상조서비스 및 정보 이용에 관한 현행법상의 개선점

상조서비스 사업의 본질은 상품과 서비스를 일반 상거래로 보는 것이 일반적인 시각이다. 사업자 즉 상례와 관련된 상조조직과 상조회사가 서비스이용자와의 계약을 통해 이루어지는 계약을 통해 장래 회원의 요구시점에 상품과 서비스를 제공하고 회원은 그 가격을 현재의 가격으로 대금을 지급하되 할부로 지급하는 것이다. 이런 상조업은 2005년 이후 이를 수행하는 업체수가 급증해 규모면에서도 3조원이 넘을 것으로 추정되는 거대한 사업으로 확장 되었다. 그러나 상조업 자체가 선불식 할부거래라는 특성 때문에 현행 개정된 할부거래에 관한 법률에서 규정하는 내용은 과거보다는 현실화가 되어 있기는 하지만 미흡한 점은 여전히 있다고 본다. 예를 들면 상조조직과 상조회사의 가입자에 대한 설명의무, 선수금예치계약에 따르는 소비자보호문제, 상조회사 설립시의 자본액의 상향 문제 등 제반 법적 검토 사항에 대한 입법적 불비가 그러하다. 본 논문에서는 이런 점들을 검토하고 다양화된 상조서비스 이용자의 점진적이고 확대되는 상조산업의 발전을 위하여 지적한 법적 사항에 대한 개선점과 할부거래에 관한 법률과 별도의 상조업법의 단일 입법을 결론적으로 주장하였다.
