  • In aviation criminal law is negligence different from in civil law and in general criminal law. The Interpretation of aviation criminal negligence must be elucidated in characteristic own way. The thesis considers the principle of trust, permissible risk and the accomplice offender.

  • Wenn man das fahrl${\"{a}}$ssige Begehungsdelikt in Bezug auf ein Niveau eines Risiko der objektiv vorhandenen tatbestandlichen Erfolgsm${\"{o}}$glichkeit und auf die n${\"{o}}$tige Sorgfaltspflicht, die die T${\"{a}}$ter nimmt, um das solches Risiko abzuhalten, berucksichtigt, ergibt sich der spezielle Fall selten bei der Person, mit dem hoch-gefahrlichen Berufszweig besch${\"{a}}$ftigt ist, auf den die bestehende Allgemeine-Theorie ${\"{u}}$ber das gafahrl${\"{a}}$ssige Begehungsdelikt gleichm${\"{a}}$ssig unanwendbar ist. Bez${\"{u}}$glich des Piloten des Milit${\"{a}}$rflugzeug ergibt sich oftmals ein bestmmter Fall, die die KontroIIe des Risiko gesch${\"{a}}$ftlich uber sein eigenes pers${\"{o}}$nliches Ermessen geht, und er nimmt die Pflicht, die notwendige milit${\"{a}}$rische Zielsetzung zuerst vor allem zu ber${\"{u}}$cksichtigen, wenn auch technisch, klimatisch und umstandehalber ein normales Niveau von Risiko ${\"{u}}$bersteigt wird und zugleich ein bedenkliches hoches Risiko mit sich gebracht wird. Aus diesem Anla${\beta}$ kann man folgem, da${\beta}$ der Pilot des Milit${\"{a}}$rflugzeug ein besonderer Fall ist, auf den die Kriterien in Bezug auf das Gebiet der Regel ${\"{u}}$ber das fahrl${\"{a}}$ssige Begehungsdelikt gleichm${\"{a}}$ssig unanwendbar sind. Und weil die Vermehrung der Gefahr des Flugzeug sofort an die Vermehrung der Gefahr seines eigenen Leben angeschlossen wird und daher es eine M${\"{o}}$glichkeit gibt, da${\beta}$ der Pilot dem Resultat eines Gefahr zum ersten Opfer f${\"{a}}$llt, ist die Regelung in der Punkt der Generalpr${\"{a}}$vention gegen das fahrl${\"{a}}$ssige Begehungsdelikt sinnlos. Und auch muB die militarpolitische Punkt, die Piloten des Milit${\"{a}}$rflugzeug gem${\"{a}}$${\beta}$ dem notwendigen Ausma${\beta}$ auszubilden und das Ausma${\beta}$ zu behalten, aktuell berucksichtigt werden.

Necessity of Intent for Defense in Case of Legitimate Self-defense (정당방위에 있어서 방위의사의 필요성)

  • Self-defense is defined as 'an act which is performed in order to prevent impending and unjust infringement of one's own or another person's legal interest'(Article 21, the Criminal Act). To establish such a self-defense, it is generally suggested that it requires an intent for defense as subjective element as well as objective precondition of impending and unjust infringement of one's own or another person's legal interest' and considerable reason. Intent for defense which means an awareness for objective circumstance of self-defense is recognized as objective justification element for self-defense. With regard to intent for defense, there are various discussions on not only necessity of such an intent for defense but whether it is necessary for both actor's recognition of circumstance and specific purpose or motive and which should be applied for its punishment in case of lack of the intent for defense: consummated, unconsummated or semi-consummated. However, there is no clear regulations. This article reviews the contents of intent for defense based on opinion that it is necessary for intent for defense and then examines contents on criminal effect in case of lack of intent and intent for defense in case of criminal negligence.

  • Defamation on the Internet is a criminal offense. Of late, the damage it has been causing has grown exponentially. Here, we suggest some ideas to expand the use of arbitration in Korea. We suggest that all disputes arising in connection with current contracts be settled under the rules of conciliation and arbitration. As a countermeasure to the requirements for defamation or damages, the field of criminal arbitration regulations needs to be defined strictly. In conclusion, the UK does not make provisions for arbitration as a specific subject. With respect to foreign legislation, it is necessary to take a look at ways to expand arbitration in our country. The scale of arbitration must be expanded to allow for greater protection of criminals in exchange for their cooperation in arbitration cases and relative to the amount of the damages in dollars. There must also be detailed instructions regarding the eligibility criteria for and proper handling of these arbitration cases.

Comparison in Water Consumption, Plant and Fruit Growth of Different Europe Eggplant Cultivars in Coir Substrate Hydroponics under High Temperature Conditions (고온조건하에서 코이어 배지에서 유럽형 가지 품종별 수분소비량, 식물체 생육 및 과실 특성 비교)

  • This study aims to select eggplant cultivars adaptive to the hot temperature period greenhouse climate by water consumption, and growth performance of plants and fruits of different European eggplant cultivars, including 'Bartok (BA)', 'Bowie (BO)', 'Black Pearl (BP)', 'Ishbilia (I)', 'Mabel (M)', 'Vestale (VE)' and 'Velia (VL)', in substrate hydroponic cultivation under hot and humid greenhouse conditions. On the 118 DAT, the leaf number and stem dry weight were highest in 'VL', followed by 'M', and there was no significant difference in leaf dry weight among cultivars. The marketable fruit number per plant was 16.4 for 'M', which was higher than other cultivars, and 'VE' and 'VL' were 8.5 and 8.8, respectively. The weight per fruit was low for 'M' at 136 g, and the highest in 'VE' and 'VL' at 332 and 281 g, respectively. There was no significant difference in fruit production per plant. In this study, 'M', which has high water use efficiency and a large number of fruits, and 'VL', which required less quantity to water consumption for producing 200 g of fruit and had a high product weight, will have excellent adaptability in the UAE greenhouse condition.

