  • The construction project is a complex undertaking involving multiple participants. Conflicts are inherently natural in the construction projects and subsequently, a success of projects mainly depends on how well to cope with the conflicts. In the past, courts usually took the position that the professional's exposure in damages for negligent performance of any of his/her duties would not extend to strangers to the contractual arrangement. However, courts today generally reject that rationale which was earlier in vogue and protect architects, engineers, and contractors from being liable to third parties. It means that the lack of privity of contract could rarely protect a profession in a suit alleging the negligence or professional malpractice in preparing plans or specifications. The main goal of this paper is to enhance the understanding of the legal aspect of privity and to provide the trend of no-privity disputes through the analysis of lawsuit cases during the last 40 years. On the base of the analysis, importance of the third relationship and the liability in construction disputes is presented.

  • In the Chinese construction industry, the utilization of Building Information Modeling (BIM) aims to increase the total output of the construction industry by solving the problem of inefficient interoperability in the construction industry. In 2011, the Chinese Ministry of Housing and Urban-Rural Development despite the technical advantages of BIM and the government policy, the BIM adoption rate in China is lower than 45%. Meanwhile, as the South Korean construction industry is a step ahead of its Chinese counterpart in introducing and utilizing BIM, it is expected that BIM is more actively utilized and accepted in South Korea than in China. According to a comparative study based on the hype-cycle theory, South Korea is at a more advanced stage of introducing BIM, than in China. This study aimed to suggest how to increase BIM utilization rates in China. To this end, this study comparatively analyzed factors affecting BIM acceptance between China and South Korea. For the comparative analysis of the BIM acceptance factors between China and South Korea, literature reviews on the technology acceptance model (TAM) and BIM acceptance model were carried out, and based on that, the BIM acceptance factors were classified. Other BIM acceptance factors were also added and considered, as they reflected Chinese national characteristics and construction industry. As for the derived BIM acceptance factors, construction project participants, especially actual BIM users in China and South Korea, were targeted for the survey. A t-test using SPSS 22.00 was carried out to identify significant differences in data. Finally, based on the t-test results, this study suggested ways of improving the BIM utilization rate in China. Based on the findings, this study is expected to contribute to activating BIM adoption in the Chinese construction industry and also to set a theoretical foundation for future studies on BIM utilization in the industry.

  • Although studies evaluating the effects of the blasting vibration on the adjacent structures from various angles have continued, cases of securing the safety of the adjacent buildings and researching the proper blasting method for the field condition by analyzing the vibration waveform of the measuring field while performing the open pit blasting are poor. Therefore, it is necessary to present a remedy for blasting pattern selection through test blasting that is appropriate for field conditions, and is economical and efficient. In this study, open pit blasting work was conducted based on the separation distance applied according to the standard blasting method by test blasting and the vibration regulation standard in the road expansion construction site to measure the blasting vibration value, and the vibration prediction equation by blasting methods was examined using a regression analysis computer program to calculate K, N, and R of the confidence level 95%. By setting the blasting allowed vibration standard of the test blasting target area to 0.3cm/sec, and the charring weight and blasting method by the separation distances according to the blasting vibration estimation equation of the open pit blasting guideline and the blasting vibration estimation equation of the test blasting were compared/analyzed, it was possible to identify the factors that increased the working expenses. In addition, the measurement and analysis of the adjacent structures during open pit blasting and the blasting vibration were performed after selecting the most adjacent structure to the open pit blasting spot to analyze the problems on the test blasting procedure and analysis method in the open pit blasting design/construction guidelines, which appeared in the process of completing open pit blasting construction, and a remedy is presented.

  • In the remodeling projects, clients without architectural expertise have limitations in presenting requirements accurately. In some cases, designers and contractors may not recognize their demands exactly, and deliver final products that are different from the clients' intentions. 3D modeling visualizing final products in previous has been regarded as a solution to enhance understanding and communication. However, this approach has the limitation that the final results are presented as a virtual outputs. In the remodeling project, an alternative, mixed-reality, is likely to reinforce the reality as it enables to present remain structure and the parts to be built together. This paper examines the mixed reality as a solution to support decision making of clients and practitioners in remodeling projects. The examinations is conducted in high-rise office remodeling projects by means of action-research. Clients and practitioners, overview product models presented in the format of 2D drawings, BIM and mixed reality asked to evaluate the effectiveness of each methods in 12 standards. The results have shown that mixed reality has improved the sense of reality, making it easier to predict results, but recognizing patterns is difficult in some areas such as the floor, and it caused dizziness.

  • In this paper, field study results about accumulation of sediments and its property in the forebay of wetland aiming at stormwater from rural area wherein intensive cow feeding lots are operated are provided. In addition, some design aspects are discussed. Amount of sediment generation in the longitudinal direction of forebay was found to be affected by hydrological factors such as rainfall depth and intensity. Nutrient contents in the sediments of this wetland were 10 times higher than those in stormwater wetland in rural area without animal-feeding lot. Total-Pb and As contents show similar level to values from the soils of surrounding watershed, but Total-Cu content was higher due to the animal feeding lots. Yearly amount of sediment generation, its depth and volume were estimated to 13tons, 23cm, and $65m^3$. Based on these results and recommended guideline by Korean Ministry of Environment, dredging frequency was found to be about 2.7years. The shape of forebay has to be carefully designed to deal with a great change in flow rate. According to the results of sediment depth analysis, instead of the present rectangular, wedge-shape forebay is more desirable in handling scouring caused by high flows.
