This study analyzed problems of operating performance bond for public works and derived some suggestions for improvement. The Contract Law for Government Owner requires to submit performance bond which guarantees performing the construction contractor pays back compensation money when the obligation is not executed. Currently, first bid eligibility for participation is exactly required for executing company of performance bond obligation, not considering volume, technical level, and special type of remaining works. In collaboration contract, if guarantee accident occurs, it is obliged for remaining collaboration contractors to be qualified to fulfill the whole contract. This study proposes following improvement plan to solve problems of current performance bone in public works. Firstly, qualification criteria must be deregulated exceptionally for selecting proper contractor, which executing performance bond obligation, considering progress and characteristics of remaining works. Secondly, In collaboration contract, the prerequisite of remaining contractors' should be deregulated as 'implementation requirement of the remaining works'from'implementation requirement of the whole work'. Finally, defect responsibility should be included in liabilities of performance bond by specifying that owner or guarantee agency bear them.

지난 11월1일 부정방지대책위원회(위원장, 이세중 대한변호사협회 회장)는 감사 원장에게 문민정부가 추진하고 있는 부정$\cdot$부패척결을 위한 사정차원에서 건설제도 개혁이 이뤄져야 한다는 의미가 담겨있는 $\ulcorner$건설부조리 실태 및 방지대책 보고서를 제출했다. 이 보고서에서 (1)건설사업의 기본절차 법제화 (2)정부공사단가 현실화 (3)도급한 도액의 분리 (4)최저가낙찰제 정착 (6)입찰정보누설 제재 강화 (6)담합적발기구 설치 (7)담합카르텔 형성 방지 (8)계열화에 대한 인센티브 부여 (9)주택사업자의 하도급법 적용 (10)하도급직권 실태조사 강화 등이 건의 되었으며, 특히 불공정거래 근절을 위해 현행 하도급대금 직불요건에 대금 결제 지연가능성이 높은 덤핑낙찰공사를 추가하고 하도급실태조사결과 대금지급관련 위법사항이 적발되면 관계기관 직권으로 일정기간 직불케 하는 등 하도급대금 직불제도를 확대해야 한다고 밝혔다.또한 하도급계약에 있어 대금지급 문제를 근원적으로 해결하기 위해 원도급업자의 하도급대금 지급을 보증하는 지급보증제도도 확립해야 한다고 밝혔다.

For the restoration of construction industry, the government have offered the policy since the end of 1990. It has offered to develop the world-class technology and establish the effective production structure. In the government policy, the delivery and contracting method has improved so that construction industry could be recognized. Foreign countries have conducted the R&D and application of Innovative Contracting for improvement of facilities, reduction of LCC and innovation of contractor. Among the Innovative Contracting, 'Performance Warranty Contracting' is defined that A guarantee of the integrity of a product and of the makers responsibility for the replacement or repair of deficiencies. Performance Warranty Contracting is used for technology developments of contractor, improvement of quality, reduction of LCC, prevention of early deficiencies and reduction of owner's inspection works. This paper analyzes concept and effects of Performance Warranty Contracting and presents considerations according to the introduction.

올해부터, 국토해양부 장관이 고시하는 최저가낙찰제 대상공사에 대하여 포괄대금지급보증제도가 시행되며, 건설근로자 노무비 구분관리 및 지급 확인제가 추진된다. 또한 근로계약 체결시 근로조건 일반사항이 명시된 서면을 근로자에게 반드시 교부해야 하며, 장애인 고용부담이 강화된다. 본지는 올해부터 달라지는 건설 중소기업 관련 개편 시행되는 각종 제도를 소개한다.