  • Beim Luftfahrtunfall kann nach den Interessen der Betroffenen oder nach der Stellungsnahme von den f$\ddot{u}$r die Unfall-Untersuchung zust$\ddot{a}$ndigen Personen der Wahrheitsgehalt get$\ddot{a}$uscht werden. Um diese Sachverst$\ddot{a}$ndnis zu verhindern, ist bei der Untersuchung des Luftfahrtunfall ist de lege lata gefordert, die technische Untersuchung und die rechtliche Untersuchung sich zu trennen. Jedoch ist es umstritten, wie es wirksamvoll ist. Also neben der Garantie auf die Sicherheit als Prevention des etwaigen Unfall in Futur muss die strafpolitische Seite beachtet werden. Damit ist es erforderlich, dass das bestimmte Mittel bereitstellt und damit den Betroffenen ihre Verantwortung erlassen k$\ddot{o}$nnen, wenn sie beim Unfall-untersuchung dienen. Und die Folge der technischen Untersuchung $\ddot{u}$ber den Unfall soll eine kurze Weile insofern nicht ver$\ddot{o}$ffentlichen, als ein gesetztiichcr Urteil noch nicht festgestellt wird. Jedoch wird diese Nicht-ver$\ddot{o}$ffentlichkeit Vorwurf wegen der langfristigen Verhinderung auf die Informationen gemacht, in den man die Elemente von der Gefahr ergreifen kann. Deswegen wird Vorwurf gemacht, da${\beta}$ diese Verhinderung auf die Infonnationen wider das Wesen von dem Gesetz zur Luftfahrtunfallgesetz ist.

The Study on Aviation Crime in Aviation Safety and Security Act of Korea ("항공안전 및 보안에 관한 법률"에 있어서 항공범죄에 관한 연구)

  • Soon after September 11 attacks in 2001, there were strong demands in Korea on making relevant laws and regulations on aviation security, and Korean parliament legislated "Aviation Safety and Security Act"to fulfill the demands on safety and security of aircrafts during aviation. However, the current Aviation Safety and Security Act seems to have many problems which do not meet the practical needs in Korea, because there were not enough considerations on the practical needs and extinguishable national circumstances on civil aviation system in Korea, but only regarded the relevant international conventions and foreign practices on it. In this context, it is necessary to amend several provisions in Aviation Safety and Security Act to enhance more practical efficiencies in its implementation through systematization of the provisions on crimes which may happen during aviation. In this context, this article argues two main issues. First, Article 39 of Aviation Safety and Security Act does not express whether it is possible to punish the attempt of crime of causing damage to aircraft. Therefore, regarding a principle of legality, it is impossible to punish the perpetrator even when coincidently failed to destruct or damage aircraft. In this context, this article argues that the necessity to introduce the possibility to punish the attempt of crime of causing damage to aircraft. Second, regarding Article 160 of Civil Aviation Act of Korea, current Aviation Safety and Security Act should be amended by guaranteeing the culpability of negligence of crime of causing damage to aircraft.

  • 오이(Cucumis sativa L.)는 1년생 초본의 덩굴성 박과 작물로 미숙한 과실을 다양한 식품 용도로 이용하고 있다. 오이는 시설재배기술 확립으로 연중 생산과 공급이 가능하나 내병성 품종개발이 필요한 실정이다. 또한 오이의 다양한 생리활성 물질에 대한 관심이 높아지고 있어 이를 위한 다양한 오이 자원이 필요한 실정이다. 본 연구에서는 국내외에서 수집한 오이 180자원의 형태적 특성을 분석하여 육종 소재로 활용하는데 있어 기초 정보를 제공하고자 하였다. 본 연구에서 사용된 오이 자원의 원산지는 조지아 98자원, 한국 37자원, 중국 28자원, 우즈베키스탄 17자원이었다. 오이 180자원은 모두 덩굴손을 가졌으며 자웅동주로 조사되었다. 착과습성은 주지형 83자원, 주지 및 측지형 97자원으로 조사되었고 절화당 자화수는 175자원이 2개로 조사되었으며 5자원은 1개로 조사되었다. 과형은 장원형 87자원, 단원형 92자원으로 대부분을 차지하였으며 과선단좁은형이 1자원 조사되었다. 과기부형태는 평평한 형태 83자원, 휘어진 형태 94자원으로 대부분이었으며 오목한 형태 1자원, 뽀족한 형태 2자원이 조사되었다. 과선단의 형태는 평평한 형태 148자원, 휘어지 형태 32자원으로 조사되었다. 오이 유전자원의 개화기는 60~80일로 평균 66.1일 이었으며 과실 성숙기는 33~68일로 평균 49.6일이었다. 국가별로 개화기는 62.4일(중국)~68.5일(한국), 과실성숙기는 48.3일(중국,조지아)~54.1일(우즈베키스탄)로 조사되었다. 본 실험에서 조사된 오이 유전자원의 형태적 특성은 오이 선발에 있어 기초 정보로 활용 가능할 것이며 추가적으로 농업형질, 내병성, 기능성 분석등의 오이 육종 프로그램을 위한 다양한 자원 평가 및 선발이 필요할 것이다.
