constructive conflict resolution techniques weaken the negative impact of the cultural distance between partner firms in international joint ventures on the performance of international joint ventures. Third, competitive relationship between international joint venture partners showed no moderating effect on the relationship between cultural distance and international joint venture performance.

SI 산업은 단기간 동안 급성장을 거듭하여 국내 소프트웨어 산업의 가장 큰 시장을 형성하고 있으며, 지식과 기술집약적 고부가가치 기간산업이다. 세계무역기구(WTO) 체제로의 급속한 국제 경제변화로 고도의 기술력을 가진 해외 서비스가 국내시장에 들어오고 있고, 국내 SI업체들도 그동안 쌓은 기술을 바탕으로 해외진출을 추진하고 있는 상황이다. 본 논문에서는 국내 SI산업의 특정과 현황을 분석한 후 국제 경쟁력 강화 방안을 도출하고 국내 SI 산업의 적합한 해외진출 방안을 제시하고자 한다.

지난 7년간을 끌어오던 우루과이 라운드 협상이 우리나라 농민을 비롯한 온 국민의 심각한 우려와 관심하에 마침내 1993년 12월 15일에 스위스 제네바의 GATT 다자간 회의에서 타결되었고 1994년 4월 16일 모로코 마라케시의 협상국 각료 회의에서 최종 서명됨과 동시에 세계무역기구(WTO)가 발족됨으로서 활을 비롯한 15개 작목의 비교역적 기초농산물마저도 예외없이 국제적 관방이 불가피하게 되었다. 이와 같은 현실하에서 국민 기본식량의 안전보장, 국토의 생태환경보전, 전통문화 및 경제사회문화의 안여적 발전등에 기본역할을 하고 있는 벼농사를 지키기 위해서는 금후 2004년까지 10년의 유예기간을 통하여 국산미 품질의 상섬화 및 다양화, 성력화 및 생산비 저감재배, 안전적 재배기술 혁신에 의한 생산성의 극대화, 가공 및 유통의 개선등으로 국제 영향력을 획기적으로 높여 나가야 할 것이다. 따라서 본보에서는 국내산 쌀의 국제경쟁력을 강화하기 위한 찰 정질의 고유화 및 다양화와 성력화의 비용 및 생산성 제고에 대하여 품종개량 및 재배기술면에서 중점적으로 검토해 보고자 한다.

국제연합무역개발회의(UNCTAD)가 1976년 제4회 나이로비 총회이후, 추진해온 일차산품 종합계획 중 천연고무에 관한 교섭은 79년 10월초에 정리되어 정식으로 천연고무 상품협정이 발족하게 되었다. 동협정은 80년 1~6월간에 제네바에서 각국이 서명하고, 7~9월에 각국에서 비준하여 10월에 발족될 전망이다. 완충재고를 중심으로 한 동협정은 UNCTAD의 18개품목의 협정 중, 경제조항과 의무분담을 골자로 한 협정으로서는 처음 있는 일로서 주목되고 있다. 동협정은 천연고무가격의 안정과 공급안정을 목적으로 한 것이나, 동협정이 발효되더라도 현재에는 최고가격인 270싱가포르센트 이상으로 되어 있으므로 당분간은 아무런 효과도 거두지 못할 것으로 보인다. 고무업계에서는, 「천연고무가격이 안정되는 것은 환영하고 있으나 고가안정으로 (주석협정과 같이) 될 두려움마저 있다」고 평하고 있으며, 원재료앙등에 고심하고 있다. 전문 68조로 된 천연고무 국제협정의 내용은 다음과 같다.

The purpose of this study is to investigate the environmental regulations in chemical substances for international trades. The recently increasing awareness of environmental protection is gaining its momentum in trade. With the rapid scientific advancements and its social changes, we have faced a number of urgent issues in environment. As the regulation of chemicals have been reinforced, many countries are in situation of having to respond to environmental regulation. The environmental regulation affect many companies within the supply chain because of regulating the whole the process of products, particularly IT industries.

