This study has been carried out in order to observe the status of performance warranty contracting system currently being implemented at the advanced countries including Europe, U.S.A., and Japan, review the introduction feasibility and possibility. For this purposes this study has surveyed the concept and necessity of performance warranty contracting system as well as the status of domestic performance warranty contracting system. Especially the application environment for the performance warranty contracting system of Europe, U.S.A., Japan and Korea in terms of maintenance guarantee liability system, performance warranty regulations for design-build contracting system, selection method of successful bidder, performance warranty means, project contracting system including maintenance cost, and specifications and contract conditions for performance warranty system have been comparatively evaluated. And introduction methods of performance warranty contracting system were suggested.

Warranty contracting is contracting methods that European Countries have applied to asphalt pavement projects from long ago, and in America as the expected effects of the warranty contracting are being verified to introduce it, the number of projects with warranty is being increased rapidly. In Japan, the warranty contracting suitable for Japanese style was established and is being applied. This study investigated and analyzed the present state of the warranty contracting being applied to European countries, America and Japan, and suggested advantages and disadvantages in introducing the warranty contracting into Korea and directions to introduce it. The principal result of this study is that performance bond contract system, performance surety bond system and performance bidding system should be established to introduce the warranty contracting into Korea.

방산업체는 정부를 상대로 제한된 시장에서 생산업무를 수행하고 있기 때문에 완전경쟁시장과는 다른 특수한 상황에 직면해 있다고 할 수 있으며 그 동안 정부와 방산업체간에는 상반된 이해관계로 인해 많은 문제점이 있는 것으로 드러났다. 따라서 이 글의 목적은 계약제도의 효율성과 합리성을 구현하기 위해 기존의 계약제도를 미국과 일본의 선진계약시스템과 함께 분석하고, 더욱 발전시켜야 하는 제도는 장려할 수 있도록 방안을 찾고자 한다.

Warranty contracting for pavements construction has been widely used in Europeans countries, Japan, and the U.S. and the benefits of warranty contract has been proven. This research investigated the European, U.S., and Japanese warranty contract policies and compared pros and cons. The most appropriate warranty contract policy solution is developed to fit in the Korean construction industry culture. Three main conclusions have been developed in this study: (1) performance specifications should be developed; (2) the systematic method is required to estimate the appropriate costs of performance bond and warranty period, etc.; and (3) short and long term plans for adopting performance warranty contract in Korea are suggested.

현재 부품 국산화 조달계약제도는 비용보상형 계약제도로서 업체의 국산화에 대한 유인책이 별로 없으며, 수입부품을 국산화하여 원가절감을 하여도 이득이 없는 경우도 발생하고 있는 실정이다. 따라서 국산화를 촉진시키기 위해서는 국산화하면 할수록 이윤이 커지는 원가절감 보상형 계약제도를 적극 활용하며, 국산화한 경우에는 개발부품에 대한 품질인증, 행정소요시간 단축 등 조달여건을 개선하고, 개발에 따른 인센티브를 높여 주어야 한다.

최근 정부계약제도는 하루가 다르게 변해가고 있습니다. 행정자치부에서는 지방정부출범 10년 맞이하여 지방자치단체의 특수성과 성격을 반영한 「지방자치단체를 위한 계약에 관한 법률」을 제정하여 올해부터 본격적인 시행에 들어갔으며, 국가계약제도 역시 정부가 추진하는 건설산업 경쟁력 강화 및 선진화 사업과 맞물려 최저가낙찰제도 확대, PQ 및 적격심사 제도의 개편, 각종 계약관련 하위 규정 통폐합 등 계약 및 입 · 낙찰제도 전반에 걸친 개편작업이 추진되고 있습니다. 본지는 이러한 정부계약제도의 급격한 변화의 흐름과 발맞추어 평소 회원사들로부터 자주 질의를 받았던 내용을 중심으로 정부시설공사입찰실무에(전문공사 50억 미만 적격심사 중심) 대한 내용을 3회에 걸쳐 게재 할 예정이오니 업무에 많은 활용 있으시기 바랍니다.

The contract screening system is being introduced and operated as a model of advance budget reduction for local fiscal efficiency. But as the authority recognizes the contract screening system as a means of budget reduction, and companies recognize it as a means of budget curtailment, a contradictory understanding structure on the contract screening system is being formed. This research was prompted to propose a development method that will enable the contract screening system operating in Jeju Special Self-Governing Province to be appropriately established as a model of advance budget reduction. To achieve this, the operating status of the contract screening system was analyzed, and the recognition level on the contract screening system of the local government and companies was analyzed on the basis of contract screening data.

국가 발주 공사는 3월 1일, 지방자치단체 발주 공사는 3월 9일 예정가격을 작성하는 사업부터 표준시장단가 제도가 적용된다. 대한설비건설협회(회장 이상일)를 비롯한 건설관련 유관단체에서는 실적공사비의 불합리한 공사비 산정 기준 및 운영관행에 대해 폐지 건의를 지속적으로 해왔다. 정부는 이같은 건의를 받아들여 지난해 12월 17일 실적공사비 제도개선을 위한 공청회를 개최하고 개선안을 발표했으며, 이번 계약예규 개정을 통해 개선됐다. 이에 따라 실적공사비 제도를 대체하는 새로운 공공공사비 산정 방식인 표준시장단가 제도가 지난 3월 1일부터 시행에 들어감에 따라 기획재정부는 국가계약예규를, 행정자치부는 지방계약예규를 개정해 각각 지난 3월 1일과 3월 5일 공포하고 시행에 들어갔다. 각 개정 계약예규는 실적공사비의 명칭이 표준시장단가로 변경됨에 따라 용어를 수정했고, 실적공사비 제도 적용배제 범위를 신설했다. 또한 적용배제 공사범위는 300억원 미만 공사 중 100억원 미만 공사는 실적공사비(표준시장단가) 적용을 폐지하고, 100억원 이상부터 300억원 미만 공사는 2016년 12월 31일까지 한시적으로 적용하지 않는다. 정부는 100억원~300억원 공사에 대한 '실적공사비 적용 배제제도' 연장 여부를 2016년 하반기에 실적공사비 현실화 수준 등을 평가하여 재검토할 예정이다. 한편, 표준시장단가 제도는 공사비를 산정할 때 현행 계약단가 외에도 시공단가와 입찰단가 등 다양한 시장 거래가격을 반영하는 제도로, 지난 1월 22일 국가정책조정회의를 거쳐 확정된 '공공건설 공사비 적정성 제고방안' 후속조치의 일환으로 공공공사비 예정가격 산출방식의 하나인 실적공사비제도를 개선한 것이다.
