  • 피의자신문시 변호인이 참여할 수 있도록 명문 규정을 둔 2007년 형사소송법 개정은 진일보한 개정이라 할 수 있다. 그러나, 피의자신문시 변호인 참여 제도는 현재까지도 제대로 활성화되지 못하고 있는 실정이다. 이 제도를 활성화하기 위해서는 첫째, 피의자에게 국선변호권이 확대되어야 할 것이다. 둘째, '검사의 사법경찰관리에 대한 수사지휘 및 사법경찰관리의 수사준칙에 관한 규정'의 문제점이 개정되어야 할 것이다. 셋째, 수사기관에 대한 교육이 강화되고 변호인에게 수사 일정 등 통지가 제도화 되어야 할 것이다. 이러한 대책을 통해 피의자신문시 변호인 참여 제도가 활겅화되어야 피의자의 인권이 제대로 보장될 것이다.

  • The ultimate goal of the local government is the owner of the residents welfare of the community. Welfare of the residents will start from the protection of life and property of the inhabitants. Much of this protective activity is a function of the police. Therefore, to be a municipal & local police that is based on the autonomy of the local conceptual prerequisites for the welfare of the population. Municipal & local police activities are activities for the local community rooted in the community that the police and to rejoin the community, municipal & local police activities taking place in the center of the area to solve the problem, but to reduce the fear of crime and disorder, crime as an expression of the efforts of the local residence themselves to improve the overall quality of life of the community as a partner recognition local residents. Municipal & local police in this case be introduced across the board in the central and local governments is careful review of the various alternatives been prepared on analysis is crucial to reduce the trial and error by providing the best alternative. priority should be to figure out exactly what the reason to introduce a municipal police. in other words, the introduction of the municipal & local police in the central and local governments, state police and municipal & local police, the ruling party and the opposition, regional self-government initiative unseen conflict between organizations and local governments are not welcomed by local residence in local time truly 'safe' and will have to face that the 'improve quality of life'.

  • In Korea, all investigations of maritime crime such as murder, robbery, drug trafficking, and illegal fishing that have been committed at sea are under the jurisdiction of maritime police. As maritime crimes tend to have more unique cases, cause damage on a larger scale, and be limited to evidence that is possibly contaminated, compared to non-maritime crimes, the cases demand maritime police investigators with a higher level of expertise. However, there is currently a lack of competent investigators in the maritime police, leading to the training of maritime police investigators in training agencies. so many of maritime investigators goes to land police training agency including Korean Police Investigation Academy. Therefore, in order to improve the capabilities of maritime crime investigation we must first gather information and data in relation to maritime crimes to foster more investigation specialists, and establish specialized training agencies offering a training course more focused on maritime crimes.

  • 카르텔 규제에서 가장 중요하고도 어려운 문제는 위법행위를 적발하고 이를 뒷받침하는 증거를 확보하는 일이다. 카르텔에 대한 법 집행의 실효성을 제고하기 위해서는 반드시 카르텔을 효과적으로 적발$\cdot$입증할 수 있는 조사수단을 갖추어야 하는바, 경쟁당국의 사법경찰권은 카르텔에 대한 법 집행상의 문제를 극복하기 위한 주요 수단이 된다. 한편 카르텔에 대한 강제 조사권은 카르텔의 적발$\cdot$처벌확률을 높임으로써 카르텔 행위자의 자진신고 및 조사협조의 유인을 강화하여 leniency program의 실효성 제고에 기여할 수 있다. 그렇지만 성격상 남용의 우려를 야기하므로 사법경찰관 제도는 반드시 선진국 수준의 엄격한 요건과 절차에 따라 운영되어야 할 것이다.

  • The primary agent of civil investigation businesses must be a corporation to line up with public interests, and the government has to carry out the permit system on business owners. As many countries such as those of European and Japan supervise civil investigation business and the police agent supervises guarding businesses, so the police also has to supervise civil investigation business. In many cases, civil investigation businesses deal with private information, and the police has to prevent from infringing customers' basic right by clarifying private information management for punishment. In addition the police has to tighten up customers' obligations. For example the police has to deliver papers about the contents when they enter into or change contract, or after they enter into contract.

  • The existing legal regulations that indiscriminately distributed various illegal information on the information network are discussing focused on civil liability and criminal liability. however, at this paper that approached with problem of police responsibility as a target of the exert of police authority for blocking illegal information on the information network. based on this recognition, this paper propose the problem and reformation about the present Information Communication Networks law's 7 of Article 44, Section 2 that for prompt blocking illegal information on the information network, not about direct regulatory approach to a person in charge of act but about the information network service provider which is a person in charge of condition.

  • The police is responsible for protecting nation's property and life. Protecting nation from crime among the core duties is the most important activity of the police. But the big problem on reported crime system of the police was founded in the recent Suwon incident. Unfortunately, the unprofessional response made a toll of human sacrifice. Taking this opportunity, we need to consider closely the problems of the reported crime and system of the police and the solutions on the problems. This study analyzes the reported crime system of the police from the law and institutional and try to seek the solutions. This study searches the management status of the police system and arranges the problems in legal and institutional terms. And then, it arranges the solutions on the problems.

A Study on the Effects of Criminal Investigators' Job Satisfaction and Organizational Commitment (수사경찰의 직무만족과 조직몰입에 관한 연구)

  • This study examines the degrees of criminal investigators' job satisfaction and organizational commitment and investigates which factors determine the variations in them. In the first step of analysis, independent variables of criminal investigators' job satisfaction consist of work itself, achievement, responsibility, safety, stability, interpersonal relations, recognition, supervision, and opportunity of growth. In the second step, job satisfaction is a mediating variable and organizational commitment is a defendant variable. Organizational commitment is classified into three types - "affective", "continuance" and "normative". According to the structural equation model analysis, responsibility has a great influence on job satisfaction, and job satisfaction affects affective commitment and continuance commitment. This study suggests that job satisfaction should be increased to improve criminal investigators' organizational commitment. And responsibility is necessary for the improvement of job satisfaction. Despite the professional detective system operating in Korea since January 1, 2005, the level of criminal investigators' recognitions of safety, stability and opportunity of growth turn out to be low. Based on these findings, this study presents four ways to reform measures which are listed below. First, to improve a! n economical circumstance of criminal investigators, any expense associated with criminal investigation should be paid by organizations. Second, to improve safety of criminal investigators, it is necessary to develop and supply enough police equipments. Third, criminal investigators' working hours should be shorten. Fourth, to improve criminal investigators' responsibilities, criminal investigators should be allowed to conduct criminal investigation independently from the prosecution.

Legal framework and practices of public order management in England and Wales (잉글랜드와 웨일즈의 공공질서 관리 관련 법적 틀 및 법집행 형태)

  • Public order management is one of the most important areas in policing. Drawing on the legal framework and policy, this study aims to assess practices of criminal justice practitioners, especially, police and prosecutors, in England and Wales. Using qualitative interviewing, four main themes are identified: (1) an emphasis on a right to protest, (2) police practices on public order management, (3) the development of police/prosecutor liaison, and (4) the value of video evidence. Based upon these findings, several legal, policy and practice implications are drawn. These implications involve a wide range of aspects concerning strategic, operational, and tactical interventions by the police, as well as collaboration between police and prosecutors. Although the criminal justice context in England and Wales is very different to South Korea, some practices and distinctions can be useful to consider in the Korean context. This study suggests that more gains can be made if legislation, policy, and practice across criminal justice nodes can be coordinated and approached holistically.