최근의 경제위기가 진행되는 과정에서 국제원유가가 급속하게 하락하고 있다. 거시경제적으로 볼 때 원유가의 하락은 생산측면에서 요소가격의 하락, 수요측면에서는 상대가격의 변동이라는 상호작용을 유도하게 된다. 본 연구는 연산일반균형모형(computable general equilibrium : CGE)을 구축하고 외생변수의 영향에 대한 모의실험을 하여 거시경제적인 측면에서 정량적인 효과를 측정하는데 목적이 있다. 신고전학파적인 이론에 기초한 CGE모형을 설정하고 국제원유가가 32.8% 하락한 외생적인 충격에 대하여 모의실험한 결과는 다음과 같다. 원유가 하락은 GDP성장률을 약 l.59% 상승시키고 물가가 l.2% 하락하는 거시경제적 측면에서 긍정적인 효과를 가져오는 것으로 계산된다. 또한 에너지 수입이 전체 무역에서 큰 비중을 차지하고 있기 때문에 국제수지의 측면에서도 약 47억 달러 개선효과를 가지는 것으로 나타난다. 상대가격의 변동은 산업별로 다른 효과를 가지는데 에너지를 집약적으로 투입하는 산업을 중심으로 산업별 생산량과 가격에서 상이한 효과를 보이는 것으로 나타났다.

전략적 비지니스 동맹의 형성은 많은 국가에 있어서 산업전반에 걸쳐 점차 유력한 전략적 목표가 되고 있다. 국내 전략적 동맹 모델을 국제 모델로 확장할 수 있는 가능성이 있다. 세계적인 전략적 비지니스 동맹은 세계적으로 불확실한 경쟁 상태의 환경하에서 안정확보와 위험요소를 줄일 수 있을 것이다. 국제적인 구매자와 판매자를 연결시킬 가능성이 있는 기술은 완전히 개발되어 있으나, 빠른 속도로 이용되지 못하고 있다. 국제 임산물 무역에 있어서 판매자와 구매자가 기술을 채택하는데 점점 복잡해짐에 따라 장래에 전략적 동맹은 계속해서 발전할 것이다.

국제 무역에 있어 한 중 일 삼국은 동아시아에서 차지하고 있는 비중이 클 뿐만 아니라, 전 세계 컨테이너 물동량의 30% 이상을 차지하며 세계 물류 흐름에서 큰 역할을 차지하고 있다. 하지만 각국의 물류 정보시스템이 각각 다르고, 관리 체제나 연계 방안이 마련되어 있지 않아 정보 연계 시 많은 문제점이 발생하고 있다. 이를 해결하기 위해 한 중 일 삼국은 정보를 공유하고 관리할 수 있도록 동북아 물류정보 서비스 네트워크(이하 NEAL-NET) 구축 사업을 진행하고 있다. 본 논문에서는 NEAL-NET 프로젝트의 진행 사항과 의의를 살펴보고, 추후 국제 물류정보 공유 협력을 위한 표준화 방안에 대해 연구하였다.

The increase in international trade is clearly reflected by litigation and arbitration. Despite the importance of international commercial transaction, until very recently little was known about how the law interacts with actual practice. The CISG obviously plays an important role, but we are concerned with using choice of law to resolve issue that the CISG leaves unresolved. The case law UPICC is now accessible by means of UNILEX, the database on international case law that focus on CISG cases. The courts and arbitration tribunals throughout the world are developing a growing body of international case law on issues not resolved by the CISG, though arising from transactions to which the CISG applies. The application of the CISG is obligatory due to its nature as hard law an international convention. However, UPICC are only restatements and more flexibility, comprehensive instrument than CISG. This article offers to promote the UPICC application from their present status as a mere soft law instrument through analysing UNILEX cases.

In determining the content of the FET standard, the tribunals stated protection of investor's legitimate expectations, due process and denial of justice, transparency, discrimination and arbitrariness, good faith, etc. The most major elements of the FET standard is the protection of the investor's legitimate and reasonable expectations. It is necessary to consider whether it is possible to what the expectations of investors are protected as legitimate and it is formed under any circumstances. If host state frustrate investor's legitimate expectations, it found a breach of the FET. The host state's specific assurance may reinforce investor's expectations, but such explicit statement is not always necessary. The host state must preserve a stable environment for investments. However, It must not be understood as the inalterability of the host state's legal framework. It implies that the host state's subsequent changes should be made consistently and predictably. The host state is entitled to exercise a reasonable regulatory authority to respond to changing circumstances in the public purpose. Therefore, whether the violation FET shall be determined through a balanced against the investor's legitimate expectations and the host state's reasonable regulatory exercise in the public interest. And investor should keep in mind that the principle of proportionality is applied unless host state provides stabilization clause or similar commitments to investor. Also host state should establish the basis of an argument about reasonable regulatory authority for public interest.
